REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the August 13, 2024 Regular Council Meeting for review. A. 24-6626 PRESENTATION OF WELLINGTON’S VISION ZERO HERO AWARD TO DEPUTY SHERIFF JEFFREY TASCHNER Mr. Barnes introduced the item. He stated that this was the Presentation of Wellington's Vision Zero Hero Award to Deputy Sheriff Jeffrey Taschner. He noted that Ms. Coates will conduct the presentation. B. 24-6631 RECOGNITION OF THE WELLINGTON HIGH SCHOOL BOYS ALL-AMERICAN SWIM TEAM Mr. Barnes introduced the item. He stated that this was the Recognition of the Wellington High School Boys All-American Swim Team. He said that Mr. Harris and Mr. Juckett will present the item. C. 24-6519 RESOLUTIONS ADOPTING THE FY 2024-2025 BUDGETS AND ASSESSMENT RATES FOR THE ACME IMPROVEMENT DISTRICT, WELLINGTON SOLID WASTE COLLECTION AND SADDLE TRAIL PARK NEIGHBORHOOD IMPROVEMENT DISTRICT; AND A RESOLUTION ADOPTING THE FY 2024-2025 BUDGET FOR THE WATER AND WASTEWATER UTILITY I. Mr. Barnes introduced the item. He stated that this was the Resolutions Adopting the FY 2024-2025 Budgets and Assessment Rates for the Acme Improvement District, Wellington Solid Waste Collection and Saddle Trail Park Neighborhood Improvement District; and A Resolution Adopting the FY 2024-2025 Budget For The Water and Wastewater Utility. He said that a detailed presentation is scheduled for tomorrow evening. Vice Mayor McGovern asked if this is the First Reading. Ms. Quickel answered a question from Vice Mayor McGovern. She noted that the Millage Budgets for governmental will be heard at the September 3, 2024 and September 19, 2024 Village Council meetings. Mayor Napoleone inquired about the budgeting documents for the binder. Ms. Quickel responded to Mayor Napoleone's inquiry. D. 24-6661 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF Village of Wellington Page 2 Village Council Workshop Action Summary - Final August 12, 2024 JUNE 11, 2024, JUNE 25, 2024 AND JULY 16, 2024 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meeting of June 11, 2024, June 25, 2024 and July 16, 2024. He asked Council to provide comments, if any, to the Clerk's Office. E. 24-6633 AUTHORIZATION TO RENEW AN EXISTING AGREEMENT FOR LOBBYING SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Renew an Existing Agreement for Lobbying Services. Mr. De La Vega explained the item. He noted that the contract went from $75,000 to $50,000 in Fiscal Year 2021. Mayor Napoleone commented on the amount and the service. Vice Mayor McGovern commented about the budgeted items approved by the Council but were vetoed by the governor. He said that we need to discuss this with our lobbyists to strategize what we could have done differently. He commented on the importance for Mr. Coker and Mr. Watson to meet Councilwoman Antuña and Councilwoman Silvestri. Mr. Barnes responded to comments from Vice Mayor McGovern. Mayor Napoleone said that the Village should set goals before the session in advance. There was discussion regarding having a legislative workshop agenda and the introduction for Mr. Coker and Mr. Watson. F. 24-6641 AUTHORIZATION TO UTILIZE A PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS CONTRACT FOR THE FIELD OF DREAMS PARK RENOVATION PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Utilize A Palm Beach County Board of County Commissioners Contract for the Field of Dreams Park Renovation Project. Mr. De La Vega explained the item. He noted that the amount is for $312,755.67, which is partially funded by the Florida Recreational Development Assistance Grant in the amount of $50,000. Mayor Napoleone asked if this is a complete renovation of the park. Mr. De La Vega answered a question from Mayor Napoleone. G. 24-6653 AUTHORIZATION TO AMEND THE ANNUAL APPROVED CONTRACT FOR PLANNING, ZONING AND BUILDING INSPECTION SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Amend the Annual Approved Contract for Planning, Zoning and Building Inspection Services. Mr. De La Vega explained the item. He said that the Building Department's outside operation expenditures have recently increased due to the retirement of two inspectors. He said that staff is recommending an additional $228,940.00 with C.A.P. Government, Inc for Planning, Zoning and Building Inspection Services. Vice Mayor McGovern asked who have we have lost; the number of people we lost and what is the timeline to replace them. Mr. Stilling