CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; John T. McGovern, Vice Mayor; Michael Drahos, Councilman; Michael Napoleone, Councilman and Tanya Siskind, Councilwoman. Advisors to the Council: Jim Barnes, Manager; Laurie Cohen, Attorney; Tanya Quickel, Deputy Village Manager; Ed De La Vega, Assistant Village Manager; and Chevelle D. Addie, Village Clerk. 2. PLEDGE OF ALLEGIANCE Members of the Wellington Youth Council led the Pledge of Allegiance. 3. INVOCATION Rabbi Dan Krimsky, Temple B’Nai Jacob, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as presented. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (4-0), to approve the Agenda as presented. Vice Mayor McGovern away from the dais. 5. PRESENTATIONS AND PROCLAMATIONS A. 21-4880 PRESENTATION OF THE FLORIDA LEAGUE OF CITIES 2021 YOUTH COUNCIL VIDEO COMPETITION WINNERS Mr. Barnes introduced this item. Ms. Edwards showed Council the Youth Council video submission. She then introduced Ms. Shwanda Barnette, Florida League of Cities, who presented the Youth Council with a trophy. The Youth Council thanked the Village Council and the Community Services Department for their support. The Village Council commended the Youth Council for their efforts, Village of Wellington Page 1 Village Council Action Summary - Final January 25, 2022 success and all of the work that they have done. Council thanked them and stated this is a well-deserved recognition. Ms. Edwards recognized the Education Board, Crowned Pearls of Wellington and teachers who were in the audience. She also introduced Mr. Cergile Sincere, new Director of the Wellington Boys and Girls Club, who gave comments. Council welcomed Mr. Sincere to Wellington. B. 21-4890 NATIONAL COMMUNITY SURVEY RESULTS FOR THE VILLAGE OF WELLINGTON Mr. Barnes introduced the item. Erin Caldwell thanked David Feliciano for his assistance in the development of the survey and acknowledged her colleague Alyssa Brunner. She referenced the National Community Survey which was hosted on Polco. Ms. Caldwell provided an overview of the survey, highlighted benchmark comparisons and presented a summary of the key findings and results. She referenced the six “E’s”. Council provided comments regarding the survey. Mr. Barnes provided follow up comments about the survey. 6. CONSENT AGENDA Mr. Barnes stated there were no comment cards on the Consent Agenda. Mr. Barnes indicated staff recommended approval of the Consent Agenda as presented. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Consent Agenda as presented. Public Comment: 1. PBSO Deputy Poritz extended an invitation for the “A Day for Autism-Building Bridges with Law Enforcement Picnic” event to be held on February 27, 2022 from 10:00 a.m. to 1:00 p.m. at Village Park. The event is free to the public. PUBLIC HEARINGS A. 21-4870 ORDINANCE NO. 2022-02 (ARTIFICIAL TURF - ZONING TEXT AMENDMENT TO WELLINGTON’S LAND DEVELOPMENT REGULATIONS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT TO MODIFY SECTION 3.2 – DEFINITIONS, OF ARTICLE 3, TO PROVIDE A DEFINITION FOR ARTIFICIAL TURF; TO MODIFY SECTION 6.4.2 – RESIDENTIAL DISTRICT/PUD SPECIFIC DEVELOPMENT STANDARDS, OF ARTICLE 6, TO PROVIDE STANDARDS FOR IMPERVIOUS SURFACE AREAS; AND TO MODIFY SECTION 7.8.1 – GENERAL LANDSCAPE STANDARDS, OF ARTICLE 7, TO ALLOW THE LIMITED USE OF ARTIFICIAL TURF FOR RESIDENTIAL AND NON-RESIDENTIAL USES, AS MORE SPECIFICALLY CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. Ms. Addie read the Ordinance by title. Mr. Stillings presented the item and answered Council's questions. Public Hearing A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0) to open the public hearing. Public Comment: 1. Debbie Evans stated she wrote a letter and expressed her concerns regarding artificial turf. There being no further public comments, a motion was made by Councilman Napoleone, seconded by Councilman Drahos, and unanimously passed (5-0) to close the public hearing. Village of Wellington Page 4 Village Council Action Summary - Final January 25, 2022 At this point, the Village Council invited Anthony Medina to speak regarding artificial turf. There were further questions from Council about the artificial turf. Mr. Stillings stated staff would analyze various lot sizes. A motion was made by Councilman Napoleone, seconded by Vice Mayor McGovern and passed (4-1; Councilman Drahos dissenting) to approve Ordinance No. 2022-02 (Artificial Turf - Zoning Text Amendment to Wellington's Land Development Regulations) as amended (with the deletion of 1A and the addition of driveway language) on first reading. B. 21-4884 FIRST READING OF ORDINANCES AMENDING CHAPTERS 9 THROUGH 16 OF WELLINGTON’S CODE OF ORDINANCES Mr. Barnes introduced the item. Ms. Addie read the Ordinances by title. Mr. Basehart and Ms. Cohen presented the item, referenced the changes to the chapters and answered Council's questions. Mr. Reinsvold discussed definitions regarding a horse wash. Public Hearings A motion was made by Councilman Napoleone, seconded by Councilman Drahos, and unanimously passed (5-0) to open the public hearing for Chapter 9. Public Comment: 1. Dr. Kristy Lund stated she is an Equestrian Preserve Committee (EPC) Member and expressed her concerns regarding Chapter 9. 2. Jane Cleveland stated her concerns are procedural regarding Chapter 9. She stated she does not see EPC's version included in what is before Council tonight. There being no further public comments, a motion was made by Vice Mayor McGovern, seconded by Councilman Drahos, and unanimously passed (5-0) to close the public hearing. Mr. Reinsvold explained the footage regarding a horse wash. Village of Wellington Page 5 Village Council Action Summary - Final January 25, 2022 Mr. O'Dell discussed the version of Chapter 9 that Council received as a part of the agenda packet. He also referenced the recommendations. There was further discussion between staff and Council regarding BMPs. 1) A motion was made by Vice Mayor McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0) to approve Ordinance No. 2022-05 (Chapter 9) as amended on first reading. A motion was made by Vice Mayor McGovern, seconded by Councilman Drahos, and unanimously passed (5-0) to open the public hearing for Chapters 10-16. There being no public comments, a motion was made by Councilman Drahos, seconded by Vice Mayor McGovern, and unanimously passed (5-0) to close the public hearing. 