CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; Michael Drahos, Vice Mayor; John T. McGovern, Councilman; Michael Napoleone, Councilman and Tanya Siskind, Councilwoman. Advisors to the Council: Jim Barnes, Manager; Laurie Cohen, Attorney; Tanya Quickel, Deputy Village Manager; Ed De La Vega, Assistant Village Manager; and Chevelle D. Addie, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. INVOCATION Father Mario Casteneda, St. Rita Catholic Church, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. 1 Move Item 6M, Approval by the Wellington Council of the Paving of a Portion of 50th Street and Adoption by the ACME Board of Supervisors of Resolution No. AC2022-01 Approving Consideration of the Adoption of a Plan of Improvements for a Unit of Development for 50th Street to the Regular Agenda as Item 8A; and the other Public Hearing items will move accordingly (Item 8A becomes Item 8B, Item 8B becomes Item 8C, Item 8C becomes Item 8D and Item 8D becomes Item 8E). 2. Add Presentation from Senator Lori Berman to the Agenda as Item 5B. Correspondingly, Item 5B will become Item 5C and Item 5C will become Item 5D. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS A. 22-5085 SENATOR TINA POLSKY: LEGISLATIVE UPDATE Village of Wellington Page 1 Village Council Action Summary - Final June 14, 2022 Mr. Barnes introduced the item. Senator Polsky spoke regarding redistricting and the state and house maps. She also mentioned the special session on the property insurance. Senator Polsky informed Council of the preemption bills; specifically Senate Bill 620. She stated legislation regarding smoking in parks was passed. Senator Polsky stated the House has a grant program similar to the appropriations program for projects. She said they are happy to answer any questions the Council may have. B. SENATOR LORI BERMAN: LEGISLATIVE UPDATE (THIS ITEM ADDED TO THE AGENDA) Senator Berman spoke regarding the special session on property insurance. She mentioned the 2% deductible and number of policies that Citizens Insurance has with homeowners. She commented regarding re-insurance. Senator Berman stated due to the incident that happened in Surfside, legislation regarding buildings was passed unanimously. Council thanked Senator Polsky and Senator Berman for their attendance and gave brief comments. C. 22-5092 PRESENTATION OF FLORIDA GREEN BUILDING COALITION (FGBC) LOCAL GOVERNMENT GOLD CERTIFICATION AWARD Mr. Barnes introduced the item. C.J. Davila provided an overview of the Florida Green Building Coalition and thanked Branden Miller and other staff who worked on this. He presented the Local Government Gold Certification Award to the Village of Wellington. Mr. De La Vega accepted the award on behalf of the Village. D. 22-4935 RESOLUTION NO. R2022-19 (AUTHORIZATION TO ENTER INTO A COMPREHENSIVE AGREEMENT FOR THE DEVELOPMENT, CONSTRUCTION, OPERATION AND MAINTENANCE OF A RECREATIONAL FACILITY AT THE WELLINGTON COMMUNITY PARK SITE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MAYOR TO EXECUTE A COMPREHENSIVE AGREEMENT WITH WELLINGTON ATHLETICS, LLC FOR THE DEVELOPMENT. CONSTRUCTION, OPERATION AND MAINTENANCE OF A RECREATIONAL FACILITY AT THE WELLINGTON COMMUNITY PARK SITE; AND PROVIDING AN EFFECTIVE DATE. Village of Wellington Page 2 Village Council Action Summary - Final June 14, 2022 Mr. Barnes introduced this item. He acknowledged those in the audience present for the presentation. Mr. De La Vega introduced Mr. Jonathan Bostic who provided brief comments. Mr. Barnes acknowledged Darren Edgecombe, Palm Beach Central High School Principal, who was in the audience. Mr. De La Vega referenced the 21-day notice period and explained the agreement highlights to Council. He stated The Sports Facilities Advisors are available via Zoom tonight. Mr. De La Vega discussed the project schedule and stated the Village has retained consultant Don Schumacher who is president of DSA Sports, LLC. and discussed the scope. Mr. Bostic discussed the project. Mr. Arnold, The Sports Facilities Advisory (SFA), provided an overview of the company and his background. Council asked various questions regarding the risk to the Village, business plan, reports, sports academies, trainers, space rental, who will run the facility and financing. Mr. Brian M. Seymour, ESQ., Shareholder for Gunster Yoakley & Stewart P.A. spoke regarding the bond issuance and pro forma. Mr. Schumacher spoke regarding his role and a situation analysis/report. Mr. Barnes stated it is staff's recommendation that the Village moves forward with this. Ms. Cohen spoke regarding the terms of the agreement and stated there are plenty of protections built into the agreement for both parties. It was worked on very hard by both parties. A motion was made by Vice Mayor Drahos, seconded by Councilman Napoleone, and unanimously passed (5-0), to approve Resolution No. R2022-19 (Comprehensive Agreement). 6. CONSENT AGENDA Mr. Barnes stated there were no comment cards on the Consent Agenda. AC2022-01 APPROVING CONSIDERATION OF THE ADOPTION OF A PLAN OF IMPROVEMENTS FOR A UNIT OF DEVELOPMENT FOR 50th STREET THIS ITEM FORMERLY ITEM 6M. Mr. Barnes introduced this item. Ms. Quickel presented the item. She stated this is a part of the steps for the paving of the portion 50th street. She said letters would be issued to landowners with a copy of the notice. The Report of Engineer for the project would be presented to Council at the July meeting. Village of Wellington Page 11 Village Council Action Summary - Final June 14, 2022 Mr. Craig Galle, on behalf of Far Niente Stables, spoke regarding cost and acreage. Ms. Carolina Cuna (sp?) stated they are fine with this. She discussed their concerns with dust, noise, safety and lack of connection with the bridle path. She stated she is sure the Village will be able to address these in the best way. Mayor Gerwig inquired about the map. A motion was made by Councilman McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0) to approve the Paving of a Portion of 50th Street and Adoption of Resolution No. AC2022-01 (Adoption of a Plan of Improvements for a Unit of Development for 50th Street). B. 21-4784 AUTHORIZATION TO AWARD A CONTRACT TO PROVIDE ARCHITECTURAL AND ENGINEERING SERVICES FOR THE CONSTRUCTION OF A NEW PALM BEACH SHERIFF’S OFFICE (PBSO) SUBSTATION Mr. Barnes introduced the item. Mayor Gerwig declared a conflict of interest, passed the gavel to Vice Mayor Drahos and left the dais. Mr. De La Vega presented the item. He discussed what is included in the task order, program confirmation, the site capacity analysis, and the cost estimate. Village Offices will be closed on Monday, July 4, 2022 in observance of Independence Day. PBI Academy COVID site is now open after a short temporary closure due to technical issues. Cros Ministries Pantry has resumed operations, now at the Wellington Community Center (WCC). Town Center: Phase 1 of the redevelopment project continues and is on schedule Scott’s place and the amphitheater will be closed beginning on July 5, 2022. In addition, parking will be extremely limited once Phase 2 begins. Summer camp is off to a robust start with 50 Kids at the Village Tennis Center and 15 tournament level kids at the High School. All Curative testing sites will be closed on Monday, June 20, 2022 in observance of Juneteenth. The drive through testing site will be open on June 20, 2022 from 8:00 to 5:00 p.m. He encouraged everyone to exit via Montauk due to paving at the intersection of Forest Hill and Town Center Drive. The Redteenth event will be held this Sunday, June 19, 2022 at the Promenade beginning at 4:00 p.m. Mr. Barnes indicated he would email the remainder of his comments. 12.
