CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Drahos, Councilman; Michael Napoleone, Councilman and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the March 22, 2022, Regular Council Meeting for review. A. 22-4921 PRESENTATION TO WELLINGTON FOR AMERICAN HEART ASSOCIATION’S WORKPLACE HEALTH ACHIEVEMENT INDEX RECOGNITION Mr. Barnes introduced the item. He stated that this was the Presentation of Wellington's American Heart Association Recognition for Workplace Health Achievement Index. B. 22-4993 TRANSGENDER DAY OF VISIBILITY PROCLAMATION Mr. Barnes introduced the item. He stated that this was the Proclamation of Wellington, Florida's Council Recognizing March 31, 2022 as Transgender Day of Visibility in the Village of Wellington. He mentioned that this would be added to the annual list of proclamations. C. 21-4778 AUTHORIZATION TO AWARD A CONTRACT FOR THE AERO CLUB DRIVE AND BIG BLUE TRACE LANDSCAPING PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Award a Contract for the Aero Club Drive and Big Blue Trace Landscaping Project to Gardening Angel Nursery, Inc. in the Amount of $510,812.70. Mr. Reinsvold explained the item. He presented a powerpoint to Council regarding the Aero Club/Big Blue Trace Landscaping and Irrigation Installation and discussed the location of the landscaping project in Aero Club between the C15 Canal to Greenbriar, the location of the irrigation project in Big Blue Trace between Wellington Trace to South Shore, landscaping planters and irrigation pump positioning on the map, Aero Club Widening & Bike Lanes and the typical planter layout. Mr. Reinsvold continued on with the presentation and further discussed the typical planter layouts. Mr. Reinsvold and Mr. Barnes answered more of Council’s questions. D. 21-4829 AUTHORIZATION TO 1) AWARD A CONTRACT TO PANTROPIC POWER, INC. FOR THE SUPPLY AND DELIVERY OF A STANDBY POWER GENERATOR AND 2) APPROVAL OF RESOLUTION NO. R2022-08 AMENDING THE UTILITY FUND BUDGET FOR FISCAL YEAR 2021-2022 BY REASSIGNING CAPITAL PROJECT BUDGETS TO THE WATER TREATMENT PLANT (WTP) GENERATOR REPLACEMENT PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to 1) Award a Contract to Pantropic Power, Inc. for the Supply and Delivery of a Standby Power Generator in the Amount of $645,763 and 2) Approval of Resolution No. R2022-08 Amending the Utility Fund Budget for Fiscal Year 2021-2022 by Reassigning Capital Project Budgets to the Water Treatment Plant (WTP) Generator Replacement Project. Ms. LaRocque explained the item. She answered questions from Council. Mayor Gerwig asked about the construction out on the road in front of the Village Hall. Mr. Wagner and Mr. Barnes answered her question. E. 21-4834 AUTHORIZATION TO RENEW A CONTRACT WITH ZAMBELLI FIREWORKS MANUFACTURING CO. FOR THE ANNUAL JULY 4TH FIREWORKS DISPLAY Mr. Barnes introduced the item. He stated that this was the Authorization to Renew a Contract with Zambelli Fireworks Manufacturing Co. for the Annual July 4th Fireworks Display in the Amount of $50,000.00. Mr. Barnes answered Vice Mayor McGovern’s question about the dollar amount and how long it has been at this amount. After some discussion, Mr. Barnes stated that he will speak with Zambelli about improving the fireworks show. Ms. Zembrzuski explained what could be done with increasing the amount. F. 21-4835 AUTHORIZATION TO CONTINUE UTILIZING A SOUTHEAST FLORIDA COOPERATIVE CONTRACT, AS A BASIS FOR PRICING, FOR PURCHASE AND DELIVERY OF GASOLINE AND DIESEL FUEL Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing a Southeast Florida Cooperative Contract with Port Consolidate, Inc., as a Basis for Pricing, for the Purchase and Delivery of Gasoline and Diesel Fuel in the Amount of Approximately $362,955 Annually. Mr. Barnes explained the item. He answered questions from Council. G. 21-4839 AUTHORIZATION TO RENEW AN EXISTING CONTRACT FOR LIME SLUDGE HAULING AND DISPOSAL SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Renew an Existing Contract with Devland Site Paving and Utilities, Inc. for Lime Sludge Hauling and Disposal Services in the Amount of Approximately $150,000 Annually. Ms. LaRocque explained the item. She answered the questions from Council. H. 21-4903 AUTHORIZATION TO EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT TO WHARTON-SMITH, INC. FOR THE WATER TREATMENT PLANT (WTP) CHEMICAL FEED SYSTEM