VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street March 12, 2018 5:00 PM Meeting Minutes CALL TO ORDER The March 12, 2018 Village Board meeting was called to order by President Chris Zellner at 5:05 p.m. ROLL CALL Present: Phil Willems, Chris Zellner, Sue Springman, Bill Ranum, Sam Ballweg, Gary Herzberg, Steve Kraus Absent: None Also Present: Todd Schmidt, Julee Helt, Renee Meinholz, Kevin Even, Bryan Kleinmaier, Richard Peterson, Vera Laufenberg, Edith Laufenberg, Elain Laufenberg, Bev Roelke, Marcus Roelke, Nila Frye, Terrence Wall, Linda Bergman, Elana Dresen, Lisa Roessler, Sam Kaufmann, Bruce Kaufmann, Carrie Arneson, Mike Mohr, Roberta Baumann, Mike Slavish, Kathy Kearney, Colleen Webster, Diane Berhardt, Phil Bernhart, John Webster, Mary Ellen Kearney, Tim Clark, Sandy Taylor, Wanda Buckingham, Ashia Dale, Maria Patt, Mary Jo Bell, Kate Pelzer, Pat Maly, Kari Corrigan, Sharyn Gardill, John D. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. PUBLIC COMMENT* Ann Lewandowski spoke about lies on the internet. Tim Clark stated that meeting times were inopportune for most people to attend. Collen Webster learned from a Waunakee Neighborhood Connection fundraiser that there are a large number of homeless residing in the Village. PUBLIC HEARING* 1 Discuss and Take Action on Amendment to Village Zoning Code for Height Restrictions in C-1D Downtown Commercial District The public hearing to consider an amendment to the Village Zoning Code for Height Restrictions in C-1D Downtown Commercial District was opened at 5:15 p.m. The following spoke generally in opposition of the height amendment: Ashia Dale (suggested a change to the ordinance to allow part(s) of the building above 45 feet in height to be used only for purposes that are accessory to the primary use(s) of the building), Ann Lewandowski (provided pictures of 4 story buildings and said they would not be invisible), Mary Heimbecker (felt the Village was rural not urban), Mary Ellen Kearney (was concerned about what happens on her street as well as urbanization), Sandy Taylor (was not concerned about the height restriction for Hovde but was for future projects, had concerns about the Hovde parking, and suggested there were some unethical actions), Kate Pelzer (wanted our small town to stay that way), John Hyland (believes this may be the cart before the horse, that other ordinance changes would need to be approved to allow the project, and the Village needs to consider the quality and character of the downtown), Dennis Helt (stated the Board should stick to the code and if approved it would be hard to make exceptions in the future). The following provided written comment in opposition of the height amendment: Kate Pelzer (opposed 5 story building), Beverly Roelke, Marcus Roelke, Carol Nelson, Lisa Roessler, Elain Laufenberg, Vera Laufenberg, Barb Adler (opposed T-Wall project), Edith Laufenberg (opposed T-Wall project), Elana Dresen, Linda Bergman, Frank Bergman, Laura Lungren (would like to maintain historic charm of Waunakee and uphold current regulations), Carrie Arneson (questioned where 25% of total square footage and 30 foot minimum setback requirements came from and asked what benefit this provided Village taxpayers), Michael Mohr (disagreed with increase height as a conditional permit and expressed concern that it differs from the Village Comprehensive Plan and would look out of place on Main Street), Philip Bernhardt, John Webster, Kelly Jorgensen, Nila Frye, Colleen Webster, and Tim Clark. Terrence Wall was undecided about the height amendment. The public hearing to consider an amendment to the Village Zoning Code for Height Restrictions in C-1D Downtown Commercial District was closed at 6:31 p.m. Jason Valerius, MSA, consultant for the Comprehensive Plan, provided an explanation for how the language was inconsistent regarding building heights. Planner Ed Freer provided an explanation regarding rural and urban areas and the need for infill projects. Motion by Steve Kraus, second by Phil Willems, to approve the amendment to Chapter 133 of the code of ordinances regarding height restrictions in the C-1D downtown commercial district, with the addition of the following standard to Section 133-489(c): The part(s) of the building that are above 45 feet in height shall be used only for purposes that are accessory to the primary use(s) of the building. Motion Passed. For: 7, Against: 0. 2 Discuss and Take Action on Amendment to Village Zoning Code to Allow Business Dormitories in Industrial District The public hearing to consider an amendment to the Village Zoning Code to Allow Business Dormitories in the Industrial District was opened at 6:50 p.m. Nila Frye asked if the occupants could move from dorm to dorm to avoid the time limit. Dennis Helt asked how this would affect the hotel. Ann Lewandowski asked about enforcing the short term rental requirement. The public hearing to consider an amendment to the Village Zoning Code to Allow Business Dormitories in the Industrial District was closed at 6:55 p.m. Motion by Sam Ballweg, second by Sue Springman, to approve the amendment to the Village Zoning Code to Allow Business Dormitories in the Industrial District Motion Passed. For: 7, Against: 0. ADJOURN Motion by Gary Herzberg, second by Bill Ranum, to adjourn at 6:56 p.m. Motion Passed. For: 7, Against: 0. PUBLIC COMMENT* PUBLIC HEARING* 1 Discuss and Take Action on Amendment to Village Zoning Code for Height Restrictions in C-1D Downtown Commercial District 2 Discuss and Take Action on Amendment to Village Zoning Code to Allow Business Dormitories in Industrial District ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may share comments with the Board on items that do not appear on the agenda. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold public hearings on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments.
