VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street June 5, 2017 - 6:00 PM Meeting Minutes CALL TO ORDER The June 5, 2017 Village Board meeting was called to order by President Chris Zellner at 6:02 p.m. ROLL CALL Present: Phil Willems, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, Bill Ranum, Sam Ballweg Absent: None Also Present: Roberta Baumann, Julee Helt, Todd Schmidt, Kevin Even, Renee Meinholz CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. Approve Proclamation Honoring Retiring Fire Chief Motion to approve Proclamation Honoring Retiring Fire Chief Gary Acker. PUBLIC COMMENT Administrator Todd Schmidt was pleased to report that the Village had received a $500,000 WEDC Idle Sites Grant. REPORTS 1. Update on Village Hall Water Damage Village Engineer Kevin Even provided a report to the Village Board regarding the Village Hall lower level water damage. PUBLIC HEARING 1. Discuss and Take Action on ETJ Certified Survey Map for Donald Esser, Town of Springfield The public hearing to consider an ETJ Certified Survey Map for Donald Esser, Town of Springfield, was opened at 6:06 p.m. and closed at 6:08 p.m. Motion by Gary Herzberg, second by Bill Ranum, to approve the ETJ Certified Survey Map for Esser, subject to any conditions of approval by the Town of Springfield. Newell, dba Newell Gallery & Fine Wine, premise identified as first floor of building located at 315 E. Main Street; a renewal application for Cuco's Inc. dba Cuco's Mexican Restaurant, premise identified as building located at 350 N. Century Avenue, approximately 2,788 interior square feet, and an outside 760 square foot patio on the northwest corner of the building subject to the following restrictions: all Conditional Use Permit conditions to be same as neighboring spaces, restricting hours at which alcohol can be served outside to 11:00 a.m. to 9:00 p.m., Sunday through Thursday, and 12:00 p.m. to 10:00 p.m., Friday and Saturday, Conditional Use Permit is revocable if there are significant complaints from neighboring residences, police calls, or violations of the Village’s noise standards, residential noise restrictions shall apply to all amplified music, and Conditional Use Permit may be revisited if offsite parking becomes an issue; a renewal application for Domott, LLC, dba Waun-A-Bowl, premise identified as building located at 301 S. Century Avenue excluding area currently leased to Rocky Rococo's, and an outside 400 square foot horseshoe pit area on southwest corner of building and 336 square foot patio on east side of building subject to the following restrictions: no alcoholic beverages or amplified music after 9:00 p.m., Sunday through Thursday, and none after 10:00 p.m., Friday and Saturday, unless by written exception provided by Police Chief, and Plan Commission may revoke outside premise approval and require closure for noise or nuisance complaints; a renewal application for Greg A. Hensen, dba Gold Nugget Bar and Grill, premise identified as the first floor of building located at 109 E. Main Street, and outside 500 square foot fenced area on north side of building subject to the following restrictions: no alcoholic beverages or amplified music after 9:00 p.m., Sunday through Thursday, and none after 10:00 p.m., Friday and Saturday, unless by written exception provided by Police Chief, and Plan Commission may revoke outside premise approval and require closure for noise or nuisance complaints; a renewal application for Kwik Trip, Inc. dba Kwik Trip #832, premise identified as building located at 208 E. Main Street, storage in lockable walk-in cooler and behind sales counter during non-sale hours, and surveillance cameras to be in place to record sales and counter activities; a renewal application for Luckys Waunakee LLC, dba Lucky's Bar and Grille, premise identified as building located at 1008 Quinn Drive, and outside patios, located in front and back of building, and volleyball courts subject to the following restrictions: volleyball and lighting hours limited to 9:00 a.m. to 10:00 p.m., alcohol hours limited to 2:00 a.m., Sunday through Thursday, and 2:30 a.m., Friday and Saturday, TV's and stereo music must remain at reasonable noise levels and coincide with outside hours, live music/DJ's limited to 10:30 p.m., signage shall clearly identify where alcohol may be possessed and consumed, and Village administrative staff may modify activities and hours of outdoor areas, including