A. 21-4429 RESOLUTIONS ADOPTING PRELIMINARY TRIM RATES FOR WELLINGTON, THE ACME IMPROVEMENT DISTRICT AND THE SADDLE TRAIL PARK NEIGHBORHOOD IMPROVEMENT DISTRICT AS FOLLOWS: A. RESOLUTION NO. Mr. Barnes introduced the item. He said that this is the Approval of the Following Resolutions Setting TRIM Rates for Ad Valorem Taxes and Non-ad Valorem Assessments for Solid Waste and Recycling in Wellington, Acme Improvement District and Saddle Trail Park South Neighborhood Improvement District (NID) Debt as Required by Law: A. RESOLUTION NO. R2021-35: The Ad Valorem Millage Rate Proposed at 2.47 Mills (no change from the current year rate, and 4.53% above the rollback rate of 2.36 mills). B. RESOLUTION NO. AC2021-09: Non-ad valorem Assessments for the Acme Improvement District Proposed at $230.00 for All Units Except the Palm Beach Polo Units with the Proposed Assessment Rate of $249.00. C. RESOLUTION NO. R2021-36: Non-ad Valorem Assessment Rates for the Saddle Trail Neighborhood Improvement District for TRIM Purposes According to the Attached Assessment Roll. There was consensus to wait to hear the presentation at the next meeting. B. 21-4539 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF JUNE 22, 2021 Mr. Barnes introduced the item. He said that this is the Council Approval of the Minutes of the Regular Wellington Council Meeting of June 22, 2021. He requested that if there were any updates to get those to us accordingly. C. 21-4407 AUTHORIZATION TO RENEW CONTRACTS FOR LANDSCAPE MAINTENANCE SERVICES FOR FACILITIES, PRIMARY ROADS, UTILITY SITES, CANALS AND EQUESTRIAN TRAILS Mr. Barnes introduced the item. He said that this is the Authorization to Renew Contracts for Landscape Maintenance Services for Facilities, Primary Roads, Utility Sites, Canals and Equestrian Trails for $740,232 Annually. Mayor Gerwig asked if they were able to increase their prices and they chose not to. Mr. De La Vega stated that there were no increases were requested and they were eligible for it. D. 21-4409 AUTHORIZATION TO AWARD A CONTRACT FOR THE RENOVATION OF FOUR FOOTBALL PRESS BOXES AT VILLAGE PARK Mr. Barnes introduced the item. He said that this is the Authorization to Award a Contract for the Renovation of Four Football Press Boxes at Village Park Project to E & F Florida Enterprises, Inc. DBA Creative Contracting Group in the Amount of $58,600. Mr. De La Vega explained the item. E. 21-4411 AUTHORIZATION TO CONTINUE UTILIZING AN EXISTING AGREEMENT WITH KRONOS SAASHR, INC. FOR SUPPORT, MAINTENANCE, LICENSES AND RENTAL OF THE VILLAGE’S TIMEKEEPING AND PERFORMANCE REVIEW SYSTEM Mr. Barnes introduced the item. He said that this is the Authorization to Continue Utilizing an Existing Contract with Kronos Saashr, Inc. for Support, Maintenance, Licenses and Rental of the Village's Timekeeping and Performance Review Systems, at a Cost of $35,485 for Fiscal Year 2022. Ms. Quickel explained the item. Vice Mayor McGovern stated that the cost went down $7,000 annually. He asked if that is reflected in the $35,485 price. Ms. Quickel said yes. F. 21-4556 AN AMENDMENT TO THE RESTRICTIVE COVENANT BETWEEN W&W EQUESTRIAN CLUB, LLC AND WELLINGTON FOR WINDING TRAILS Mr. Barnes introduced the item. He said that this is the Approval of an Amendment to the Restrictive Covenant for Winding Trails, Specifically Section 4, to Allow Adjacent Lots 8 and 9 Held Under Unity of Title with Common Ownership to Aggregate the Sum of Each Lot's Maximum Horse Stall and Stall Rental Limitation. He mentioned that a perspective buyer is looking at combining two parcels within Winding Trails. There is Village of Wellington Page 3 Village Council Workshop Action Summary - Final July 12, 2021 some language that necessitated looking at the actual restrictive covenant as far as for the limitation of ten stalls per lot. With what they were proposing to do and before they got too far along in the process, they wanted to ensure that they would be able to affect their ultimate proposed project with the proposed twenty stalls with the aggregate of two lots with the unity of title. Ms. Cohen explained the item. She said that with the request of the Vice Mayor, she had added some additional language to the restrictive covenant. The added part indicated that not withstanding the exemptions of 604.50, all lots within the community would comply with Wellington's codes. This was sent to the Ward's attorney and Ms. Ward would not agree to that. Ms. Ward has since asked that this item be pulled from the agenda. Councilman Napoleone asked where that proposed language was to go and what exactly did it say. Ms. Cohen stated that she did not have the revised version with her. Mayor Gerwig stated that she had the revised version and gave to Councilman Napoleone to review. Vice Mayor McGovern explained his reasoning for requesting the additional language. Councilman Drahos stated that he