Motion by Sue Springman, second by Phil Ranum, to approve the Consent Agenda including all of the items listed below. Motion Passed. For: 7, Against: 0. 1 Approve April 2, 2018 Village Board Minutes Motion to approve the April 2, 2018 Village Board minutes. 2 Approve Schedule of Bills Motion to approve check numbers 76277 through 76283 totaling $5,514.63 and check numbers 76287 through 76303 totaling $14,447.88 3 Approve Temporary Operator License Applications Motion to approve Temporary Operator License applications for Waunakee Home Talent for Matthew D. Ripp and Kent P. Adler. 4 Approve Temporary Class "B" Retailer's License Application for Waunakee Home Talent Motion to approve an application for a Temporary Class “B” License for Waunakee Home Talent Baseball on May 6 and 20, June 10, 16, 17, and 24, July 8 and 22, and any necessary rain dates for games held at Murphy Field. 5 Declare April "Parents Who Host, Lose the Most: Don't Be a Party to Teenage Drinking Month" Motion to approve April as “Parents Who Host, Lose the Most: Don’t Be a Party to Teenage Drinking” Month. PUBLIC COMMENT* Linda Ashmore commented on how business is conducted with developers, and whether apartment proposals on Main Street should be approved based on zoning or conditional use permits. Mary Heimbecker requested Village meetings be televised on YouTube. Ann Lewandowski clarified her comments that were reported in the previous meeting’s minutes. PUBLIC HEARING* 1 Discuss and Take Action on Request by Sweeney/Loomans to Rezone 701 W. Main Street from C-2 General Highway Commercial to C-1 Commercial The public hearing to consider a request by Sweeney/Loomans to rezone 701 W. Main Street from C-2 General Highway Commercial to C-1 General Commercial was opened at 6:12 p.m. Dave Prochaska was generally against the project. Ann Lewandowski was generally in favor of the project. The public hearing to consider a request by Sweeney/Loomans to rezone 701 W. Main Street from C-2 General Highway Commercial to C-1 General Commercial was closed at 6:18 p.m. Motion by Sam Ballweg, second by Steve Kraus, to approve the ordinance to rezone 701 W. Main Street for Sweeney/Loomans from C-2 General Highway Commercial to C-1 General Commercial as recommended by the Plan Commission and conditioned on payment of monies owed to Waunakee Utilities. Motion Passed. For: 7, Against: 0. 2 Discuss and Take Action on Proposed Zoning Amendment to General Development Plan for Waunakee Business Park 2, Adding as a Conditional Use in Phase 2A, Daycare Center for Dogs The public hearing to consider a zoning amendment to the General Development Plan for Waunakee Business Park 2, to add daycare centers for dogs as a conditional use permit in Phase 2A, was opened at 6:40 p.m. Sue Vande Plasch was neither opposed nor in favor of the project. The public hearing to consider a zoning amendment to the General Development Plan for Waunakee Business Park 2, to add daycare centers for dogs as a conditional use permit in Phase 2A, was closed at 6:42 p.m. Motion by Phil Willems, second by Bill Ranum, to approve the amendment to the General Development Plan for Waunakee Business Park 2, to add daycare centers for dogs as a conditional use permit in Phase 2A. Motion Passed. For: 7, Against: 0. LICENSES/PERMITS 1 Discuss and Take Action on Operator License Applications for Sydney E. Dorn and Norbert L. Oldenburg Motion by Gary Herzberg, second by Phil Willems, to approve operator license applications for Sydney E. Dorn and Norbert L. Oldenburg, subject to successful completion of an approved responsible beverage server training course and review by the Waunakee Police Department. Motion Passed. For: 7, Against: 0. NEW BUSINESS 1 Discuss and Take Action on Initial Resolution for the Sale and Issuance of $7,370,000 Waunakee General Obligation Bonds, Series 2018A for Purpose of Library Improvements and Tax Increment Costs Financial consultant Mike Harrigan, Ehlers Inc., explained the change in the borrowing amount due to an omission of capitalized interest, and further explained the details of the borrowing. Motion by Chris Zellner, second by Gary Herzberg, to approve the Initial Resolution Authorizing the Borrowing of Not to Exceed $7,450,000 and Providing for the Issuance and Sale of General Obligation Bonds, Series 2018A. Motion Passed. For: 7, Against: 0. 2 Discuss and Take Action on Approval of Hotel Market Feasiblity Study This item was not discussed. 