VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street March 19, 2018 6:00 PM Meeting Minutes CALL TO ORDER The March 19, 2018 Village Board meeting was called to order by Village Clerk Julee Helt at 6:02 p.m. ROLL CALL Present: Phil Willems, Sue Springman, Bill Ranum, Sam Ballweg, Gary Herzberg, Steve Kraus Absent: Chris Zellner Also Present: Julee Helt, Renee Meinholz, Kevin Even, Adam Bentley, Bryan Kleinmaier, Roberta Baumann, Jeremy Arrington, Patrick Maier, Courtney Maier, Linda Ashmore, Gerry Ashmore, Jim Welsh, Sam Kaufmann, Maria Patt, Mary Heimbecker, Peg Whiteside, L. Scott Maier, Erin Moran, Colleen Webster Motion by Steve Kraus, second by Bill Ranum, to appoint Gary Herzberg as temporary chair. Motion Passed. For: 6, Against: 0. CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability was confirmed by Clerk Helt for open meeting compliance. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Steve Kraus, second by Sue Springman, to approve the Consent Agenda including all of the items listed below. Motion Passed. For: 6, Against: 0. 1 Approve March 5 and March 12, 2018 Village Board Minutes Motion to approve March 5 and March 12, 2018 Village Board Minutes 2 Approve Schedule of Bills Motion to approve check numbers 76100-76150 totaling $120,757.46, check number 76151 in the amount of $409.00, check numbers 76192 through and check numbers through 76220 totaling $574,068.40, check number 76221 in the amount of $10,450.02, check number 76222 in the amount of $1,020.00, and check numbers 76223 through 76242 totaling $44,612.26. 3 Approve Amendment to Construction Site Erosion Control and Post- Construction Stormwater Management Ordinance Motion to approve the proposed amendments to Chapter 109 of the Village Code for Stormwater and Erosion Control. PUBLIC COMMENT* Mary Heimbecker commented she thought the Amendment to Construction Site Erosion Control and Post-Construction Stormwater Management Ordinance was a good idea for rural preservation and was aligned with the Comprehensive Plan. Gerry Ashmore commented his concerns about the proposed apartment projects, noting the vacancy rate in existing buildings, and requested that public notices be less vague. Linda Ashmore commented about the early meeting times and the difficulty citizens have attending them, vague information in the informational meeting notice, concern about a proposed zoning change when the Village President and Village Administrator are both on vacation, the definition of lot area standard is clear in the present ordinance, and concern about changing ordinances to allow for big box apartments versus today’s standards. PUBLIC HEARING* 1 Discuss and Take Action on Proposed Certified Survey Map and Rezone, Whiteside, 5147 Bong Road, Village of Waunakee The public hearing to consider a Certified Survey Map and rezone request for Peg Whiteside, 5147 Bong Road, was opened at 6:19 p.m. and closed at 6:20 p.m. Motion by Steve Kraus, second by Sue Springman, to approve the Whiteside Certified Survey Maps, rezones, and detachment as recommended by the Joint Plan Commission. Motion Passed. For: 6, Against: 0. 2 Discuss and Take Action on Proposed Certified Survey Map and Rezone, Arrington, 5683 Harbort Road, Town of Westport The public hearing to consider a Certified Survey Map and rezone request for Jeremy Arrington, 5683 Harbort Road, was opened at 6:23 p.m. and closed at 6:24 p.m. The issue was being discussed by the Town of Westport at their Town Board meeting following the Village’s meeting and so any action by the Village Board was being held over until the April 2, 2018 Village Board meeting. 3 Discuss and Take Action to Amend Waunakee/Westport Joint Comprehensive Plan to Change 80 Acres Located at Northwest Corner of Schumacher Road/STH 113 Intersection to Rural Preservation, and to Rezone Parcel to County A-1 This issue was postponed to a future meeting. LICENSES/PERMITS 1 Discuss and Take Action on Operator License Application for Breanne C. Karls, Mohamed Sawan, Samantha Haag, and Eric Hanson Motion by Phil Willems, second by Steve Kraus, to approve operator license applications for Breanne C. Karls, Mohamed Sawan, Samantha Haag, and Eric J. Hanson, subject to successful completion of an approved responsible beverage server training course and review by the Waunakee Police Department. Motion Passed. For: 6, Against: 0. NEW BUSINESS 1 Discuss and Take Action on Bids for 2018 Public Works Improvement Projects Village Engineer Kevin Even explained the bid results and wasn’t prepared to recommend approval until final details were discussed with Waunakee Utilities. 2 Discuss and Take Action on Bids for Cross Street Extension Project Motion by Sue Springman, second by Phil Willems, to award the contract to Krause Excavating of Markesan, WI, conditioned on the execution of the developers agreement between Hovde and the Village of Waunakee. Motion Passed. For: 6, Against: 0. 3 Discuss and Take Action on Developers Agreement for Hovde, 203 E. Main Street *The Village Board may convene in closed session as authorized by Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion by Steve Kraus, second by Phil Willems, to convene in closed session at 6:48 p.m. as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session related to a Developers Agreement for Hovde, 203 E. Main Street. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion Passed. For: 6 - Phil Willems, Chris Zellner, Sue Springman, Bill Ranum, Sam Ballweg, Gary Herzberg. Against: 0. Absent: 1 - Chris Zellner. Motion Passed. For: 6, Against: 0, Absent -1. ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may share comments with the Board on items that do not appear on the agenda. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold public hearings on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments.