agreed with that. Mr. Barnes explained how this item came to be. Ms. Cohen explained the process on why the change was needed to be made for their request. Mayor Gerwig stated that since the applicant has requested it to be pulled, they will do it and leave everything as is. G. 20-3962 RESOLUTION NO. R2021-07 (WELLINGTON SENIORS CLUB AGREEMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A CONTRACT FOR SENIOR CITIZENS SERVICES BETWEEN WELLINGTON AND THE WELLINGTON SENIORS CLUB, Village of Wellington Page 4 Village Council Workshop Action Summary - Final July 12, 2021 INC.; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of the Annual Agreement Between Wellington and the Wellington Seniors Club, Inc. for FY 2021. Mr. De La Vega explained the item. Mayor Gerwig asked if the money they do not use stays in the General Fund. Mr. De La Vega stated that was correct. Vice Mayor McGovern asked if the $27,827 is what they have already spent and submitted receipts for. Mr. De La Vega stated that was correct and that almost $22,000 of it was for food. H. 21-4536 ORDINANCE NO. 2021-09 (FIREWORKS PROHIBITED WITHIN EQUESTRIAN PRESERVE AREA) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 36 ENTITLED OFFENSES AND MISCELLANEOUS PROVISIONS TO CREATE A NEW ARTICLE 6 ENTITLED FIREWORKS WITHIN THE EQUESTRIAN PRESERVE AREA; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval on First Reading of Ordinance No. 2021-09 Fireworks Prohibited in Equestrian Preserve Area. Ms. Cohen explained the item. Mayor Gerwig asked Mr. Barnes about damage caused by a fireworks display in town. Mr. Barnes stated that he would have Mr. Wagner's team look at that. Mr. O'Dell indicated that the damage was from the accident where a car had caught on fire in that area that same evening. Vice Mayor McGovern asked Ms. Cohen about the ordinance, page 222, Village of Wellington Page 5 Village Council Workshop Action Summary - Final July 12, 2021 line 6, where it discusses public displays approved by Wellington's police captain and fire chief. He asked if it should say sheriff or was she just taking it directly out of the statute. Ms. Cohen stated that it was directly out of the local bill and that the statute does provide police captain and fire chief, so to be consistent that is what was used. She said that technically, he is our police captain. Mayor Gerwig asked if we will need a second reading on this. Ms. Cohen stated that they will need a second reading. Mayor Gerwig asked if we were still able to enforce it without this. Ms. Cohen said yes. She said that she went back and looked at the language of the bill and it said it was effective immediately and so we were able to enforce it immediately. I. 21-4544 RESOLUTION NO. R2021-33 (CDBG FY 2020/2021 BUDGET AMENDMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND ADOPTING AN AMENDMENT TO THE FY 2020/2021 ANNUAL ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CARES ACT FUNDING, AUTHORIZING THE VILLAGE MANAGER TO FORWARD THE AMENDMENT TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of Resolution No. R2021-33 Approving and Adopting Amendment to the FY 2020/2021 CDBG Annual Action Plan Prior to Obligating or Expending CDBG Funds for Previously Unidentified Activities. As Such, Wellington is Required to Submit an Amendment to United States Department of Housing and Urban Development. The Village of Wellington Proposes to Amend 2020/2021 CDBG Annual Action Plan Budget as Follows: Activities Proposed to Receive a Decrease in CDBG Entitlement Funding: Emergency Rent and Utility Assistance. Mr. De La Vega explained the item. Mayor Gerwig asked why was it not required and why did we not use up these funds. She also asked if it was because the County funding was sufficient. Mr. O'Dell stated that it was a surprise that we have not been able to get Village of Wellington Page 6 Village Council Workshop Action Summary - Final July 12, 2021 more participation from our local residents. He said that what they found was that because the County had a lot more money and more flexibility with their granting of dollars, that many were able to utilize that. They also found that residents were looking to the County and also to Wellington to provide the same funding. Mayor Gerwig stated that would be a violation of the Cares Act. Mr. O'Dell stated that was correct. He said that they have also found that many of the landlords are not willing to participate at this point either. Vice Mayor McGovern asked Mr. O'Dell to explain what he means when he said that the landlords are refusing to participate. Mr. O'Dell explained that Wellington has asked them to be a participate in the program where they take 75% of the rent due and forego any late fees or any other additional fees and some are refusing to do that. Mayor Gerwig asked if the County allow for 100% of that rent. Mr. O'Dell stated that in some