VILLAGE OF WAUNAKEE BOARD MEETING Virtual Meeting via Zoom Webinar November 16, 2020 6:00 PM Please note that due to the COVID-19 pandemic, the Village of Waunakee Village Board meeting was held as a live virtual meeting. Meeting Minutes CALL TO ORDER The November 16, 2020 Village Board meeting was called to order by President Chris Zellner at 6:02 p.m. ROLL CALL Present: Nila Frye, Kristin Runge, Phil Willems, Chris Zellner, Erin Moran, Gary Herzberg Not Present: Bill Ranum Also Present: Todd Schmidt, Caitlin Stene, Renee Meinholz, Kevin Even, Bryan Kleinmaier, Scott Russell, Todd Taves, Brian Sweeney, Tim Minson, Adam Kreitzman, Sue McDade, Erick Plumb, Kate Crowley, Issac Showaki, Kent Straus, Jerry Tierney, Mike Lawton, Paul Kardatzke. CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability were confirmed by Clerk Caitlin Stene for open meeting compliance. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. PUBLIC COMMENT David Boetcher (Waunakee School District) and Linda Ashmore (114 South Street) provided comments regarding the Tax Incremental District No. 9 amendment. PUBLIC HEARING* 1 Public Hearing & Discussion/Action on a Proposed Amendment to the Village of Waunakee Zoning Code in which Section 133-16 (Restriction on Rezoning for Multifamily Use) Would Be Repealed from the Zoning Code Following a presentation by Kevin Even, Village Engineer, the public hearing to consider an amendment to the Village of Waunakee Zoning Code in which Section 133-16 (Restriction on Rezoning for Multifamily Use), was opened at 6:14 p.m. No comments received. The public hearing to consider an amendment to the Village of Waunakee Zoning Code in which Section 133-16 (Restriction on Rezoning for Multifamily Use), was closed at 6:16 p.m. Motion by Phil Willems, second by Kristin Runge, to approve the ordinance amendment to repeal Sec. 133-16 of the Waunakee Code of Ordinances relating to limits on multi-family housing. Roll Call Vote. Motion Passed. For: 6 - Kristin Runge, Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg, Nila Frye. Against: 0. 2 Public Hearing & Discussion/Action on a Proposed Amendment to the 2017 Waunakee/Westport Joint Comprehensive Plan in which Language Addressing the Ratio Between Single-Family Housing and Multi-Family Housing in the Village of Waunakee would be Modified Following a presentation by Kevin Even, Village Engineer, the public hearing to consider an amendment to the 2017 Waunakee/Westport Joint Comprehensive Plan in which language addressing the ratio between single-family housing and multi-family housing in the Village of Waunakee would be modified, was opened at 6:16 p.m. No comments received. The public hearing to consider an amendment to the 2017 Waunakee/Westport Joint Comprehensive Plan in which language addressing the ratio between single-family housing and multi-family housing in the Village of Waunakee would be modified, was closed at 6:18 p.m. Motion by Phil Willems, second by Kristin Runge, to approve the ordinance amending the 2017 Waunakee/Westport Joint Comprehensive Plan in which language addressing the ratio between single- family housing and multi-family housing in the Village of Waunakee as presented. Roll Call Vote. Motion Passed. For: 6 – Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg, Nila Frye, Kristin Runge. Against: 0. 3 Public Hearing & Discussion/Action on 2021 Budget Following a presentation by Renee Meinholz, Finance Director, the public hearing to consider the 2021 Village of Waunakee Budget, was opened at 6:36 p.m. No comments received. The public hearing to consider consider the 2021 Village of Waunakee Budget, was closed at 6:38 p.m. Motion by Gary Herzberg, second by Phil Willems, to approve the resolution approving the 2021 Village of Waunakee Budget with option one and related changes. Roll Call Vote. Motion Passed. For: 6 – Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg, Nila Frye, Kristin Runge. Against: 0. LICENSES/PERMITS 1 Discuss and Take