Section 3: In instances where the City Manager determines it is in the City's best interest to employ an individual prior to that individual having secured all necessary certifications or qualifications required for the position, the City Manager may establish the pay scale for that individual at a figure below the base annual salary of the pay grade or position-based compensation range established herein for the position; provided, however, that such reduced pay scale may be maintained only until the employee has received the necessary certifications or for one year, whichever event comes first. Section 4: The Classified and Unclassified Service are defined in Section 7.6 of the Webster Groves City Charter. Section 5: The City Council solely may approve salaries above the established pay grade range and/or bi-weekly pay range as established herein; incumbents who exceed the pay grade range and/or position-based compensation range as of the date of enactment of this ordinance are so approved by this ordinance. Section 6: Pursuant to Personnel Policy 2.01, Job Classification System, as approved by the Personnel Board and consistent with Section 7.7 of the Webster Groves City Charter, the City Manager shall maintain and publish a list of all job titles and their assignment to a specific pay grade. Section 7: Incidental compensation items, including, but not limited to, unscheduled overtime, auto allowance, uniform allowance, stipends, longevity pay, etc. are not considered a component of annual salary by this ordinance and not subject to the minimum and maximum of the pay grade range. Section 8: All ordinances or parts of ordinances in conflict or inconsistent with the provisions of this ordinance, including Ordinance No. 9247 are hereby repealed. WHEREAS, Insight Public Sector Inc., 2701 E. Insight Way, Chandler AZ 85286, will provide services and deliverables at a cost not to exceed $38,200.00, and was determined to be the most advantageous proposal received under the OMNIA Cooperative Purchasing Contract with the specifications provided. NOW, THEREFORE, BE IT RESOLVED THAT THE COUNCIL OF THE CITY OF WEBSTER GROVES, hereby authorizes the City Manager to enter into a contract with Insight Public Sector, Inc., for these services and related deliverables, for the amount hereinabove set forth, and to assure that all services are provided in accordance with the contract. ADOPTED this ________day of _____________, 2024. ________________________________ Mayor ATTEST: ____________________________ City Clerk ARTICLE 2 – THE COUNCIL Section 2.4 COMPENSATION Issue: Adjusting Compensation for Council Members and the Mayor CRAB Recommendation 1) Set compensation for City Council members at $400 per month, not exceeding $4,800 per year. 2) Set compensation for the Mayor at $625 per month, not exceeding $7,500 per year. 3) No City Council member or Mayor presently serving shall receive increased compensation during their term of office. 4) The current rate of compensation per meeting attended will remain in effect for each officeholder until the next term for each office begins. 5) Every four (4) years after the effective date of this Charter amendment, the City Council shall review the compensation paid Council members and Mayor and may adjust the future levels by ordinance. Any change in compensation approved by ordinance shall not take effect until the new term begins for each office. 6) The City Council may appoint a citizens’ commission to study and recommend compensation adjustments to the Council. 7) City Council members and the Mayor may receive reasonable reimbursement for actual and necessary expenses incurred in the fulfillment of that office, provided such expenses are budgeted and supported by appropriate documentation. Adjusted for historical inflation, $600 and $750 in 1965 would now equal, respectively, $5,811.34 and $7,264.18 as of May 2023, per the U.S. Bureau of Labor Statistics CPI Inflation Calculator. 3) Webster Groves’ compensation levels are the lowest of any of our neighboring 1  municipalities; and the lowest of comparable size municipalities (by population) and other home rule municipalities in St. Louis County for which information is readily available. See below Table 3 – Comparisons of Compensation Levels. 4) Compensation provided to City Council and Mayor for serving in these positions is a statement of value, recognizing time and effort are required to oversee City government operations and protect the public interest. 5) Compensation for these positions that is too low can be a deterrent for individuals serving on City Council or Mayor who are from limited financial means and/or who would need to take time off work and forgo wages or promotions in their regular jobs. The current pay levels do not cover the cost of hiring dependent care, such as a babysitter, for the multiple hours of City-related meetings that occur each month. 6) Compensation based on meetings attended requires additional tracking than a flat monthly payment. Compensating City Council and Mayor by month rather than by meetings attended is a simpler approach. 7) The compensation increases proposed by CRAB would have a small impact on the City budget. Council compensation of $4,800 per year for Council members and $7,500 per year for the Mayor would total $36,600 annually. This is 0.12 percent of the City’s 2024 budget. Note: This does not include permitted reimbursement of actual and necessary expenses incurred in the fulfillment of their offices. Table 3. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Chapter 70, of the Code of Ordinances of the City of Webster Groves, Missouri, is hereby amended by adding a new Section 70.227, Prohibiting the Possession-manufacture- transport-repair-sale of prohibited weapons, and said section to read as follows: Sec. 70.227: Possession-manufacture-transport-repair-sale of prohibited weapons. (a) Definitions: (1) Machine gun. A "machine gun" is any firearm that is capable of firing more than one shot automatically, without manual reloading, by a single function of the trigger, regardless of whether the firearm was originally manufactured as a machine gun or was modified by a switch, Glock switch, auto sear, bump stock, trigger crank, or any other manufactured or homemade component. The word "machine gun" includes include any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun, and any combination of part from which a machinegun can be assembled if such parts are in the possession or under the control of a person. (2) Firearm silencer. A "firearm silencer" is any instrument, attachment, or appliance that is designed or adapted to muffle the noise made by the firing of any firearm. A "short barrel" is a barrel length of less than sixteen inches for a rifle and eighteen inches for a shotgun, both measured from the face of the bolt or standing breech, or an overall rifle or shotgun length of less than twenty-six inches. (4) Shotgun. A "shotgun" is any firearm designed or adapted to be fired from the shoulder and to use the energy of the explosive in a fixed shotgun shell to fire a number of shots or a single projectile through a smooth bore barrel by a single function of the trigger. (b) Unlawful possession, manufacture, transport, repair, or sale of a prohibited weapon. A person commits the unlawful possession, manufacture, transport, repair, or sale of a prohibited weapon if the person knowingly possesses, manufactures, transports, repairs, or sells a machine gun, firearm silencer, or short-barreled rifle or shotgun in violation of federal law. (c) Violation. Any person violating any provision of this section shall be deemed guilty of an ordinance violation. (d) Penalty. The punishment for violating any provision of this section shall be the same as the punishment for the ordinance violation of unlawful use of weapons, which is defined by Section ________ and __________. (e) Severability. If any section, subsection, word, or phrase in this law is held unenforceable, invalid, or illegal, every other section, subsection, word, and phrase shall continue to have the full force and effect of law. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. This Ordinance shall be printed in the Code of Webster Groves. Section 4. This Ordinance shall become effective immediately upon passage and approval. Passed and Approved this _____ day of _______________ 2024. ________________________ Mayor ATTEST: ____________________________ City Clerk Page 2 of 2  BILL #9256 ORDINANCE #9256 AN ORDINANCE OF THE CITY OF WEBSTER GROVES, MISSOURI, AMENDING CHAPTER 70, BY ADDING A NEW SECTION 70.226 RELATED TO THE UNLAWFUL TRANSFER OF WEAPONS TO A MINOR WHEREAS, Section 571.060 of the Missouri Revised Statutes prohibits the sale, lease, loan, giving away, or delivery of any firearm to a person less than eighteen years old without the consent of the child's custodial parent or guardian; and WHEREAS, for the purposes of Missouri's prohibition on delivering firearms to minors, Section 571.010 defines "firearm" as "any weapon that is designed or adapted to expel a projectile by the action of an explosive;" and WHEREAS, Section 21.750 of the Missouri Revised Statutes permits political subdivisions to pass any ordinance that conforms exactly with any of the provisions of sections 571.010 to 571.070." NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Chapter 70, of the Code of Ordinances of the City of Webster Groves, Missouri, is hereby amended by enacting a new Section 70.226, Unlawful transfer of weapons; parental or guardian consent for delivery of a firearm to minors; failure to report stolen or lost firearm, and said section shall read as follows: Sec. 70.226. Unlawful transfer of weapons; parental or guardian consent for delivery of a firearm to minors; failure to report stolen or lost firearm. (a.) Definitions (1) Recklessly. The word "recklessly" as used in this section means a person who consciously disregards a substantial and unjustifiable risk that circumstances exist or that a result will follow, and such disregard constitutes a gross deviation from the standard of care which a reasonable person would exercise in the situation. (2) Minor. The word "minor" as used in this section means a person less than 18 years old. (3) Bullet-Cartridge. An object consisting of a cartridge case, primer, powder, and projectile arranged in such a way that the projectile can be expelled by the action of an explosion. Page 1 of 2  (b) Unlawful transfer of a weapon. A person commits the unlawful transfer of a weapon if the person recklessly sells, leases, loans, gives away or delivers any firearm, which includes a bullet-cartridge, to a minor without the consent of the minor's custodial parent or guardian; provided, that this does not prohibit the delivery of such weapons to any peace officer or member of the Armed Forces or National Guard while performing the officer's or member's official duty (c) Violation. A person violating this section shall be guilty of an ordinance violation. (d.) Penalty. The punishment for violating any provision of this section shall be the same as the punishment for the ordinance violation of unlawful use of weapons, which is defined by Sections 50-261 and 50-262. (e.) Severability. If any section, subsection, word, or phrase in this law is held unenforceable, invalid, or illegal, every other section, subsection, word, and phrase shall continue to have the full force and effect of law. