CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; John T. PLEDGE OF ALLEGIANCE Cub Scout Pack 125 led the Pledge of Allegiance. 3. INVOCATION Deacon Al Payne, St. Therese de Lisieux Catholic Church, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. 1) Add a Presentation regarding Impaired Waters as Item 5D under Presentations. 2) Move Item 5A, Presentation of Audit Results for the Fiscal Year Ended September 30, 2021, to Item 5C. 3) Move Item 5C, Pack 125 Annual Pinewood Derby Invitation, to Item 5A. A motion was made by Vice Mayor McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0), to approve the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS A. 22-4940 PACK 125 ANNUAL PINEWOOD DERBY INVITATION This Item was formerly Item 5C. Cub Scout Pack 125 thanked Council for their support and extended an Village of Wellington Page 1 Village Council Action Summary - Final February 22, 2022 invitation to Council to participate in the Pinewood Derby. The Derby will be held on March 5, 2022 at the Wellington Amphitheater. Members of the pack distributed the cars to Councilman Napoleone, Palm Beach County Sheriff's Office Captain Rolando Silva and Palm Beach County Fire Rescue Battalion Chief Philip Olavarria. B. 22-4928 PRESENTATION OF FLORIDA SCHOOL CROSSING GUARD APPRECIATION DAY Mr. Barnes introduced the item. Ms. Addie read the proclamation. Captain Rolando Silva provided background information regarding the school crossing guard proclamation. Council presented the proclamation, thanked and commended the school crossing guards. They also thanked the Public Safety Committee for their efforts. C. 22-4919 PRESENTATION OF AUDIT RESULTS FOR THE FISCAL YEAR ENDED SEPTEMBER 30, 2021 This Item was formerly Item 5A. Mr. Barnes introduced the item. Ms.Tanya Quickel introduced Ms. Racquel McIntosh, partner with Grau & Associates, who presented the Audit for the Village of Wellington for the fiscal year ended September 30, 2021. Ms. Quickel stated it was a Village wide effort and commended everyone involved in providing information for the audit. Council extended their thanks to Ms. McIntosh and her firm and Ms. Quickel and team for their hard work. D. PRESENTATION REGARDING IMPAIRED WATERS ISSUE This Item was added to the Agenda. Mr. Barnes introduced the item. Mr. Craig Varn provided an update regarding the Impaired Waters issue. Mr. Barnes, Mr. Varn and Ms. Cohen responded to Council's questions. PUBLIC HEARINGS A. 21-4888 ORDINANCE NO. 2022-03 (COMPREHENSIVE PLAN AMENDMENT TO THE MOBILITY ELEMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING WELLINGTON COMPREHENSIVE PLAN, MORE SPECIFICALLY, TO MODIFY THE MOBILITY ELEMENT BY REPLACING THE EXISTING PEDESTRIAN NETWORK MAP WITH THE PEDESTRIAN PATHWAY NETWORK MAP; UPDATING THE BICYCLE LANES MAP; ADDING THE MULTI-MODAL PATHWAYS MAP; REORDERING OTHER EXISTING MAPS IN THE MOBILITY ELEMENT; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Barnes introduced the item. Ms. Addie read the Ordinance by title. Mr. O'Dell presented this item and submitted the staff report and file into the record. He answered Council's questions. Public Hearing A motion was made by Councilman Drahos, seconded Councilwoman Siskind, and unanimously passed (5-0) to open the public hearing. Public Comment: 1. Glen Fleischer thanked Council for their service and stated there is a lot of good in the mobility element and thanked Mr. O’Dell and his team for their efforts on the mobility element. He asked Council to reject the item that would breach Palm Beach Point. 2. Eileen Yarbrough spoke regarding the ordinance and stated she agrees with what Mr. Fleischer stated. She said she utilizes the yellow trail and encounters motor bikes/motorcycles more than horses. She stated it is not necessary to add another trail. 3. Ben Myers referenced Flying Cow and stated his job is desensitizing horses. He read a statement into record. He asked Council to strike the bridge from the plan. She briefly discussed the equestrian community and Palm Beach Point specifically. 5. Marilyn Bryson’s comment was read into record. She opposes the bridge. 6. Rod Bryson spoke regarding the ordinance. He stated any proposal that would allow a non-resident into their community is a security breach to their community. He stated the bridge is not necessary because the red and yellow trails are already there. He stated no one in Palm Beach Point wants or needs it. 7. Sarah Goos stated the road is prone to cars speeding and the bridge would make their community unsecure. There being no further public comments, a motion was made by Councilman Drahos, seconded by Councilman Napoleone, and unanimously passed (5-0) to close the public hearing. