The June 3, 2019 Village Board meeting was called to order by President Chris Zellner at 6:00

Todd Taves of Ehlers provided the Village Board with a presentation regarding the draft capital
improvement plan. No action was taken.

Motion by Bill Ranum, second by Phil Willems, to approve all Alcohol Beverage License
applications, subject to conditions as presented, complete application submission, possession of a
current seller's permit, payment of outstanding liquor bills, and payment of all outstanding bills
or monies owed the Village including a renewal Alcohol Beverage License application for
Cuco’s Inc. dba Cuco’s Mexican Restaurant, premise identified as building located at 350 N.
Century Avenue, approximately 2,788 interior square feet and a 760 square foot patio on the
northwest corner of the building; all Conditional Use Permit conditions to be the same as
neighboring spaces, restricting hours at which alcohol can be served outside to 11:00 a.m. to 9:00
p.m., Sunday through Thursday, and 12:00 p.m. to 10:00 p.m., Friday and Saturday, Conditional
Use Permit is revocable if there are significant complaints from neighboring residences, police
calls, or violations of the Village’s noise standards, residential noise restrictions shall apply to all
amplified music, Conditional Use Permit may be revisited if offsite parking becomes an issue; a
renewal Alcohol Beverage License application for Domott, LLC, dba Waun-A-Bowl, premise
identified as building locate at 301 S. Century Avenue excluding premise currently leased to
Rocky Rococo’s, 400 square foot horseshoe pit area at southwest corner of building, and 336 sq.
ft. patio at front of building on east side. No alcoholic beverages or amplified music in the
outdoor seating area after 9:00 p.m., Sunday through Thursday, and none after 10:00 p.m.,
Friday and Saturday, unless by written exception provided by Police Chief, Plan Commission
may revoke outside premise and require closure for noise or nuisance complaints; a renewal
Alcohol Beverage License application for Greg A. Hensen, dba Gold Nugget Bar and Grill,
premise identified as the first floor of building located at 109 E. Main Street, 500 square foot
fenced area on north side of building; no alcoholic beverages or amplified music in the outdoor
seating area after 9:00 p.m., Sunday through Thursday, and non after 10:00 p.m., Friday and
Saturday, unless by written exception provided by Police Chief, Plan Commission may revoke
outside premise approval and require closure for noise or nuisance complaints; a renewal
Alcohol Beverage License application for Kwik Trip, Inc. dba Kwik Trip #832, premise
identified as convenience store located at 208 E. Main Street, one-story frame construction with
storage in lockable walk-in cooler or behind sales counter during non-sale hours, and
surveillance cameras are to be in place to record sales and counter activities; a renewal Alcohol
Beverage License application for Meffert Oil Company, Inc. dba Meffert’s One Stop, premise
identified as building located at 404 W. Main Street not including area leased to Dunkin’ Donuts,
a gate or enclosure securing wine display during non-sale hours with surveillance cameras to be
in place to record sales and counter activities, appearance before that Plan Commission is
required before selling anything other than wine or beer; a renewal Alcohol Beverage License
application for Neil’s Liquor Stores, LLC, dba Neil’s Village Liquor, premise identified as
building located at 204 S. Century Avenue B; a renewal Alcohol Beverage License application
for Piggly Wiggly of Waunakee, Inc. dba Piggly Wiggly of Waunakee, premise identified as
building located at 205 N. Holiday Drive; a renewal Alcohol Beverage License application for
Rex’s Innkeeper Inc., dba Rex’s Innkeeper, premise identified as building located at 301 N.