answered questions from Vice Mayor Napoleone. There was discussion regarding the additional amount being requested, cost effectiveness and all the disciplines covered. Vice Mayor McGovern commented on the cost. Mr. Barnes responded to Vice Mayor McGovern's comment. Mayor Napoleone asked if this was an "up to" amount. Mr. Barnes answered a question from Mayor Napoleone. H. 24-6606 BINKS ELEMENTARY SIGN – SIGNAGE AND MAINTENANCE EASEMENT AGREEMENT Mr. Barnes introduced the item. He stated that this was the Binks Elementary Sign- Signage and Maintenance Easement Agreement. Mr. Stillings explained the item. He noted that the policy was adopted by the Council in 2023 regarding signs within public right-of-ways. He said that he is glad that we are finally getting the sign. Vice Mayor McGovern commented on the School Board paying for the sign and the Village giving them the approval to use it. Mr. Stillings responded to Vice Mayor McGovern's comment. Mr. Barnes commented on the timeline. I. 24-6654 AUTHORIZATION TO UTILIZE A SEMINOLE COUNTY, FLORIDA CONTRACT, WITH HYDROMAX USA, LLC, AS A BASIS FOR PRICING, FOR FIRE HYDRANT TESTING AND MAINTENANCE SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Utilize a Seminole County, Florida Contract, with Hydromax USA, LLC, As a Basis for Pricing, for Fire Hydrant Testing and Maintenance Services. Ms. Panse explained the item. She said that there are 2,300 fire hydrants in the system. She noted that the funds for this work are included in the Operating Budget, the request is for $160,000 plus about $17,000 in owner contingency. Mayor Napoleone asked if all of the hydrants are being done in one year. Ms. Panse answered a question from Mayor Napoleone. Vice Mayor McGovern asked if hydrants are done one year on and one year off. Ms. Panse answered a question from Vice Mayor McGovern. J. 24-6655 AUTHORIZATION TO RENEW MULTIPLE EXISTING CONTRACTS FOR UTILITY PROCESS CONTROL ANNUAL MAINTENANCE Mr. Barnes introduced the item. He stated that this is for the Authorization to Renew Multiple Existing Contracts for Utility Process Control Annual Maintenance. Ms. Panse explained the item. She noted that a solicitation was done last year for on-call contracts for three vendors. She noted that the $115,000 had been planned for in the operating budget. Ms. Panse responded to Mayor Napoleone's comment. K. 24-6676 AUTHORIZATION TO CONTINUE UTILIZING A CONSULTANT TO PROVIDE GIS SUPPORT, DEVELOPMENT AND INTEGRATION Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing a Consultant to Provide GIS Support, Development and Integration. Ms. Quickel explained the item. She said that this is included in the annual budget for GIS. Mayor Napoleone asked if the Village is happy with the company. Ms. Quickel answered a question from Mayor Napoleone. L. 24-6625 RESOLUTION NO. R2024-37 (FIRST AMENDMENT TO THE AMENDED AND RESTATED INTERLOCAL AGREEMENT BETWEEN WELLINGTON AND PALM BEACH COUNTY FOR EMERGENCY OPERATIONS INTEROPERABILITY) A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL AUTHORIZING THE MAYOR AND CLERK TO EXECUTE THE FIRST AMENDMENT TO THE AMENDED AND RESTATED INTERLOCAL AGREEMENT BETWEEN WELLINGTON AND PALM BEACH COUNTY FOR EMERGENCY OPERATIONS INTEROPERABILITY THROUGH COUNTYWIDE COMMUNICATION AMONG PUBLIC SAFETY AND GENERAL GOVERNMENTAL AGENCIES; AND PROVIDING AN EFFECTIVE DATE. He stated that this was the Resolution No. R2024-37 (First Amendment to the Amended and Restated Interlocal Agreement between Wellington and Palm Beach County for Emergency Operations Interoperability. Ms. Coates explained the item. She noted that the Village has had this agreement since 2002. She said that this agreement allows the Village to direct connect to the County Emergency Operations Center (EOC). M. 24-6665 RESOLUTION NO. N. 24-6650 ORDINANCE NO. 2024-06 (CELL TOWER ZONING TEXT AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING ARTICLE 6 OF WELLINGTON’S LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT TO MODIFY SECTION 6.2.2.G. Mr. Barnes introduced the item. He stated that this was the Ordinance No. 2024-08 (Public Notice Requirements Zoning Text Amendment). Mr. Stillings explained the item. He said that this is just a consistency change to the LDR to incorporate the same provisions or reference the provisions that were provided for in the Code of Ordinances. Mayor Napoleone commented on the clean up of the