CALL TO ORDER
The June 1, 2020 Village Board meeting was called to order by President Chris Zellner at 6:02 p.m.
ROLL CALL
Present: Bill Ranum (arrived at 6:43 pm), Nila Frye, Kristin Runge, Phil Willems, Chris Zellner, Erin
Moran, Gary Herzberg
Also Present: Todd Schmidt, Caitlin Stene, Renee Meinholz, Kevin Even, Bryan Kleinmaier, Mary
Heimbecker, Ann Lewandowski, Robert McPherson
CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and
online availability)
Public postings, official notices, and online availability were confirmed by Clerk Caitlin Stene for open
meeting compliance.
CONSENT AGENDA
Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board
Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for
discussion and/or action.
Trustee Nila Frye asked that item #2 be pulled.
Motion by Phil Willems, second by Kristin Runge, to approve the Consent Agenda including all of the
items listed below, expect item #2. Roll Call Vote. Motion Passed. For: 6 - Nila Frye, Kristin Runge,
Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg. Against: 0.
1 Approve Schedule of Bills
Approve WEX in the amount of $1,575.81, check number 79498 in the amount of $553.35, check
numbers 79499-79513 totaling $30,768.67, and 79514-79531 totaling $50,333.36.
PUBLIC COMMENT (for items not on the agenda)*
Ann Lewandowski (103 W 3rd Street) requested that the individuals in the video not be allowed to have
their banner hung on Main Street. Mary Heimbecker (306 W 3rd Street) requested that item #2 under new
business be open for public comment. Robert McPherson (1703 Alexandria Court) requested that item #2
under new business be open for public comment.
LICENSES/PERMITS
1 Discuss and Take Action on Change of Premise for Monarca LLC, dba El Charro
Mexican Grill
Motion by Phil Willems, second by Gary Herzberg, to approve the premise change permitting the
additional 2,241 square feet to include bar seating of 12 individuals and additional dining room space
increasing seating by 94 individuals for El Charro Mexican Grill. Roll Call Vote. Motion Passed. For: 6 -
Gary Herzberg, Nila Frye, Kristin Runge, Chris Zellner, Phil WIllems, Erin Moran. Against: 0.
Consent Agenda Item #2 - Approve February 3, 2020, February 17, 2020, and March 2, 2020 Village
Board Minutes.
Motion by Kristin Runge, second by Erin Moran, to approve the February 3, 2020, February 17, 2020,
and March 2, 2020 Village Board Minutes. Roll Call Vote. Motion Passed. For: 4 - Kristin Runge, Chris
Zellner, Phil Willems, Erin Moran. Against: 0. Abstain: 2 - Nila Frye, Gary Herzberg.
NEW BUSINESS
1 Discussion and Update regarding COVID-19 Pandemic
Discussion only, no action taken.
2 Discussion on Tolerance and Inclusiveness in the Village
Motion by Gary Herzberg, second by Nila Frye, to approve a working statement by the Village Board of
the Village Of Waunakee regarding racist incidents and intolerance in our community. Roll Call Vote.
Motion Passed. For: 7 - Phil Willems, Erin Moran, Gary Herzberg, Nila Frye, Kristin Runge, Bill Ranum,
Chris Zellner. Against: 0.
3 Discuss and Take Action on Resolution Waiving Interest and Penalties on Certain
Delinquent Property Tax Installment Payments Due in 2020
Motion by Chris Zellner, second by Gary Herzberg, to approve the resolution waiving interest and
penalties on certain delinquent property tax installment payments dues in 2020. Roll Call Vote. Motion
Passed. For: 7 - Kristin Runge, Bill Ranum, Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg,
Nila Frye. Against: 0.
4 Discuss and Take Action on Changes to Special Assessment Policy
Motion by Phil Willems, second by Nila Frye, to allow deferral of special assessments for one year or
payments in installments over three years for those sidewalk special assessments billed in 2020. Roll Call
Vote. Motion Passed. For: 7 - Erin Moran, Gary Herzberg, Nila Frye, Kristin Runge, Bill Ranum, Chris
Zellner, Phil Willems. Against: 0.
5 Discuss and Take Action on Ordinance Amending Chapter 6, Article II of the Code of
Ordinances Concerning Operator Licenses
Motion by Erin Moran, second by Phil Willems, to approve the ordinance amending Chapter 6, Article II
of the Code of Ordinances concerning operator licenses. Roll Call Vote. Motion Passed. For: 7 - Bill
Ranum, Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg, Nila Frye, Kristin Runge. Against: 0.
6 Discuss and Take Action on Initial Hiring Vacation and Sick Time Accrual for Sergeant
Candidate
Motion by Chris Zellner, second by Phil Willems, to approve an annual vacation accrual of 80 hours,
prorated to date of hire, and a sick leave bank of 40 hours upon starting employment with the Village for
Sergeant Candidate Matthew Plendl. Roll Call Vote. Motion Passed. For: 7 - Phil Willems, Erin Moran,
Gary Herzberg, Nila Frye, Kristin Runge, Bill Ranum, Chris Zellner. Against: 0.
7 Discuss and Take Action on Recommendation from WaunaBoom Committee Regarding
July 4th, 2020 Celebration
Motion by Kristin Runge, second by Bill Ranum, to approve the WaunaBoom Committee
recommendation to cancel the WaunaBoom 2020 celebration due to COVID-19 and Dane County Public
Health orders. Roll Call Vote. Motion Passed. For: 7 - Kristin Runge, Bill Ranum, Chris Zellner, Phil
Willems, Erin Moran, Gary Herzberg, Nila Frye. Against: 0.

the State of Wisconsin’s Safer At Home Order. The public can participate in one of three ways:

attending to speak about any item not on the agenda. During this item, those participating

ADJOURN
*As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public
comment period on Board meeting agendas to afford an opportunity for valued public comments.
This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may
share comments with the Board on items that do not appear on the agenda. The Village Board
may not engage in back-and-forth discussion or take formal action during this period, as the
subject items are not specifically listed. The Board may consider deferring the subject to a later
meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the
right to attend and observe open session meetings of the Village Board, but does not require
allowing the public to speak or actively participate. The Village Board may determine if citizen
participation will be allowed and to what extent.
State statute and/or Village Code requires the Village Board to hold PUBLIC HEARINGS on
certain specified matters where the public can comment on the particular subject. The meeting
chairperson will identify rules for providing comments. Other items on the agenda which are not
listed for public hearing do not require the Board to allow public comment, however the meeting
chairperson can at his/her own discretion allow limited public comments.
Any person who has a qualifying disability as defined by the Americans with Disabilities
Act that requires the meeting or materials at the meeting to be in an accessible location or
format should contact the municipal clerk at (608) 850-8500, 500 West Main Street,
Waunakee, Wisconsin, at least twenty-four hours prior to the commencement of the
meeting so that any necessary arrangements can be made to accommodate each request.
