Stat. § 125.26, closing hours shall be 11:30 p.m. every night, except that the licensee shall be permitted to close at the same time as other establishments in the Village holding a Class B license issued pursuant to Wis. Stat. § 125.26 on ten (10) nights during the year upon written approval by the Village Administrator, no alcohol except beer and wine shall be served or sold on the property, per the Conditional Use Permit, there shall be no bar service in the outdoor patio area, customers shall go inside to purchase food and drinks, which food or drinks may then be consumed in the outdoor patio area, fencing for the outdoor patio is required, restricting hours at which alcohol can be served outside to 9:00 p.m., Sunday through Thursday, and 10:00 p.m. on Friday and Saturday, Conditional Use Permit is revocable if there are significant complaints from residences, noise restriction shall apply to all amplified music, fire pit(s) must be approved by Waunakee Fire Department and the Village Engineer, if parking becomes an issue, the Plan Commission has the right to reevaluate the Conditional Use Permit; a renewal Class “B”/“Class B” Alcohol Beverage License application for The Lone Girl Brewing Company-Waunakee LLC dba The Lone Girl Brewing Company, premise described as west side of the Village Crossing property located at 114 E. Main Street, Suite 101, including 7,215 square feet on the first floor with a capacity of 200 people, first and second floor common interior and exterior stairwells, common hallways, elevator, elevator lobbies, and bathroom areas, 4,649 square feet on the second floor for rooftop dining and bar areas with a capacity of 145 people, and 600 square foot patio on southwest side of building, service limited to 11:00 p.m., Sunday through Thursday, and 12:00 p.m., Friday and Saturday, Police Chief may waive this restriction for special events, with music turned off one hour prior to closing, amplified music limited to 10:00 p.m., fire pits must be fire department approved, capacities to be established by fire department and/or state requirements, any expansion of seating or conversion of “play/game area” would trigger Plan Commission review if deemed necessary by either the Village Engineer or Police Chief, Plan Commission review of Conditional Use Permit if parking becomes an issue, Plan Commission may revoke outside premise approval and require closure for noise or nuisance complaints from neighboring residents or property owners; a renewal Class “A”/“Class A” Alcohol Application Beverage License application for Walgreen Co., dba Walgreens #05669, premise identified as 15,120 square foot building located at 401 W. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may share comments with the Board on items that do not appear on the agenda. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold public hearings on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments.