patios, based on noise levels; renewal application for Meffert Oil Company, Inc. dba Meffert's One Stop, premise identified as building located at 404 W. Main Street not including area currently leased by Dunkin Donuts, with a gate or enclosure securing wine display during non-sale hours, surveillance cameras to be in place to record sales and counter activities, and appearance before the Plan Commission is required before selling anything other than beer or wine; a renewal application for Neil's Liquor, LLC, dba Neil's Liquor Stores LLC, premise identified as building located at 204 S. Century Avenue B; a renewal application for Piggly Wiggly of Waunakee, Inc., dba Piggly Wiggly, premise identified as building located at 205 N. Holiday Drive; a renewal application for Rex's Innkeeper Inc., dba Rex's Innkeeper, premise identified as building located at 301 N. Century Avenue, and outside gazebo and horseshoe pits subject to the following restrictions: no alcoholic beverages or amplified music after 9:00 p.m., Sunday through Thursday, and none after 10:00 p.m., Friday and Saturday, unless by written exception provided by Police Chief, and Plan Commission may revoke outside premise approval and require closure for noise or nuisance complaints; a renewal application for Robert M. Bishop dba Blowin' Smoke Barbeque, premise identified as building located at 1336 Montondon Avenue Suite 4C, approximately 1,237 square feet in upper level of Unit 200 located in west corner of building, and outside 960 square foot patio with 5 foot high fence on northwest corner of building subject to the following restrictions: all outdoor speakers to be positioned away from residential houses, residential noise restrictions apply, hours restricted to 11:00 a.m. to 9:00 p.m., Sunday through Thursday, and 12:00 p.m. to 10:00 p.m., Friday and Saturday, Conditional Use Permit is revocable if there are significant complaints from neighboring residences, police calls, or violations of the Village's noise standards, Conditional Use Permit to be revisited if restaurant requests license beyond beer and wine, Conditional Use Permit is reviewable annually and may be revised or revoked if warranted by the Plan Commission based on neighborhood complaints, traffic circulation pattern with appropriate lane markings or other signage must be approved by the Village Enginee, and specific outdoor alcohol consumption and necessary signage must be approved by the Police Chief and Village Engineer; a renewal application for Sixmile Creek Golf Development Group, LLC, dba The Meadows of Sixmile Creek, premise identified as building located at 800 N. Century Avenue, and golf course proper; a renewal application for Waunakee Citgo, Inc., dba Waunakee Citgo, premise identified as building located at 206 S. Century Avenue with liquor secured behind the counter; a renewal Alcohol Beverage License application for the American Legion Post 360 dba American Legion Post 360, premise identified as building located at 417 E. Main Street, and outside 300 square foot grilling area on northwest corner of the building; a renewal application for Z & A Partners, LLC, dba Doughboys Pizza, premise identified as building located at 246 N. Century Avenue, and outside 476 square foot deck on north side of building subject to the following restrictions: no music speakers, television may not be visible from any adjoining residences and sound must be turned off, residential noise restrictions apply, service hours are limited to 11:00 a.m. to 9:00 p.m., Sunday through Thursday, and 12:00 p.m. to 10:00 p.m., Friday and Saturday, Conditional Use Permit is revocable if there are significant complaints from residences, police calls, or violations of noise standards, and privacy screening subject to Village Engineer; a renewal application for Yuremi LLC dba Abarrotes Yuremi, premise identified as first floor of building located at 132 W. Main Street, more specifically 1,100 square feet in northeast corner of building including back room; a renewal application for Rodd Allen Ripp dba Ripp's Bar, premise identified as building located at 117 E. Main Street, and outside 169 square foot porch on front side of building and 330 square foot fenced area on west side of building subject to the following restrictions: no alcoholic beverages or amplified music after 9:00 p.m., Sunday through Thursday, and none after 10:00 p.m., Friday and Saturday, unless by written exception provided by