2) A motion was made by Councilman Napoleone, seconded by Councilman Drahos, and unanimously passed (5-0) to approve Ordinance No. 2022-01 (Chapter 10) as presented on first reading. 3) A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (4-0) to approve Ordinance No. 2022-07 (Chapter 11) as amended on first reading. 4) A motion was made by Councilman Napoleone, seconded by Councilman Drahos, and unanimously passed (5-0) to approve Ordinance No. 2022-08 (Chapter 12) as presented on first reading. 5) A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0) to approve Ordinance No. 2022-09 (Chapter 13) as presented on first reading. 6) A motion was made by Councilman Napoleone, seconded by Vice Mayor McGovern, and unanimously passed (5-0) to approve Ordinance No. 2022-10 (Chapter 14) as presented on first reading. Council thanked Mr. Basehart, Ms. Cohen and staff for the amount of time spent on the ordinances. 8. REGULAR AGENDA There were no Regular Agenda items. 9. PUBLIC FORUM Mr. Barnes indicated no comment cards were received. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen provided a brief update on the Impaired Waters issue. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The Next Regular Council Meeting will be held on Tuesday, February 22, 2022 at 7:00 p.m. The Council Meeting scheduled for February 8, 2022, will be cancelled, as the Florida League of Cities Legislative Action Days are being held on February 8, 2022 and February 9, 2022 in Tallahassee. Agenda Review will be held on Thursday, February 17, 2022 due to the Presidents' Day Holiday. Council asked that staff work on the agenda review meeting date. Village Offices will be closed on Monday, February 21, 2022 in observance of the Presidents' Day Holiday. Based on information released by Palm Beach County, staff recommends revising the September Council Meeting Schedule as Village of Wellington Page 7 Village Council Action Summary - Final January 25, 2022 follows: Agenda Review Thursday, September 1, 2022 1st Meeting Tuesday, September 6, 2022 Agenda Review Monday, September 19, 2022 2nd Meeting Wednesday, September 21, 2022 Palm Beach County has scheduled their Second Budget Hearing for 9/20/2022. This recommended schedule also avoids any conflict with Rosh Hashanah. Staff is continuing outreach efforts regarding the golf cart ordinance and completion of public service announcements (PSAs) about golf cart safety. 12. COUNCIL REPORTS VICE MAYOR MCGOVERN: Vice Mayor McGovern presented the following report: Vice Mayor McGovern asked for an update regarding the Village's two testing locations. Mr. Barnes discussed the testing sites and capacity. He also discussed a possible location at the equestrian grounds. Councilman Drahos commented that there is a high concentration of international travel there and a public need for testing at that location. Mr. Barnes commented that the testing sites will remain open, public sites to receive governmental support and funding. Vice Mayor McGovern inquired about appointments and capacity at the Village Hall testing site. Mayor Gerwig commented about the testing site located at Wellington Green Park. Mr. Barnes discussed the sites and answered other questions from Council. Mr. De La Vega discussed those who walkup at the Village Hall testing site without an appointment. He stated Curative refers them to the other site. Mr. Barnes stated information regarding the sites is updated on the Village of Wellington Page 8 Village Council Action Summary - Final January 25, 2022 website and the Village has had media coverage also. Vice Mayor McGovern inquired about the positivity rate. Mr. De La Vega discussed the positivity rate. Vice Mayor McGovern commented regarding facial coverings and asked if staff will continue to monitor this. Mr. Barnes stated staff will continue to follow the County regarding facial coverings. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind stated that the legislative session in Tallahassee was productive and she is looking forward to attending the Florida League of Cities' Legislative Days in February with the Mayor. COUNCILMAN DRAHOS: Councilman Drahos presented the following report: Councilman Drahos stated he had no report. COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Councilman Napoleone stated he had been contacted by a high number of residents commending the new waste management company, FCC, and they are happy with the service they are receiving. Councilman Napoleone stated on February 7, 2022, the Village will be a stop on the "Hate Ends Now" Tour. He commended Michelle Garvey for her efforts on getting this set up. Vice Mayor McGovern stated he has heard praise for FCC and thanked the Wellington Staff and the FCC team for a smooth transition. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig commented regarding evaluations for the Village Manager Village of Wellington Page 9 Village Council Action Summary - Final January 25, 2022 and Village Attorney and stated she would like the evaluations that have been received distributed to Council. Mayor Gerwig stated she looks forward to the Florida League of Cities' Legislative Action Days. Mayor Gerwig stated the Palm Beach County League of Cities' meeting will be held here in Wellington tomorrow. Vice Mayor McGovern stated the Great Charity Challenge will be held on February 5, 2022. Mr. Barnes stated the BrewFest will also be held on February 5, 2022. Mayor Gerwig thanked staff for the positive things they are placing on the agenda i.e. the Youth Council, Robotics Teams, etc. 13.