cases they do and the State has some cases where they have allowed for 100% of the rent. He said that some are even allowing them to go forward in time, which our program does not allow. Vice Mayor McGovern asked if our program does not allow it because that was the state of the regulation when we created the program. Mr. O'Dell stated yes, that was the way the program was set up. We paid for back rent, not going forward. The State is now offering that you can go forward in rent dollars for three months. Vice Mayor McGovern asked if we changed ours to mirror the State or the County, do we feel that there would still be a need, specific to our community, separate from the dollars available with the County or State. Mr. O'Dell stated possibly. He said that he needed make one accounting adjustment to this, as in the last 30 days, they have allocated about $10,000 in both rental assistance and electricity assistance. He said that they also have three applicants that if their landlords participate with this, they have another possibility of issuing another $10,000. Vice Mayor McGovern asked if that will change these numbers. Mr. O'Dell stated it would be just slightly by close to $20,000. J. 21-4543 RESOLUTION NO. R2021-34 (CDBG ACTION PLAN) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND ADOPTING THE FY 2021/2022 ANNUAL ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM; AUTHORIZING THE VILLAGE MANAGER TO FORWARD THE FY 2021/2022 ANNUAL ACTION PLAN TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of Resolution No. R2021-34 Approving and Adopting a FY 2021/2022 Action Plan for the Community Development Block Grant Program. Mr. De La Vega explained the item. Mayor Gerwig asked how this is different from last year. Mr. Fackrell stated that the primary difference is that last year half of what we would normally allocate for housing rehab, we allocated it towards rental assistance. He said that this year, we are allocating more towards housing rehab. Last year, they lifted the cap on public services so we could operate public services at a level above the 15% cap. This year, we are back at the 15% cap on public services. K. 21-4555 AUTHORIZATION TO EXECUTE A LEASE AGREEMENT BETWEEN ACME IMPROVEMENT DISTRICT AND BASORE FAMILY FARMS, LLC. FOR THE K-PARK SITE Mr. Barnes introduced the item. He said that this is the Authorization to Execute a Lease Agreement Between ACME Improvement District and Basore Family Farms, LLC, for the K-Park Site in the Amount of $190,000. He said that the Basore's have requested that this item be pulled from the agenda so that they may have time to get with their newly retained counsel. Vice Mayor McGovern stated that a lot more people are finding out about this and he feels it should be discussed with not only the legal and financial issues, but the concerns about traffic, the usage of the secondary entrance by the church, potential noise, and the language that is used throughout the contract. He mentioned that words such as Village of Wellington Page 8 Village Council Workshop Action Summary - Final July 12, 2021 "subject to change" need to be reviewed as to what they really mean in the terms of their events. Ms. Cohen stated that they have a meeting with them this week and these items will also be discussed. 4. WORKSHOP A. 21-4561 DISCUSSION REGARDING SPEEDING STUDIES Mr. Barnes introduced the item. He said that this workshop item would be discussed by Mr. Reinsvold. The discussion is regarding the traffic circulation issues around the Village. Mr. Reinsvold explained the item regarding the Wellington Trace Speed Study Summary. He presented a powerpoint to the Council. Mayor Gerwig asked what were the highest speeds. Mr. Reinsvold stated that he would have to go back through and look to see the highest, but that they were seeing speeds as high as 65-70 mph. He said that after the meeting he would let her know what the highest was. Councilman Drahos asked how the number of trips relate to the corner of Big Blue Trace and Wellington Trace. Mr. Reinsvold stated that he could not say off the top of his head. He said that it would definitely be less as that is a busier intersection and would address some of it further on in the presentation. Mayor Gerwig asked what a high visibility speed limit sign is. Mr. Reinsvold informed them that it is the flashing speed indicator sign. Mayor Gerwig asked if they are telling the driver what speed they are going. Mr. Reinsvold said yes. The sign has the posted speed limit and also tells the driver how fast they were going. He said these particular signs will flash red and blue. These also collect the data that can be retrieved every couple of months. Mr. Adam Kerr, Kimley Horn & Associates Traffic Consultant, presented Village of Wellington Page 9 Village Council Workshop Action Summary - Final July 12, 2021 his portion of the study to the