Action on Original Alcohol Beverage License Application for Birky's 2, LLC dba Buck & Honey's Motion by Phil Willems, second by Gary Herzberg, to approve an original alcohol beverage license application for Binky’s 2, LLC dba Buck & Honey’s, premise identified as building located at 1370 Water Wheel Drive, 2,000 square foot outdoor dining and entertainment space on the south side of the building. Fencing for the outdoor patio area is required and shall be subject to approval by the Village of Waunakee Chief of Police and Village Engineer. Limitation of outdoor service and amplified music to 9:00 p.m. Sunday to Thursday and 10:00 p.m. Friday and Saturday, with the condition that if there are noise or other nuisance complaints from neighboring residents or property owners, the Joint Plan Commission may review the conditional use. The Waunakee Chief of Police may grant a waiver to this restriction for special events. Any capacity controls shall be established by the Waunakee Fire Department and/or Wisconsin state statute/administrative code requirements; and, possession of a current seller’s permit, payment of outstanding liquor bills, and payment of all outstanding bills or monies owed the Village. NEW BUSINESS 1 Discussion and Update regarding COVID-19 Pandemic Discussion only, no action taken. 2 Discuss and Take Action on Proposed Resolution Approving an Amendment to the Project Plan and Boundaries of Tax Increment No. 9 Motion by Gary Herzberg, second by Kristin Runge, to approve and adopt the Resolution approving an amendment to the project plan and boundaries of Tax Increment District No. 9, in the Village of Waunakee. Roll Call Vote. Motion Passed. For: 5 - Erin Moran, Gary Herzberg, Kristin Runge, Chris Zellner, Phil Willems. Against: 1 - Nila Frye. 3 Discuss and Take Action on Request from Cohen-Esrey Development Group, LLC for Village Financial Contribution to Support Affordable Housing Development at 701/705 West Main Street Discussion only, no action taken. 4 Discuss and Take Action on the Parisi Construction Co, Inc. Contract for Hanover South Park Tennis Court Rehabilitation Project Motion by Phil Willems, second by Erin Moran, to approve awarding the Hanover South Tennis Court asphalt bid to Parisi Construction of Madison, WI. Roll Call Vote. Motion Passed. For: 6 – Gary Herzberg, Nila Frye, Kristin Runge, Chris Zellner, Phil Willems, Erin Moran. Against: 0. 5 Discuss and Take Action on the SIP for Jimmy Johns Sub Shop, Kilkenny Commons, with a Reduced Setback of 20 Feet from the Lot Line Adjacent to CTH Q for the Garbage Enclosure, as Recommended by the Plan Commission President Chris Zellner recused himself from discussion and voting on this item. Motion by Phil Willems, second by Erin Moran, to approve the SIP for Jimmy Johns Sub Shop with the reduced setback of 20 feet for the dumpster location along County Highway Q. Roll Call Vote. Motion Passed. For: 5 - Nile Frye, Kristin Runge, Phil Willems, Erin Moran, Gary Herzberg. Against: 0. 6 Discuss and Take Action on Strand Task Order 20-08 Related to 2021 Public Works Improvements Motion by Chris Zellner, second by Nila Frye, to approve the Strand Task Order 20-08 related to 2021 Public Works Improvements. Roll Call Vote. Motion Passed. For: 6 - Kristin Runge, Chris Zellner, Phil Willems, Erin Moran, Gary Herzberg, Nila Frye. Against: 0. 7 Discuss and Take Action on Racism, Tolerance and Equality in the Waunakee Community Discussion only, no action taken. This is specifically listed on the agenda as PUBLIC COMMENT. The Village Board may not engage in back-and-forth discussion or take formal action during this period. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments. Any person who has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the municipal clerk at (608) 850-8500, 500 West Main Street, Waunakee, Wisconsin, at least twenty-four hours prior to the commencement of the meeting so that any necessary arrangements can be made to accommodate each request.