Avenue including clubhouse with bar and grill and golf course proper; a renewal Alcohol
Beverage License application for Yogi Enterprise LLC, Inc. dba Waunakee Citgo, premise
identified as building located at 206 S. Century Avenue; liquor must be secured behind the
counter; renewal Alcohol Beverage License application for the William Lansing Post #360 of the
American Legion dba American Legion Post 360, premise identified as building located at 417
E. Main Street with approximately 15 x 20 outside grilling area on the northwest corner of the
building; a renewal Alcohol Beverage License application for Doughboys Italian Restaurant
LLC dba Doughboys Italian Restaurant, premise identified as building located at 246 N. Century
Avenue, 14 x 34 deck on north side of building. No outdoor music speakers. Outdoor television
not visible from any adjoining residences and sound turned off. Residential noise restrictions
apply. Outdoor service hours 11:00 a.m. to 9:00 p.m. Sunday through Thursday, and 12:00 noon
to 10:00 p.m. Friday and Saturday. Conditional Use Permit is revocable if there are significant
complaints from residences and/or police calls or violations of noise standards. Construction of
privacy screening subject to Village Engineer and permits; a renewal Alcohol Beverage License
application for Yuremi LLC dba Abarrotes Yuremi, premise identified as first floor of building
located at 132 W. Main Street, more specifically 1,100 square feet in northeast corner of building
including back room; a renewal Alcohol Beverage License application for Rodd Allen Ripp dba
Ripps Bar, a premise identified as building located at 117 E. Main Street, 169 square foot porch
on front side of building, and 330 square foot fenced area on west side of building; no alcoholic
beverages or amplified music in the outdoor seating area after 9:00 p.m. , Sunday through
Thursday, and none after 10:00 p.m., Friday and Saturday, unless by written exception provided
by Police Chief, Plan Commission may revoke outside premise approval and require closure for
noise or nuisance; a renewal Alcohol Beverage License application for Brix 340, LLC dba Brix
340, premise identified as the building located at 340 N. Century Avenue, approximately 1,205
square feet with open bottles of wine to be stored in a cabinet behind island, off limits to patrons,
product kept in refrigeration units behind the serving island, and full bottles of wine will be kept
in wine racks in the small hallway toward the restroom and in cabinets behind the serving island.
Liquor bottles kept on shelving and cabinets behind the bar; a renewal Alcohol Beverage License
application for Meffert Oil Company, Inc. dba Meffert Oil Company, Inc., premise identified as
store sales floor and cooler locate in the northwest corner of the building at 300 S. Division
Street; a renewal Alcohol Beverage License application for the Lone Girl Brewing Company-
Waunakee, LLC dba The Lone Girl Brewing Company, premise occupies west side of the
Village Crossing property located at 114 E. Main Street, Suite 101, including 7,215 square feet
on the first floor with a capacity of 200 people, first and second floor common interior and
exterior stairwells, common hallways, elevator, elevator lobbies, and bathroom areas. Second
floor of Village Crossing property 1,600 square feet event space, 250 square feet office and
storage space, and 220 square feet of prep/holding area, and 4,649 square feet on the second
floor for rooftop dining and bar areas with a capacity of 145 people, and 600 square foot patio on
southwest side of building. Service limited to 11:00 p.m., Sunday through Thursday, and 12:00
a.m., Friday and Saturday, Police Chief may waive this restriction for special events, with music
turned off one hour prior to closing, amplified music limited to 10:00 p.m., fire pits must be fire
department approved, capacities to be established by fire department and/or state requirements,
any expansion of seating or conversion of “play/game area” would trigger Plan Commission
review if deemed necessary by either the VillageEngineer or Police Chief, Plan Commission
review of Conditional Use Permit if parking becomes an issue, Plan Commission may revoke
outside premise approval and require closure for noise or nuisance complaints from neighboring
residents or property owners. The double door and windows installed by Applicant on second
floor may open the converted space to the existing outdoor patio; a renewal Alcohol Beverage
License application for Mr Brews Taphouse IV LLC dba Mr Brews Taphouse, premise identified
as Tenant “A” in multi-tenant building located at 300 N. Century Avenue, limited to 2,409
square feet in the southern part of the building, 1,120 square foot patio with a 3 foot high steel
fence; service limited to 11:00 a.m. to 9:00 p.m., Sunday through Thursday, and 11:00 a.m. to
10:00 p.m., on Friday and Saturday, Conditional Use Permit is revocable if there are significant
complaints from neighboring residences, police calls, or violations of the Village’s noise
standards, residential noise restriction shall apply to all amplified music; a renewal Alcohol
Beverage License application for Walgreen Co. dba Walgreens #05669, premise identified as
building located at 401 W. Main Street, with overstock alcohol stored in a locked area at all
times with all alcohol on the sales floor locked at 9:00 p.m.; a renewal Alcohol Beverage License
application for Monarca LLC dba El Charro Mexican Grill, premise identified as building
located at 1336 Montondon Avenue Suite 4C, approximately 1,237 square feet in upper level of
Unit 200 located in west corner of building, 960 square foot patio with 5 foot high fence at
northwest corner of building, All outdoor speakers to be positioned away from residential
houses, residential noise restrictions apply, hours for outside service are restricted to 11:00 a.m.
to 9:00 p.m., Sunday through Thursday, and 12:00 noon to 10:00 p.m., Friday and Saturday,
Conditional Use Permit is revocable if there are significant complaints from neighboring
residences, police calls, or violations of the Village’s noise standards, Conditional Use Permit is
reviewable annually and may be revised or revoked if warranted by the Plan Commission based
on neighborhood complaints, traffic circulation pattern with appropriate lane markings or other
signage must be approved by the Village Engineer, and specific outdoor alcohol consumption
area and necessary signage must be approved by the Police Chief and Village Engineer; and, all
subject to possession of a current seller’s permit, payment of outstanding liquor bills, and
payment of all outstanding bills or monies owned to the village.