Council. Vice Mayor McGovern asked when Mr. Kerr mentioned "a couple dozen a day", was he referring to a particular time or was it more scattered throughout the day. Mr. Kerr stated that it was throughout the day. He said that the high speed ones were pretty random. Vice Mayor McGovern asked if he felt that it could not be done with two of the three recommendations. Mr. Kerr said that in a situation like this, the more, the better. Mr. Reinsvold stated that we are in the process of doing culvert work there now and they are in the process of getting a quote from the contractor now to see how much it would cost to add on that median and for the "circle #1" for now. He said that later on we can budget for the other two. In the mean time, it will be a good test to see how that it is going with just those. Councilman Napoleone asked if this was the only 25 mph stretch of road in Wellington that is not in a community or in the Equestrian Preserve area. Mr. Reinsvold stated that he believed so. Councilwoman Siskind asked why was May picked as the "Study Date" because she thought that in the season, they would see increased traffic and an increased average of speed. Mr. Reinsvold stated that it was just more of a "getting it done" time period since they were getting multiple calls regarding this issue. Mr. Barnes explained that the expectations of the look of the medians will not be what we are used to. He said that they will bring the contract back to Council once it is ready. Vice Mayor McGovern asked if once people get used to this new set up and learn how to navigate it, could it go back to where it does not solve the speeding problem. Mr. Kerr stated that he believes it certainly will help the problem. He said that he believes it would be very difficult to navigate through one of these at 50-60 mph. Mr. Reinsvold gave the Council a presentation on the Wellington Trace/Big Blue Trace Intersection (Protected Left Turn Study). Mayor Gerwig asked for an explanation of what a back plate is. Mr. Reinsvold explained that it is high visibility back plate that get posted to the signal heads. It is framing the signal. Mayor Gerwig asked if that is so you see more contrast. Mr. Reinsvold stated that you would. At night, you would see them better. Councilman Drahos asked what a protected left turn is. Mayor Gerwig explained that it when it has the green arrow. It takes more pavement and longer turn cues. Councilman Napoleone asked based on what is being recommended, were most of the accidents based on left turn movements. Mr. Reinsvold said yes. Mayor Gerwig asked what traffic signal is up there now. Mr. Reinsvold indicated that it was the picture on the left of his presentation, which is the protected/permissive left. Councilman Napoleone asked if all four movements would be protected left. Mr. Reinsvold said yes. Councilman Drahos mentioned that there are a few religious centers in that area. He asked if it will potentially slow things down a bit, how do they anticipate this will operate on a Sunday. Mr. Reinsvold said that was a good question, and unfortunately, did not have an answer for him. He said that they will have to look into that and get him an answer. Councilman Drahos asked if he wanted to go westbound, he is looking at a minute wait. Village of Wellington Page 11 Village Council Workshop Action Summary - Final July 12, 2021 Mr. Reinsvold said that it is an increased time from 17.4 seconds to 39.6 seconds. Councilman Napoleone asked if we know how many cars can be stacked up at each turn lane movement. Mr. Reinsvold said that we do. Councilman Napoleone asked if the light would be long enough to clear the whole stack out or would there be some that would have to wait for 2 left turn signals. Mr. Reinsvold stated that the intent is to empty out the stacked up lane. Vice Mayor McGovern asked if they should not have to wait more than one cycle. Mr. Reinsvold stated that they should not have to. Councilman Napoleone asked if we know if a flashing yellow arrow would be enough rather than a straight green arrow, go when you can. Mr. Reinsvold stated that we have not looked into that. Mr. Reinsvold gave the Council the presentation on Binks Forest Speed Study Summary (Between Southern Boulevard and Bent Creek Road). Vice Mayor McGovern asked how far from Southern does the school zone start. Mr. Reinsvold pointed out where the school was on the presentation map. Vice Mayor McGovern asked if additional school zone signage be helpful. Mr. Reinsvold stated that what is out there now meets the standard. It has the flashers. He said that it is a matter of the fact that it is being ignored. He said that they could add another sign to the other side that has that also has the flashers. Mr Barnes stated that they will be including this area in PBSO's start plan for the beginning of school as well as for targeted enforcement.
