CALL TO ORDER
The December 5, 2022 Village Board meeting was called to order by Karla Endres at 6:00 p.m.
Motion by Gary Herzberg, second by Nila Frye to appoint Phil Willems as chair. Motion
passed: For: 6, Against: 0.
ROLL CALL
Present: Nila Frye, Phil Willems, Gary Herzberg, Joe Zitzelsberger, Erin Moran and Sam Kaufmann.
Chris Zellner was excused.
Also Present: Todd Schmidt, Renee Meinholz, Bill Frederick, Ryan Endres, Jeff Karls and Jared Heyn.

Public postings, official notices, and online availability were confirmed by Village Clerk Karla Endres
for open meeting compliance.

Phil Willems announced he will not seek re-election for another term.
CONSENT AGENDA
Items under the consent agenda may be acted upon by one motion. If, in the judgment of any
Board Member, a consent agenda item needs discussion, the item may be moved to later on the
agenda for discussion and/or action.
Nila Frye removed item 3 from the consent agenda.
Motion by Gary Herzberg, second by Nila Frye to approve consent agenda item 1-2. Motion
passed: For: 6, Against: 0.

approve check numbers 86150-86157 totaling $672.05 and 86158-86189 totaling

3 Approve Extraterritorial Jurisdiction Certified Survey map for Maier, 5590
Easy Street, Town of Vienna
Motion by Nila Frye, second by Joe Zitzelsberger to not object to the proposed CSM
at 5590 Easy Street, Town of Vienna; however, encourage the Town to acquire the
northerly 33 feet of Easy Street through dedication for future public road right-of-way
purpose. Motion Passed: For: 6, Against: 0.
PRESENTATIONS
1 Resolution Honoring World Migratory Bird Day
Motion by Gary Herzberg, second by Sam Kaufmann to approve the resolution
honoring World Migratory Bird Day. Motion passed: For: 6, Against: 0.
2 Presentation by Waunakee Artists John and Tracy Grade - Village-
Commissioned Gift to Ho-Chunk Nation
John Grade presented a stained glass light box created to symbolize the Village’s
commitment to the Ho Chunk Nation.
LICENSES/PERMITS
1 Discuss and Take Action on Original Alcohol Beverage License Application for
Par Bar Earlie Birdie, LLC, DBA Par Bar Earlie Birdie, LLC
Motion by Erin Moran, second by Gary Herzberg to grant an original alcohol
beverage license to the applicant, Par Bar Earlie Birdie, LLC, dba, Par Bar Earlie
Birdie, LLC, located at 350 and 340 North Century Avenue, subject to the following
conditions being satisfied prior to issuance of the license:
(1) Possession of a current seller’s permit;
(2) Payment of outstanding liquor bills;
(3) Payment of all outstanding bills or monies owed to the Village; and
(4) Existing alcohol license on the Premises is relinquished by current licensee on or
before June 30, 2023.
Motion passed: For: 6, Against: 0.
BUSINESS ITEMS
1 Discussion/Action on Bids for Terrace Tree Trimming
Motion by Phil Willems, second by Nila Frye to approve the lowest quote of $28,500
from Whitney Tree Service for the tree trimming project using ARPA funds.

ADJOURN
*As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on
Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the
agenda as PUBLIC COMMENT. The Village Board may not engage in back-and-forth discussion or take formal
action during this period. The Board may consider deferring the subject to a later meeting when specific notice can
be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of
the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may
determine if citizen participation will be allowed and to what extent. State statute and/or Village Code require the
Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment on the
particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda
which are not listed for public hearing do not require the Board to allow public comment, however the meeting
chairperson can at his/her own discretion allow limited public comments.
Land Acknowledgment: The Village of Waunakee acknowledges that the land we occupy is Teejop, ancestral
territory of the Hoocąkra (Ho-Chunk Nation), People of the Sacred Voice. Hoocąkra are stewards of these lands
and waters since time immemorial. Settlers attempted to forcibly remove them from their homelands by exploiting a
series of land cessions and treaties, including the Treaty of 1832. However, the Hoocąkra resisted these conquests
and asserted their sovereignty as a nation. We address this trend of dispossession by upholding Hoocąk woošgąra
(way of life), sovereignty, culture, language, and environmental practices. Acknowledging these atrocities is only the
first step towards reconciliation. Through relationship building, education, and action, the Village will advocate for
a shared future with the Hoocąkra Nation.
Any person who has a qualifying disability as defined by the Americans with Disabilities Act that requires the
meeting or materials at the meeting to be in an accessible location or format should contact the municipal
clerk at (608) 850-8500, 500 West Main Street, Waunakee, Wisconsin, at least twenty-four hours prior to the
commencement of the meeting so that any necessary arrangements can be made to accommodate each
request.
