REVIEW OF COUNCIL AGENDA A. 17-1081 PRESENTATION OF SCHOLARSHIPS AND CONTRIBUTIONS BY WASTE MANAGEMENT, INC. OF FLORIDA TO LOCAL AREA SCHOOLS Mr. Schofield introduced this item. This item is a presentation from Waste Management, Inc. of Florida (WMI) presenting sustainability scholarships to Wellington High School and Palm Beach Central High School ($2,500 each), as well as providing contributions for the purchase of books to Elbridge Gale and Panther Run Elementary Schools ($1,800 each) and Emerald Cove Middle School ($900). Mayor Gerwig asked who would be representing WMI. Ms. Edwards said she received confirmation from the Elbridge Gale, Panther Run, Palm Beach Central principals and Emerald Cove's Media Specialist would be in attendance. She noted she was waiting for Wellington High School's confirmation and WMI's representative would present each check. There were no changes recommended. B. 17-1172 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA PROCLAIMING MAY 2017 AS "AMERICAN STROKE MONTH" IN THE VILLAGE OF WELLINGTON Mr. Schofield introduced this item. E. 17-1174 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF APRIL 25, 2017 Mr. Schofield introduced this item. This item is for the approval of the Minutes of the Regular Wellington Council Meeting of April 25, 2017. There were no changes recommended. F. 17-0837 AUTHORIZATION TO AWARD A CONTRACT TO MULTIPLE VENDORS FOR ROADWAY STRIPING AND PAVEMENT MARKING SERVICES AND AUTHORIZATION TO APPROVE PROJECTS OVER $25,000 Mr. Schofield introduced this item. This item is for the authorization to award a contract to multiple vendors for roadway striping and pavement marking services in the amount of approximately $50,000 annually and authorization to approve projects over $25,000. Mr. Schofield noted 4 proposals meeting the required specifications were received and the Public Works Department was requesting authorization to award all 4 vendors on a project by project basis based on the lowest unit price. The 2 projects include: 1) Pierson Road (South Shore to Fairlane Farms Road; and 2) Wellington Trace (Forest Hill to Stratford Road) both projects estimated cost was at $25,000. Mr. Schofield explained as the projects get started, the Public Works Department adds pictures to the Manager's Weekly Report in order to indicate the progress being made. Mayor Gerwig asked for the results of the testing of the pavement material on Ousely Farms Road. Mr. Barnes explained the results did not go well and staff had to repave over the material. He said staff was not recommending pursuing the use of the substitute material. There were no changes recommended. Village of Wellington Page 2 Village Council Workshop Action Summary - Final May 8, 2017 G. 17-1023 AUTHORIZATION TO AWARD A CONTRACT FOR THE SOUTH SHORE BOULEVARD AND PIERSON ROAD RIGHT TURN LANE IMPROVEMENT PROJECT Mr. Schofield introduced this item. This item is for the authorization to award a contract to Rosso Site Development, Inc. for the right turn lane improvements at South Shore Boulevard and Pierson Road in the amount of $159,994.23. There were no changes recommended. H. 17-1028 AUTHORIZATION TO: 1) RENEW AN EXISTING CONTRACT FOR UTILITY PROCESS CONTROL SYSTEMS MAINTENANCE & MODIFICATION AND 2) EXECUTE A TASK ORDER FOR UTILITY SCADA SYSTEM UPGRADE Mr. Schofield introduced this item. This item is for the authorization to: 1) Renew an existing contract with Process Control Consultants, Inc. for utility process control systems maintenance & modification, in the amount of approximately $80,000 annually; and 2) Execute a task order with Process Control Consultants, Inc. for Utility SCADA System upgrade in the amount not to exceed $61,200. Mr. Schofield explained the current agenda item and the next agenda item were related and said the contract was for the needed hardware upgrade. There were no changes recommended. I. 17-1083 AUTHORIZATION TO AWARD A SOLE SOURCE CONTRACT FOR THE PURCHASE OF VTSCADA HMI SOFTWARE, LICENSES, SUPPORT AND TRAINING Mr. Schofield introduced this item. This item is for the authorization to award a sole source contract to Trihedral, Inc., for the purchase of VTScada HMI Software, Licenses, Support and Training in the amount of $55,975.88. Mr. Schofield noted this agenda item was for the software which would provide the most updated versions needed moving forward. Mr. Barnes said the software would bring the Water Treatment Plant and Water Reclamation Facility up to date for the pump and booster stations. He noted the software needed to be installed before the design and construction of both plants. There were no changes recommended. R2017-18 FOR A BUDGET AMENDMENT TO ALLOCATE THE GRANT RESOLUTION NO. R2017-17 (LAND AND WATER CONSERVATION