VILLAGE OF WAUNAKEE BOARD MEETING Virtual Meeting via Zoom Webinar May 18, 2020 6:00 PM Please note that due to the COVID-19 pandemic, the Village of Waunakee Village Board meeting was held as a live virtual meeting. Meeting Minutes CALL TO ORDER The May 18, 2020 Village Board meeting was called to order by President Chris Zellner at 6:07 p.m. ROLL CALL Present: Bill Ranum, Nila Frye, Kristin Runge, Phil Willems, Chris Zellner, Gary Herzberg Absent: Erin Moran Also Present: Todd Schmidt, Caitlin Stene, Renee Meinholz, Kevin Even, Bryan Kleinmaier, Erick Plumb, Sue McDade, Adam Kreitzman, Cindy Mosiman CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability were confirmed by Clerk Caitlin Stene for open meeting compliance. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Gary Hertzberg, second by Phil WIllems, to approve the Consent Agenda including all of the items listed below. Roll call vote. Motion Passed. Against: 0. 1 Approve Schedule of Bills Approve check numbers 79451-79464 totaling $34,700.85, 79470-79497 totaling $95,017.37, US Bank in the amount of $87,695.20, and WEX in the amount of $1,575.81. 2 Approve Low Bid for 2020 Chip Seal Project Approve the low bid from Fahrney Asphalt and Paving for $98,544.45. 3 Approve Certified Survey Map, Administrative Lot Line Adjustment, Combining Lots 55 & 56, First Addition to Carriage Ridge, Town of Westport Approve the Certified Survey Map combining Lots 55 & 56, First Addition to Carriage Ridge in the Town of Westport. 4 Approve Certified Survey Map, Administrative Lot Line Adjustment, Foulker/Lilley, River Road, Town of Westport Approve the Certified Survey Map adjusting lot line for Foulker/Lilley, River Road in the Town of Westport. 5 Approve Purchase of Playground Equipment for Watertower Park Approve the purchase of playground equipment from Boland Recreation to replace damaged unit at Watertower Park. PUBLIC COMMENT (for items not on the agenda)* Administrator Todd Schmidt previewed the new development project interactive map available on the Village's website. PUBLIC HEARING* 1 Public Hearing and Discussion/Action for Development Agreement, Certified Survey Map and Rezone from A-1 Agricultural to C-1 Commercial, Kwik Trip LLC to Construct a Convenience Store with Fueling Canopy at CTH Q Across from Peaceful Valley Parkway Following a presentation by Kevin Even, Village Engineer, the public hearing to consider the development agreement, certified survey map and rezone from A-1 Agricultural to C-1 Commercial from Kwik Trip LLC to construct a convenience store with fueling canopy at CTH Q across from Peaceful Valley Parkway was opened at 6:17 p.m. No comments received. The public hearing to consider the development agreement, certified survey map and rezone from A-1 Agricultural to C-1 Commercial from Kwik Trip LLC to construct a convenience store with fueling canopy at CTH Q across from Peaceful Valley Parkway was closed at 6:19 p.m. Motion by Kristen Runge, second by Gary Herzberg to approve the certified survey map, subject to final review and approval by the Village Engineer and incorporation of all Village staff comments. Roll call vote. Motion Passed. For: Gary Hertzberg, Nila Frye, Kristin Runge, Bill Ranum, Chris Zellner, Phil Willems. Against: 0. Motion by Phil Willems, second by Kristin Runge to approve the rezone of the lot to be purchased by Kwik Trip from A-1 Agricultural/Holding District to the C-1 General Commercial District, with the attached deed restrictions to be recorded on the lot. Roll call vote. Motion Passed. For: Kristin Runge, Bill Ranum, Chris Zellner, Phil Willems, Gary Hertzber. Abstention: Nila Frye. Against: 0. Motion by Kristin Runge, second by Phil Willems to approve the public improvements agreement associated with the Kwik Trip lot subject to final review and approval by the Village Engineer and Village Attorney. Roll call vote. Motion Passed. For: Phil Willems, Gary Hertzberg, Kristin Runge, Bill Ranum, Chris Zellner. Abstention: Nila Frye. Against: 0. NEW BUSINESS 1 Discussion and Update regarding Village Procedures and Impacts of COVID-19 Pandemic Discussion only, no action taken. 2 Discuss and Take Action on Resolution to Grant an Extension of Declaration of Emergency in the Village of Waunakee and Continuation of Joint Executive Authority Motion by Gary Hertzberg, second by Bill Ranum to approve resolution to grant an extension of Declaration of Emergency in the Village of Waunakee and continuation of Joint Executive Authority. Roll call vote. Motion Passed. For: Bill Ranum, Chris Zellner, Phil Willems, Gary Hertzberg, Nila Frye, Kristin Runge. Against: 0. 3 Discuss and Take Action on Resolution Allowing Pictures of Waunakee Community High School Seniors to be Placed on Banners on Village Streetlight Poles as a Response to COVID-19 Motion by Nila Frye, second by Bill Ranum to approve the resolution allowing pictures of Waunakee Community High School seniors to be placed on banners on Village streetlight poles as a response to COVID-19. Roll call vote. Motion Passed. For: Nila Frye, Kristin Runge, Bill Ranum, Chris Zellner, Phil Willems, Gary Hertzberg. Against: 0. 4 Update and Discussion regarding Sex Offender Residency Restriction Regulations Discussion only, no action taken. 5 Discuss and Take Action on Resolution to Apply for a Loan from the Board of Commissioners of Public Lands State Trust Fund Loan Program to Reimburse Library Construction Costs Originally Paid by the General Fund Motion by Phil Willems, second by Kristin Runge to approve the attached resolution provided by the Board of Commissioners of Public Lands. Roll call vote. Motion Passed. For: Gary Hertzberg, Nila Frye, Kristin Runge, Bill Ranum, Chris Zellner, Phil Willems. Against: 0. This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may share comments with the Board on items that do not appear on the agenda. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments. Any person who has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the municipal clerk at (608) 850-8500, 500 West Main Street, Waunakee, Wisconsin, at least twenty-four hours prior to the commencement of the meeting so that any necessary arrangements can be made to accommodate each request.