IMPROVEMENT PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Execute a Guaranteed Maximum Price (GMP) Amendment to Wharton-Smith, Inc. for the Water Treatment Plant (WTP) Chemical Feed System Improvement Project at a Cost of $206,857.68. Ms. LaRocque explained the item. I. 21-4905 AUTHORIZATION TO AWARD A TASK ORDER TO HAZEN & SAWYER P.C. TO PROVIDE ENGINEERING CONSULTING SERVICES FOR THE RENEWAL OF A FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP) OPERATING PERMIT Village of Wellington Page 3 Village Council Workshop Action Summary - Final March 21, 2022 Mr. Barnes introduced the item. He stated that this was the Authorization to Award a Task Order to Hazen & Sawyer P.C. to Provide Water and Wastewater Treatment Engineering Services for the Renewal of a Florida Department of Environmental Protection (FDEP) Operating Permit at a Cost of $69,826. Ms. LaRocque explained the item. She answered Vice Mayor McGovern’s question. J. 21-4901 ITEM: RESOLUTION NO. R2022-02 (ADOPTION OF LOCAL HOUSING ASSISTANCE PLAN AND DESIGNATING RESPONSIBILITY TO THE VILLAGE MANAGER FOR THE ADMINISTRATION OF THE LOCAL HOUSING ASSISTANCE PLAN) A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL ADOPTING THE LOCAL HOUSING ASSISTANCE PLAN AS REQUIRED BY THE STATE HOUSING INITIATIVES PARTNERSHIP PROGRAM ACT, SUBSECTIONS 420.907-420.9079, FLORIDA STATUTES; AND RULE CHAPTER 67-37, FLORIDA ADMINISTRATIVE CODE; AUTHORIZING AND DIRECTING THE VILLAGE MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS AND CERTIFICATIONS NEEDED BY THE STATE; AUTHORIZING THE SUBMISSION OF THE LOCAL HOUSING ASSISTANCE PLAN FOR REVIEW AND APPROVAL BY THE FLORIDA HOUSING FINANCE CORPORATION; AND PROVIDING AN EFFECTIVE DATE. REQUEST: Approval of Resolution No. R2022-02 to adopt the Local Housing Assistance Plan and designate and authorize the Village Manager to execute any documents and certifications to carry out the terms and conditions of said program as required by the Florida Housing Finance Corporation. He stated that this was the Approval of Resolution No. R2022-02 to Adopt the Local Housing Assistance Plan and Designate and Authorize the Village Manager to Execute Any Documents and Certifications to Carry Out the Terms and Conditions of Said Program as Required by the Florida Housing Finance Corporation. Mr. O’Dell explained the item. He presented a brief Powerpoint to Council and discussed Wellington’s proposed action strategies. Mr. O’Dell answered questions from Council. K. 22-4926 RESOLUTION NO. R2022-07 (AUTHORIZING EXECUTION OF THE 2ND AMENDMENT TO INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY - HOMELESS RESOURCE CENTER) Village of Wellington Page 4 Village Council Workshop Action Summary - Final March 21, 2022 A RESOLUTION OF WELLINGTON’S COUNCIL AUTHORIZING THE MAYOR OR VICE MAYOR AND THE VILLAGE CLERK TO EXECUTE THE SECOND AMENDMENT TO THE INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY TO REFER AND TRANSPORT HOMELESS INDIVIDUALS TO THE HOMELESS RESOURCE CENTER; AND PROVIDING AN EFFECTIVE DATE. He stated that this was the Approval of Resolution No. R2022-07 Authorizing the Mayor or Vice Mayor to Execute the 2nd Amendment to the Interlocal Agreement with Palm Beach County (Homeless Resource Center) in the Form Attached as Exhibit A. L. 22-4977 DEVELOPER AGREEMENT WITH TUTTLE ROYALE APARTMENTS, LLC FOR POD 4 IN THE VILLAGE ROYALE DEVELOPMENT LOCATED IN PALM BEACH COUNTY, FLORIDA Mr. Barnes introduced the item. He stated that this was the Approval of a Developer Agreement Reserving Potable Water, Wastewater and Fire Capacity for POD 4 in the Village Royale Development Which is Owned/Controlled by Tuttle Royale Apartments, LLC in Palm Beach County, Florida. Ms. LaRocque explained this item and the next item. She answered questions from Council. M. 22-4979 DEVELOPER AGREEMENT WITH TUTTLE ROYALE APARTMENTS, LLC FOR POD 2 IN THE VILLAGE ROYALE DEVELOPMENT LOCATED IN PALM BEACH COUNTY, FLORIDA Mr. Barnes introduced the item. He stated that this was the Approval of a Developer Agreement Reserving Potable Water, Wastewater and Fire Capacity for POD 2 in the Village Royale Development Which is Owned/Controlled by Tuttle Royale Apartments, LLC in Palm Beach County, Florida. Ms. LaRocque explained this with the previous item. N. 22-4982 ORDINANCE NO. 2022-03 (COMPREHENSIVE PLAN AMENDMENT TO THE MOBILITY ELEMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING WELLINGTON COMPREHENSIVE PLAN, MORE SPECIFICALLY, TO MODIFY THE MOBILITY ELEMENT BY Village of Wellington Page 5 Village Council Workshop Action Summary - Final March 21, 2022 REPLACING THE EXISTING PEDESTRIAN NETWORK MAP WITH THE PEDESTRIAN PATHWAY NETWORK MAP; UPDATING THE BICYCLE LANES MAP; ADDING THE MULTI-MODAL PATHWAYS MAP; REORDERING OTHER EXISTING MAPS IN THE MOBILITY ELEMENT; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. He stated that this was the Approval of Ordinance No. 2022-03 to Modify the Pedestrian Pathways Network, Bicycle Lanes, and Multi-Modal Pathways Maps of the Mobility Element in the Comprehensive Plan. Mr. O’Dell explained the item. He presented a Powerpoint to Council and discussed the M5 map, M6 map, pedestrian pathway network, multimodal pathways, bicycle lanes, what the approval provides, and the bicycle and pedestrian circulation plan. O. 22-4968 ORDINANCE NO. 2022-04 (SHIP PROGRAM) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL ESTABLISHING THE WELLINGTON STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) LOCAL HOUSING ASSISTANCE PROGRAM, ESTABLISHING A LOCAL HOUSING TRUST FUND AND ESTABLISHING AN AFFORDABLE HOUSING ADVISORY COMMITTEE, CONSISTENT WITH AMENDMENTS TO SECTION 420.9076, FLORIDA STATUTES; PROVIDING A CONFLICTS CLAUSE; PROVIDING FOR CODIFICATION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Approval of Ordinance No. 2022-04 to Implement the State Housing Initiatives Partnership (SHIP) Program by Establishing a Local Housing Trust Fund and Establishing an Affordable Housing Advisory Committee. Mr. O’Dell mentioned that he will have a full presentation at the next meeting. P. 22-4935 RESOLUTION NO. R2022-19 (AUTHORIZATION TO ENTER INTO A COMPREHENSIVE AGREEMENT FOR THE DEVELOPMENT, CONSTRUCTION, OPERATION AND MAINTENANCE OF A RECREATIONAL FACILITY AT THE WELLINGTON COMMUNITY PARK SITE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MAYOR TO EXECUTE A COMPREHENSIVE AGREEMENT WITH WELLINGTON ATHLETICS, LLC FOR THE Village of Wellington Page 6 Village Council Workshop Action Summary - Final March 21, 2022 DEVELOPMENT. CONSTRUCTION, OPERATION AND MAINTENANCE OF A RECREATIONAL FACILITY AT THE WELLINGTON COMMUNITY PARK SITE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Authorization to Enter Into An Agreement with Wellington Athletics, LLC, for the Development, Construction, Operation and Maintenance of the Wellington Community Park Site, Contingent on Council Approval of Public Financing. Mr. Barnes explained that they will be postponing it to the first meeting in April and explained why. Mr. Barnes and Ms. Quickel answered questions from Council. Council gave their comments on the item. Q. 22-4983 APPOINTMENT OF COUNCIL MEMBER TO NEGOTIATE RENEWAL OF VILLAGE ATTORNEY CONTRACT Mr. Barnes introduced the item. He stated that this was the Appointment of Council Member to Negotiate Renewal of Village Attorney Contract. Vice Mayor McGovern asked for status of all Village of Wellington cases before the next meeting. 4. WORKSHOP Mr. Barnes introduced the item. He presented a video of the new app that was created for the Village of Wellington. He explained the features of the app, how it works and where it is available. Mr. Silliman gave a demonstration on how a resident would report an issue. Mr. Barnes and Mr. Silliman answered questions from Council. 5. ATTORNEY'S COMMENTS None. 6. MANAGER COMMENTS Mr. Barnes reminded Council of the Canvassing Board meeting the next evening at 6:00 p.m. and the swearing-in ceremony will be around 6:30 p.m. with the Council meeting at 7:00 p.m. He mentioned that they will Village of Wellington Page 7 Village Council Workshop Action Summary - Final March 21, 2022 get an email or AT regarding the Charter modification of the Supervisor of Elections as part of the Canvassing Board and reviewing Charter requirements of going to one meeting a month. Mr. Barnes answered Council’s questions. Ms. Cohen commented on the Charter requirements with discussion from Council. Mr. Barnes informed Council that Civics 101 had been cancelled and rescheduled. 7. COUNCIL COMMENTS Vice Mayor McGovern asked Ms. Cohen about an AT regarding the Special Magistrate appointment. Ms. Cohen and Mr. Barnes explained the current code on the renewal of appointments. 8.