FUND) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL TO ENTER INTO AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR THE PURPOSE OF RECEIVING A GRANT UNDER PROVISIONS OF THE LAND AND WATER CONSERVATION PROGRAM FOR THE DORCHESTER PARK PROJECT; AND PROVIDING AN EFFECTIVE DATE. RESOLUTION NO. R2017-18 (FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION GRANT FUNDS) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE FISCAL YEAR 2016-2017 CAPITAL FUND BUDGET FOR FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION GRANT FUNDS AWARDED FOR DEVELOPMENT OF THE DORCHESTER PARK PROJECT; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced this item. This item is for the approval of Resolution No. R2017-17 authorizing the Mayor to enter into an agreement with the Florida Department of Environmental Protection for the Land and Water Conservation Fund grant and approval of Resolution No. R2017-18 for a budget amendment to allocate the $200,000 in grant monies to the Governmental Capital Fund revenue and expenditures. Mr. Schofield said the grant was for the Dorchester Park project which would include an observation platform. Mayor Gerwig asked for the location of the park. Mr. Barnes explained Dorchester Park was in the Greenview Shores 2 neighborhood which was off of Big Blue Trace. He said in the past all of the neighborhood parks had observation platforms or fishing piers but approximately 10 years ago, the maintenance and renovations of the platforms were becoming very costly due to a large amount of vandalism, at that point in time, all of the platforms were eliminated. He said due to the grant funding, the platforms were being reintroduced in some of the neighborhood waterfront parks as an amenity that was heavily used in the past. He stated staff would be using vandal resistant material and construction methods. There were no changes recommended. R2017-16 (FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES (FDACS) MEMORANDUM OF AGREEMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE MEMORANDUM OF AGREEMENT (MOA) NO. 024182 BETWEEN WELLINGTON AND THE FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES (FDACS) REGARDING ENROLLMENT AND IMPLEMENTATION OF FDACS EQUINE BEST MANAGEMENT PRACTICES; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced this item. This item is for the approval of the Memorandum of Agreement (MOA) between Wellington and the Florida Department of Consumer Services (FDACS) regarding enrollment and implementation of FDACS Equine Best Management Practices. Mr. Schofield noted this was a requirement to maintain water quality. Mayor Gerwig said Wellington already has Best Management Practices in place and asked when would a permit be required. Mr. Schofield said a permit would be required anytime action was taken that may cause a problem with water quality, in Wellington, storage and disposal of manure. Mayor Gerwig said if the manure bin needed replacement or land development changes a permit would be needed. Mr. Schofield replied affirmatively and explained under the State of Florida statute, the voluntary program administered by the FDACS has the right to regulate the requests. If the approval was provided by FDACS, a local government permit was not needed. Mr. Schofield said the rules between FDACS and Wellington were very similar and were not conflicting in nature. He felt that the process would be good for Wellington. Mayor Gerwig asked if the information was presented to the Equestrian Preserve Committee (EPC). Mr. O'Dell said the information has not been presented to the EPC. Mr. Schofield said Wellington regulations were not presented to the committees and boards. Mayor Gerwig said having the EPC be aware of the regulations would be helpful in order to send out the message to the farm owners. Mr. Schofield noted if anyone goes to FDACS for a permit, they would be sent to Wellington. Mr. O'Dell reiterated the program was a voluntary program and the water quality requirements would need to be met but the requester was given the opportunity to meet the FDACS or Wellington requirements. He noted FDACS highlights pasture management and they work with the farm owners to assist in improving their farm operations and provide other services that Wellington does not provide. Mayor Gerwig said it was the farm owner's choice which agency to go to. Mr. O'Dell replied affirmatively and explained staff was able to indicate the Village of Wellington Page 5 Village Council Workshop Action Summary - Final May 8, 2017 differences between FDACS and Wellington. There were no changes recommended. 