Police Chief, and Plan Commission may revoke outside premise approval and require closure for noise or nuisance complaints; a renewal application for Brix 340, LLC dba Brix 340, premise identified as the building located at 340 N. Century Avenue, approximately 1,205 square feet with open bottles of wine stored in a cabinet behind the serving island, off limits to patrons, cold wines kept in refrigeration units behind the serving island, and full bottles of wine kept in wine racks in the small hallway toward the restroom and in cabinets behind the serving island; a renewal application for Meffert Oil Company, Inc. dba Meffert Oil Company, Inc., premise identified as store sales floor and cooler in the northwest corner of the building located at 300 S. Division Street; a renewal application for Octopi Brewing LLC dba Octopi Brewing, premise identified as 1,540 square foot tasting room in east half of the building located at 1131 Uniek Drive, and outside 1,100 square foot patio on the northeast corner of the building, all subject to the following restrictions: open hours for the service, sale, and consumption of beer and wine shall be the same as for other establishments in the Village holding a Class B license issued pursuant to Wis. Stat. § 125.26, closing hours shall be 11:30 p.m. every night, except that the licensee shall be permitted to close at the same time as other establishments in the Village holding a Class B license issued pursuant to Wis. Stat. § 125.26 on ten (10) nights during the year upon written approval by the Village Administrator, and no alcohol except beer and wine shall be served or sold on the property; a renewal application for The Lone Girl Brewing Company-Waunakee, LLC dba The Lone Girl Brewing Company, premise identified as west side of the Village Crossing property located at 114 E. Main Street, Suite 101, including 7,215 square feet on the first floor with a capacity of 200 people, first and second floor common interior and exterior stairwells, common hallways, elevator, elevator lobbies, and bathroom areas, and outside 4,649 square feet on the second floor for rooftop dining and bar areas with a capacity of 145 people subject to the following restrictions: service limited to 11:00 p.m., Sunday through Thursday, and 12:00 p.m., Friday and Saturday, Police Chief may waive this restriction for special events, with music turned off one hour prior to closing, amplified music limited to 10:00 p.m., fire pits must be fire department approved, capacities to be established by fire department and/or state requirements, any expansion of seating or conversion of “play/game area” would trigger Plan Commission review if deemed necessary by either the Village Engineer or Police Chief, Plan Commission review of Conditional Use Permit if parking becomes an issue, and Plan Commission may revoke outside premise approval and require closure for noise or nuisance complaints from neighboring residents or property owners; a renewal application for Mr Brews Taphouse IV LLC dba Mr Brews Taphouse, premise identified as Tenant "A" in multi-tenant building located at 300 N. Century Avenue, limited to 2,409 square feet in the southern part of the building, and outside 1,120 square foot patio with 3 foot high steel fence subject to following restrictions, service limited to 11:00 a.m. to 9:00 p.m., Sunday through Thursday, and 11:00 a.m. to 10:00 p.m., Friday and Saturday, residential noise restriction shall apply to all amplified music, and Conditional Use Permit is revocable if there are significant complaints from neighboring residences, police calls, or violations of the Village's noise standards. Discuss and Take Action on Annual Operator License Applications Motion by Sue Springman, second by Bill Ranum, to approve Operator License applications for all applicants listed on attached roster subject to successful completion of an approved responsible beverage server training course. Discuss and Take Action on Professional Services Agreement with Ayres Associates Inc. for Alloy Site Remediation Motion by Sue Springman, second by Steve Kraus, to approve the agreement for professional services between the Village of Waunakee and Ayres Associates, Inc., to perform site remediation and environmental consulting in conjunction with the Village’s WEDC Idle Sites Grant, subject to any modifications by the Village Attorney, and authorizing the Village Administrator to execute the final agreement.