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0) to approve Ordinance No. 2022-03 (Comprehensive Plan Amendment to the Mobility Element) with deletion of the multi-modal pathway within the limits of Palm Beach Point and deletion of the crossing over the C1 canal at C24. Vice Mayor McGovern thanked Mr. O'Dell and his team for putting this together. B. 21-4900 ORDINANCE NO. 2022-04 (SHIP PROGRAM) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL ESTABLISHING THE WELLINGTON STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) LOCAL HOUSING ASSISTANCE PROGRAM, ESTABLISHING A LOCAL HOUSING TRUST FUND, AND ESTABLISHING AN AFFORDABLE HOUSING ADVISORY COMMITTEE, CONSISTENT WITH AMENDMENTS TO SECTION 420.9076, FLORIDA STATUTES; PROVIDING A CONFLICTS CLAUSE; PROVIDING FOR CODIFICATION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. C. 22-4942 ORDINANCE NO. 2022-02 (ARTIFICIAL TURF - ZONING TEXT AMENDMENT TO WELLINGTON’S LAND DEVELOPMENT REGULATIONS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT TO MODIFY SECTION 3.2 – DEFINITIONS, OF ARTICLE 3, TO PROVIDE A DEFINITION FOR ARTIFICIAL TURF; TO MODIFY SECTION 6.4.2 – RESIDENTIAL DISTRICT/PUD SPECIFIC DEVELOPMENT STANDARDS, OF ARTICLE 6, TO PROVIDE STANDARDS FOR IMPERVIOUS SURFACE AREAS; AND TO MODIFY SECTION 7.8.1 – GENERAL LANDSCAPE STANDARDS, OF ARTICLE 7, TO ALLOW THE LIMITED USE OF ARTIFICIAL TURF FOR RESIDENTIAL AND NON-RESIDENTIAL USES, AS MORE SPECIFICALLY CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. She read a statement into record. There being no further public comments, a motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0) to close the public hearing. There was further discussion regarding artificial turf between Council, Mr . Stillings and Mr. Barnes. A motion was made by Councilman Drahos, seconded by Councilman Napoleone and passed (4-1; Mayor Gerwig dissenting) to approve Ordinance No. 2022-02 (Artificial Turf - Zoning Text Amendment to Wellington's Land Development Regulations) with Exhibit A amendment. 8. REGULAR AGENDA A. 21-4781 AUTHORIZATION TO 1) AMEND AN EXISTING CONTRACT TO ADD CONSTRUCTION PHASE CONSULTING SERVICES FOR PHASE II OF THE TOWN CENTER PROJECT AND 2) EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT FOR THE CONSTRUCTION MANAGER AT RISK CONTRACT FOR PHASE II OF THE TOWN CENTER PROJECT Mr. Barnes introduced the item. Mr. O'Dell presented this item. He answered Council's questions. A motion was made by Councilman Napoleone, seconded by Councilman Drahos, and unanimously passed (5-0) for Authorization to 1) Amend an existing contract to add construction phase consulting services for Phase II of the Town Center Project and 2) Execute a Guaranteed Maximum Price (GMP) Amendment for the Construction Manager At Risk contract for Phase II of the Town Center Project. 9. Chris George spoke regarding Councilwoman Siskind running for the election. 10. ATTORNEY'S REPORT MS. BAUSCH: Ms. Bausch presented the following report: Ms. Bausch stated she had no report. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The Next Regular Council Meeting will be held on Monday, March 7, 2022, due to the canvassing board needing to be present on March 8, 2022 at the Supervisor of Elections Service Center. 12. COUNCIL REPORTS VICE MAYOR MCGOVERN: Vice Mayor McGovern presented the following report: Vice Mayor McGovern stated he hopes to see everyone at the Day for Autism event. Vice Mayor McGovern commented regarding voting for the March 8, 2022 election. COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Councilman Napoleone stated the Day for Autism is this Saturday at Village Park. Councilman Napoleone stated the Pinewood Derby will be held on March 5, 2022. COUNCILMAN DRAHOS: Councilman Drahos presented the following report: Councilman Drahos stated he would miss the weekend events due to out of town travel. Councilman Drahos conveyed his support for Vice Mayor McGovern and Village of Wellington Page 9 Village Council Action Summary - Final February 22, 2022 Councilwoman Siskind. He said it has been a privilege working with them for the past six years. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind congratulated Ms. Quickel and her team on receiving the Government Finance Officers' Association (GFOA) Award for excellence in financial reporting. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig asked if there was a way to restore the public access to the portal regarding financial spending for the Village. Mr. Barnes discussed the previous Open Wellington technology and possible future Council access to the information with the Village's new software with Tyler. Mayor Gerwig commented regarding the lobbying firm contract. Mayor Gerwig stated she and Councilwoman Siskind attended the Florida League of Cities (FLC) Legislative Action Days in Tallahassee. Councilwoman Siskind stated it was a productive trip. Mayor Gerwig commented about an accident on her street. She asked that people observe the speed limits because there are a significant number of young children who play on that street. Mr. Barnes stated staff would provide the information to PBSO and would review this in regards to speeding studies in the Village. 13.