4. WORKSHOP None. 5. ATTORNEY'S COMMENTS Ms. Cohen said she emailed Council the order from the circuit court regarding the enforcement case. She said the court ruled in favor of Wellington obtaining a temporary injunction since Palm Beach Polo did not rise to the level of being contemptuous. She noted the order was good for Wellington and encouraged Council to review the information. She provided an overview of the results of the order: 1) Clarification of the obligation to preserve and enhance Big Blue was an ongoing obligation that did not end once partial compliance occurred in 2004; 2) Palm Beach Polo's responsibility to remove exotics; and 3) The change in the pumping schedule in 2011 did not incur exotics to flourish. Mayor Gerwig asked if there were other matters pending. Ms. Cohen explained there was a pending matter which she would discuss with each Council member privately and noted the calendar call was upcoming during the month of May. Ms. Cohen said she provided Council with the requested memo regarding the conversion therapy ban. She was not sure of Council's direction moving forward. Mr. Schofield said the conversion therapy ban could be placed on the agenda for the last meeting of the month. Mayor Gerwig said several residents have asked when the item would be on the agenda and she would provide them with the date. Ms. Cohen said she received inquiries regarding the PACE program from Wellington residents inquiring if they were able to participate in the county's program. She noted the program was not fully implemented and there was a website that the residents could visit. She noted once the program was fully implemented, all of the residents within Palm Beach County would be able to participate unless their municipality had adopted their own ordinance. Mayor Gerwig said the residents needed to understand the long term repercussions that go with the program. Ms. Cohen said the program was a county wide program and not a Wellington program. Mayor Gerwig said in the interest of protecting the Wellington residents from a false presentation by a vendor or salesperson, the overview that was provided in the past, should be available for the residents to review. Vice Mayor McGovern said a link could be placed on the Village's website directing the residents to the county's website that has the information. Ms. Cohen said that was a very good idea and was appropriate. Village of Wellington Page 6 Village Council Workshop Action Summary - Final May 8, 2017 6. MANAGER COMMENTS Mr. Schofield introduced Mr. Barnes. Mr. Barnes provided an update on the mosquito spraying program: 1) Spray year round on a regular basis. He said the maps were located on the Village's website and indicates the different spraying zones; 2) Complaints about being in a no spray zone or being accidentally sprayed by the truck. He noted Wellington does maintain a "Do Not Spray" list and the addresses were programmed into the GPS system which monitors all the areas being sprayed. The sprayer stops before reaching any of the addresses on the "Do Not Spray" list; 3) Start spraying later at night in order to minimize interaction with people walking their dogs, walking or jogging. He said after researching the issue, staff found the most effective spraying time needed to be done earlier when the mosquitoes were out, which was close to the dusk hours. He indicated the fogging process works best when the mosquitoes come in contact with the droplets in the air and staff would continue with the current schedule; and 4) Update the "Do Not Spray" list locations. In larger neighborhoods, the residents would be notified via door hangers that due to "Do Not Spray" locations located within their neighborhood, their street may not receive the same amount of spraying coverage. Vice Mayor McGovern asked for the earlier time for the spraying. Mr. Barnes said the general time frame for spraying was between 8:30P.M. and 9:00P.M. Mr. Barnes explained PBC applies their truck fogging at 20% of the active ingredient and Wellington applies at the rate of 4%. Mayor Gerwig asked if the amount was sufficient. Mr. Barnes said the amount was sufficient because a past vendor who was very reputable used the same amount and studies indicate that was the correct rate of application for residential spraying especially since some of the areas have a large amount of livestock. Mr. Schofield said Wellington sprays more frequently than PBC. Mayor Gerwig said the Governor declared a State of Emergency with the Zika Virus and the Opioid Epidemic and was sure the Health Department could provide a presentation, cards and flyers as Councilman Napoleone informs on his video. Mr. Barnes said the information was very important because Wellington only sprays along the rights-of-ways but not on the drive ways or back yards. He noted controlling mosquitoes within the back yards was very