1 Discuss and Take Action on a Developers Agreement for Kilkenny Farms West
Commercial Center at the Southwest Corner of Woodland Drive and CTH Q
Motion by Gary Herzberg, second by Joe Zitzelsberger, to approve the developers agreement for
Kilkenny Farms West Commercial Center subject to any technical issues approved by the
Village Attorney and Village Engineer.
Motion Passed. For: 6, Against: 0.
2 Discuss and Take Action on potential sale of Village property at 710 South Street
(existing Library site)
No action taken.
3 Discuss and Take Action on Settlement from Madison Environmental
Resourcing, Inc.*
Motion by Phil Willems, second by Susan Springman, to convene in closed session at 6:59 p.m.
as authorized by Wisconsin Statute 19.85(1)(g) for the purpose of conferring with legal counsel
for the Village Board who is rendering oral or written advice concerning strategy to be adopted
by the Village Board with respect to litigation in which it is or is likely to become involved. The
Village Board may reconvene in open session and discuss and take action on the subject matter
discussed in closed session.
Motion Passed. For: 6 - Chris Zellner, Bill Ranum, Sue Springman, Gary Herzberg, Joe
Zitzelsberger, Phil Willems. Against: 0.

*As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public
comment period on Board meeting agendas to afford an opportunity for valued public comments.
This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may
share comments with the Board on items that do not appear on the agenda. The Village Board
may not engage in back-and-forth discussion or take formal action during this period, as the
subject items are not specifically listed. The Board may consider deferring the subject to a later
meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the
right to attend and observe open session meetings of the Village Board, but does not require
allowing the public to speak or actively participate. The Village Board may determine if citizen
participation will be allowed and to what extent.
State statute and/or Village Code requires the Village Board to hold PUBLIC HEARINGS on
certain specified matters where the public can comment on the particular subject. The meeting
chairperson will identify rules for providing comments. Other items on the agenda which are not
listed for public hearing do not require the Board to allow public comment, however the meeting
chairperson can at his/her own discretion allow limited public comments.

Waunakee, Wisconsin, at least twenty-four hours prior to the commencement of the
meeting so that any necessary arrangements can be made to accommodate each request.
