CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgement of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Phil Willems, second by Sue Springman, to approve the Consent Agenda including all of the items listed below. Motion Passed. For: 6, Against: 0. 1 Approve May 7, 2018 Village Board Minutes Motion to approve May 7, 2018 Village Board minutes. 2 Approve Schedule of Bills Motion to approve check numbers 76414 through 76439 totaling $119,729.99 and 74584 through 76471 totaling $24,531.63. 3 Approve Application for Temporary Class "B" License Application for Waunakee Rotary Club Motion to approve an application for a Temporary Class “B” license for the Waunakee Rotary Club for the Relay for Life Fundraiser and Walk on June 15, 2018, licensed premise identified as a 1,248 square foot fenced area to the west of the south shelter, with a security officer located at entrance/egress checking ID’s, and allowing for amplified music until 10:30 p.m. 4 Approve Temporary Operator License Applications for Diane M. Anderson and Phillip J. Willems Motion to approve Temporary Operator License applications for Diane M. Anderson and Phillip J. Willems subject to review by the Waunakee Police Department. PUBLIC COMMENT Richard Sarabia, 300 W. Second Street, asked what the proper way to submit a petition would be. Mary Heimbecker, 306 W. Third Street, thanked the staff and the Village Board for providing YouTube broadcasts for Village Board meetings. Mary Ellen Kearney, 301 W. Main Street, was happy about the library groundbreaking on May 21, 2018, the progress with the library, and she thanked Gary Herzberg for his part. Leonard Allen, 1909 Manchester Crossing, expressed his appreciation that the Village has procedures and laws and is happy that the Village is following them. PRESENTATIONS 1 Discuss and Take Action on Proclamation Honoring Kruchten Family Motion by Phil Willems, second by Sam Ballweg, to approve the Proclamation Honoring Kruchten Family. Motion Passed. For: 6, Against: 0. 2 Discuss and Take Action on Proclamation Honoring Randy Meffert Motion by Erin Moran, second by Joe Zitzelsberger, to approve the Proclamation Honoring Randy Meffert. Motion Passed. For: 6, Against: 0. PUBLIC HEARING 1 Discuss and Take Action on Request to Rezone 6172 CTH I, Town of Westport, to Village ER-1 The public hearing to consider a request to rezone 6172 CTH I, Town of Westport, from A1-EX to ER-1, was opened at 6:14 p.m. and closed at 6:15 p.m. Motion by Sue Springman, second by Phil Willems, to approve the request to rezone 6172 CTH I, Town of Westport, from A1-EX to ER-1, as recommended by the Town. Motion Passed. For: 6, Against 0. NEW BUSINESS 1 Discuss and Take Action on Waunakee Area Fire District Air Packs Funding Request Motion by Phil Willems, second by Erin Moran, to approve an additional $14,390 of unassigned fund balance to be used to pay for the Village’s share of Fire District equipment. Motion Passed. For: 6, Against: 0 2 Discuss and Take Action on Resolution Awarding the Sale of $7,450,000 General Obligation Corporate Purpose Bonds, Series 2018A Motion by Sam Ballweg, second by Sue Springman, to approve the Resolution Awarding the Sale of $7,450,000 General Obligation Corporate Purpose Bonds, Series 2018A. Motion Passed. For: 6, Against: 0 OLD BUSINESS 1 Discuss and Take Action on Petition for Annexation by Lone Silo North Addition LLC, Annexation Ordinance, Rezone, and Pre-Annexation Agreement Jerry Tierney, 3564 Egre Road, Ann Becker, 18 Cherokee Circle #202, Madison, Bryan Sipple, 401 N. Century Avenue, spoke in favor of the annexation. Danielle Baudhuin, Sun Prairie, and Jenny Acker-Emberson, 331 E. Main Street, provided written comments in favor of the annexation. Sam Kaufmann, 908 Turnberry Drive, provided written comments against the annexation. Motion by Sue Springman, second by Phil Willems, to approve the ordinance providing for the direct annexation of a portion of the Town of Westport to the Village of Waunakee. Motion Passed. For: 6, Against: 0. Motion by Sue Springman, second by Phil Willems, to approve the pre-annexation agreement between Lone Silo North Addition, LLC and Dalmatian Farms, LLC, and the Village of Waunakee. Motion Passed. For: 6, Against: 0. NEW BUSINESS 2 Discuss and Take Action on Octopi Development Agreement and Municipal Revenue Obligation *The Village Board may convene in closed session as authorized by Wisconsin Statue 19.85 (1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion by Sam Ballweg, second by Sue Springman, to convene in closed session at 6:59 p.m. as authorized by Wisconsin Statue 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, related to the Octopi development agreement and municipal revenue obligation. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion Passed. For: 6 - Erin Moran, Phil Willems, Chris Zellner, Sue Springman, Sam Ballweg, Joe Zitzelsberger. Against: 0. Absent: 1 - Bill Ranum. 3 Discuss and Take Action on Potential Sale of Castle Creek Outlot Plat, Outlot 10 *The Village Board may convene in closed session as authorized by Wisconsin Statue 19.85 (1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion by Sam Ballweg, second by Joe Zitzelsberger, to convene in closed session at 7:03 p.m. as authorized by Wisconsin Statue 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, related to the potential sale of Castle Creek Outlot Plat, Outlot 10. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Motion Passed. For: 6 - Sue Springman, Sam Ballweg, Joe Zitzelsberger, Erin Moran, Phil Willems, Chris Zellner. Against: 0. Absent: 1 - Bill Ranum. OLD BUSINESS 1 Discuss and Take Action on Petition for Annexation by Lone Silo North Addition LLC, Annexation Ordinance, Rezone, and Pre-Annexation Agreement ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may share comments with the Board on items that do not appear on the agenda. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold public hearings on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments.