important since those areas were usually the breeding grounds due to standing water. He noted Wellington adds larvicide to the catch basins to target the early larval life stages of the mosquitoes. Mayor Gerwig asked how often does she need to change her bird feeder and if there was a larvicide available that does not harm the birds. Mr. Barnes said he did not have the answer to her questions but he would have staff from the Environmental Department provide her with answers to her questions. Vice Mayor McGovern asked if Wellington sprays in gated communities. Mr. Village of Wellington Page 7 Village Council Workshop Action Summary - Final May 8, 2017 Barnes replied affirmatively. Vice Mayor McGovern asked for the instructions if residents wanted to be placed on the "Do Not Spray" list and how would that affect his neighbors. Mr. Barnes said he was not a fan of the "Do Not Spray" list because it affects your neighbors and the majority of the resident calls were to ensure that Wellington continues to spray and enhance the spraying. He explained to be placed on the "Do Not Spray" list, the resident fills out a form which was located on the website and once the completed form was received, staff loads the address into the GPS system. He noted the neighbors across the street and adjacent to the property on the "Do Not Spray" list would be affected. Councilwoman Siskind asked if the requester needed to list a medical reason or condition in order to be added to the "Do Not Spray" list. Mr. Barnes said no medical reason was needed and the residents make the request for different reasons. Mayor Gerwig said many of the residents were on the "Do Not Spray" list due to having exotic animals, birds, rabbits and other outside animals. She said the Health Department could provide additional informational material which included weblinks for the Wellington residents. Mr. Barnes said the links could be placed on the Village's website. Mayor Gerwig agreed to have staff place the information on the Village's website. Mr. Schofield stated during the prior year when the Zika virus numbers were multiplying quickly, Wellington increased and enhanced the number of sprays but once the increase stopped, staff returned to the normal amount of sprays. In the future, if an increase of sprays was needed, he would communicate the information to Council before enhancing the number of mosquito sprays. COUNCIL COMMENTS Mayor Gerwig said some of the telemetry poles have vines on them and asked if the vines interfere with the service. Mr. Barnes explained some of the poles were combined with FPL and he would contact them to assist in the removal of the vines. He noted the poles were for wifi and not telemetry but having the vines on the lines matters greatly because the appearance was not acceptable. Mr. Schofield said the IT Department performed very well with the goggle.docs virus that hit Wellington last week and only one computer was affected. Currently, there were no dangers within the system. Mayor Gerwig said she was notified earlier that Wellington High and Palm Beach Central baseball teams both won their District meets and would be moving on to the Statewide competitions. They would be hosting games tomorrow and she asked to have the information posted on the website in order for the younger kids to be aware of what the older kids were doing. She noted Palm Beach Central's game starts at 4:30 p.m. and Wellington High School's game starts at 7:00 p.m. She noted the fields at Palm Beach Central do not light up at night which was the reason for the early games which could be difficult at times. Mr. Barnes said he was not sure what the reason was for Palm Beach Central not lighting the fields during the initial construction of the school. Mr. Schofield said under the interlocal agreement the schools could use a lighted Wellington field. Mayor Gerwig asked staff to contact Palm Beach Central and advise them of the lighted field that they could use. Mayor Gerwig said the Wellington Wild Girls' Baseball team won the Walk On The Wild Side tournament and commended staff on the appearance of the fields especially after the large amount of rainfall that fell on Friday. She said everyone in attendance was very impressed with the fields and the entire facility. She encouraged girls to continue attending the girls baseball games. Mr. Schofield reminded Council that Congresswoman Lois Frankel would be in attendance tonight at 7:00 p.m. Mayor Gerwig encouraged everyone to attend. Councilwoman Siskind asked about the highlights from SunFest 2017. Vice Mayor McGovern congratulated his wife and the Wellington Wolverine Marching Band for a successful fundraising effort at SunFest 2017 and said it was a very good event. 8.