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. This Ordinance shall be printed in the Code of Webster Groves. Section 4. ADOPTED this ________day of _____________, 2024. ________________________________ Mayor ATTEST: ____________________________ City Clerk Exhibit 1  RESOLUTION #2024-34 AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE CITY OF OAKLAND FOR UTILIZATION OF PARKS & RECREATION FACILITIES WHEREAS, the City of Oakland, a neighboring municipality, desires to update its resident amenities by providing access to the City of Webster Groves Parks and Recreation facilities at resident rates. WHEREAS, the City of Webster Groves will provide access to its Parks and Recreation Facilities, specifically the Recreation Center, Aquatic Center, Tennis Center, and Ice Rink at the Webster Groves resident rate, subject to the same policies and rules as Webster Groves residents use of recreational facilities. Further, non-resident rates and rules apply to the rentals of park pavilions, ice rink, meeting rooms, and athletic fields. (See Exhibit 1) WHEREAS, the City of Webster Groves Parks and Recreation staff will prepare monthly reports on the City of Oakland’s usage and invoice the City of Oakland for the difference between the resident and non-resident rates. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, that the City Manager is hereby authorized to execute, on behalf of the City, an agreement with the City of Oakland, in substantially the same form as attached hereto, and made a part hereby by this reference, upon simultaneous execution by the City of Oakland. WHEREAS, WEBSTER owns and operates various recreational facilities and programs, including, without limitation, a swimming pool, recreation center, tennis facilities and ice skating rink; WHEREAS, OAKLAND is a neighboring municipality to WEBSTER and does not currently have or plan to construct similar recreational facilities; and WHEREAS, WEBSTER and OAKLAND agree that allowing residents of OAKLAND to use WEBSTER’s recreational facilities at the same rates as WEBSTER residents and in return OAKLAND paying WEBSTER an amount to subsize WEBSTER between WEBSTER’s resident and non-resident fees for use of such facilities will benefit both communities. NOW, THEREFORE, for mutual and valuable consideration, the receipt and sufficiency of which are acknowledged, WEBSTER and OAKLAND, agree as follows: 1. WEBSTER shall provide residents of OAKLAND, who display proof of OAKLAND residency, the opportunity to use WEBSTER’s recreational facilities on a daily on annual basis at the same rates as residents of WEBSTER. The facilities that are subject to this Agreement include the WEBSTER Recreation Center, Aquatic Center, Tennis Center, and Ice Arena. This Agreement excludes resident rates for rental of park pavilions, ice rink, meeting rooms and athletic fields. 2. OAKLAND shall pay to WEBSTER amounts necessary to subsidize WEBSTER for the difference in cost between WEBSTER’s resident and non-resident rates for the use of the recreational facilities by OAKLAND residents. WEBSTER agrees to provide itemized monthly invoices to OAKLAND detailing the amount of day-use passes and annual memberships purchased, resident fee, non-resident fee, and subsidized difference billable to OAKLAND. OAKLAND shall pay such invoice within thirty (30) days of receipt. 3. OAKLAND’s commitment to pay WEBSTER for the difference between the resident and non-resident rates for the WEBSTER facilities used by OAKLAND residents shall be capped at the ending amount of any calendar month that $15,000 in subsidies have been accrued during the OAKLAND fiscal year (July 1 to June 30). In the event OAKLAND reaches its maximum payment obligation during any OAKLAND fiscal year, OAKLAND shall publish in its monthly newsletter, social media or other outlets to its residents that OAKLAND residents will be charged the non-resident rates for the remainder of the OAKLAND fiscal year. WEBSTER shall be entitled to also advise OAKLAND residents that OAKLAND residents will be charged the non- resident rates for use of WEBSTER recreational facilities and programs through the remainder of OAKLAND’s fiscal year. 4. OAKLAND residents will be subject to the same policies and rules as WEBSTER residents for the use of WEBSTER’s recreational facilities 5. This term of this Agreement shall run from the effective date of this Agreement through June 30, 2025. This Agreement shall automatically renew for successive one year renewal terms running from July 1 to June 30 unless either party notifies the other at least 60 days in advance that it intends to not renew this Agreement. Either party may terminate this Agreement upon 60 days’ advanced written notice. WHEREFORE, the Parties have set their hands the day and date first above written.