3 Discuss and Take Action Authorizing Staff to Publicly Bid Meadowbrook Park Shelter Motion by Gary Herzberg, second by Phil Willems, to authorize staff to move forward with public bidding of the Meadowbrook Park shelter construction project. Motion Passed. For: 7, Against: 0. 4 Discuss and Take Action on Resolution Authorizing the Issuance of Municipal Revenue Obligation in an Amount Not to Exceed $5,588,145 to 203 Main, LLC Motion by Sue Springman, second by Gary Herzberg, to approve the Resolution Authorizing the Issuance of a Municipal Revenue Obligation in an Amount Not to Exceed $5,588,145 to 203 Main, LLC. Motion Passed. For: 7, Against: 0. 5 Discuss and Take Action on Development Agreement for Phase VI of Kilkenny Farms (Residential) Motion by Steve Kraus, second by Sue Springman, to approve the developer’s agreement for Phase VI of Kilkenny Farms (residential). Motion Passed. For: 7, Against: 0. 6 Discuss and Take Action on 2018-2019 Committee Appointments Motion by Sue Springman, second by Bill Ranum, to approve the board, commission, and committee appointments as recommended by the Village President. Motion Passed. For: 5, Against: 0, Abstain: 2 (Herzberg, Kraus). OLD BUSINESS 1 Discuss and Take Action on Ayres Request for Additional Engineer Compensation Related to Oversight of Environmental Cleanup of Alloy Site *The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion by Gary Herzberg, second by Sue Springman, to convene in closed session at 7:13 p.m. as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session related the Ayres request for additional engineer compensation related to oversight of environmental cleanup of the Waunakee Alloy site. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion Passed. Against: 0. 2 Discuss and Take Action on Notice of Claim Filed by Foat Construction LLC Against Village of Waunakee Related to Demolition and Disposal Services Performed at 201 N. Madison Street *The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(g) for the purpose of conferring with legal counsel for the governing body who is rendering oral advice concerning strategy to be adopted by the Village with respect to litigation in which it is or is likely to become involved. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion by Phil Willems, second by Bill Ranum, to convene in closed session at 7:14 p.m. as authorized by Wisconsin Statute 19.85(1)(g) for the purpose of conferring with legal counsel for the governing body who is rendering oral advice concerning strategy to be adopted by the Village with respect to litigation in which it is or is likely to become involved related to a claim filed by Foat Construction LLC against the Village related to demolition and disposal services performed at 201 N. Madison Street. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion Passed. Against: 0. 3 Discuss and Take Action on Administrator Review, Compensation, and Benefit Adjustments *The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(c) for the purpose of considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion by Phil Willems, second by Bill Ranum, to convene in closed session at 7:15 p.m. as authorized by Wisconsin Statute 19.85(1)(c) for the purpose of considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility related to Administrator review, compensation, and benefit adjustments. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion Passed. For: 7 - Phil Willems, Chris Zellner, Sue Springman, Gary Herzberg, Bill Ranum, Sam Ballweg, Steve Kraus. Against: 0. Motion by Phil Willems, second by Gary Herzberg, to reconvene in open session at 7:55 p.m. Motion Passed. For: 7, Against: 0. Motion by Sue Springman, second by Steve Kraus, to approve a $40,000 payment to Ayres for additional engineer compensation related to the oversight of environmental cleanup of the Waunakee Alloy site, and to recommend that Ayres apply for additional grant monies. Motion Passed. For: 7, Against: 0. Motion by Steve Kraus, second by Phil Willems, to approve a 2.5% increase for 2018 for the Village Administrator, retroactive to January 1, 2018, a bonus of $2500 bonus to be received on July 1, 2018 that can be applied to retirement or in whatever manner the Administrator chooses, and a contract amendment wherein the last sentence of item #13 is amended to read: If termination is without cause, the Employee shall receive six months salary and health insurance coverage plus one additional week of salary and health insurance coverage for each year of employment from the original date of employment to a maximum of nine months as severance compensation. ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed.