LDR to make it consistent to what the Council approved. Ms. Bausch responded to Mayor Napoleone's comment. P. 24-6491 RESOLUTION NO. R2024-43 (ADOPTION OF THE WELLINGTON VISION ZERO ACTION PLAN) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND ADOPTING THE VISION ZERO ACTION PLAN TO ELIMINATE TRAFFIC-RELATED FATALITIES AND SERIOUS INJURIES WITH THE CITY; AND PROVIDING AN EFFECTIVE DATE. Mr.Barnes introduced the item. He stated that this was the Resolution No. R2024-43 (Adoption of the Wellington Vision Zero Action Plan). Mr. Reinsvold explained the item. He noted that there will be a presentation at tomorrow night's meeting. Q. 24-6598 RESOLUTION NO. R2024-31 (INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF WELLINGTON AND THE SCHOOL BOARD OF PALM BEACH COUNTY FOR THE MUTUAL USE OF RECREATIONAL FACILITIES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF WELLINGTON AND THE SCHOOL BOARD OF PALM BEACH COUNTY FOR THE MUTUAL USE OF RECREATIONAL FACILITIES; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution No. R2024-31 (Interlocal Agreement Between the Village of Wellington and the School Board of Palm Beach County for the Mutual Use of Recreational Facilities). Mr. De La Vega explained the item. He noted that the Village initiated discussions with the Palm Beach County School District to make revisions that would be beneficial to the Village. He discussed the changes listed on page 270 under Section 3E; page 277 under Section 3F; page 281 Section 28; and page 282 under Section 33 and 36. Village of Wellington Page 9 Village Council Workshop Action Summary - Final August 12, 2024 Vice Mayor McGovern inquired about the name listed on page 282. Mr. De La Vega and Mr. Barnes responded to Vice Mayor McGovern's inquiry. Mr. De La Vega noted the list of independent contractors listed on page 285 that would be utilizing the recreation facilities and the usage by the Palm Beach County School District. There was discussion regarding the partnership and usage. R. 24-6632 DISCUSSION AND DIRECTION CONCERNING 80-FOOT DRAINAGE AREA REFLECTED ON THE PALM BEACH LITTLE RANCHES EAST OF WELLINGTON PLAT Mr. Barnes introduced the item. He stated that this was the Discussion and Direction Concerning 80-Foot Drainage Area Reflected on the Palm Beach Little Ranches East of Wellington Plat. Ms. Bausch explained the item. She noted that it was brought to Legal's attention in connection with a Code Enforcement action that Acme has a fee simple interest in the property as opposed to an easement. She mentioned the extensive discussion during the workshop and the direction given by the Council to have this placed on a agenda. She said that Legal is looking for direction as to whether the Council would like Acme to assert its ownership and interest in the property. She said that Legal would notify the property owners and property appraiser. She said if it is challenged, there is potential to have to bring a lawsuit to quiet title. Mayor Naploeone asked how much discussion has been had by staff with the property owners. Ms. Bausch answered a question from Mayor Napoleone. She mentioned the discussions Legal had with Ms. Katie Edwards-Walpole on behalf of IDA Farm and Harry Knopp. She said that there are nine (9) properties in the area and seven (7) of the properties have encumbrances on them in the drainage area based on her understanding with Code Enforcement today. Ms. Bausch said that she knows that Code Enforcement has had conversations with the property owners. They know that there are code actions coming, but that was placed on hold and those are not actively being pursued because Legal is looking for direction from the Council on how to proceed. Vice Mayor McGovern asked if the Council would be hearing from anyone else on this item tomorrow night other than Ms. Cohen. Mayor Napoleone asked if this is something that the Council needs to address tomorrow. He asked if this would be more productive if staff and Legal sat down and sought if the Village can work out a resolution, then bring it back before the Council. Vice Mayor McGovern commented how do you work out a resolution between whether we own it or not. There was discussion regarding the two issues and next steps. Mayor Napoleone commented that we should keep this item on the agenda for tomorrow. Mr. Barnes and Ms. Bausch responded to Mayor Napoleone's comment. 4. WORKSHOP A. 24-6678 DISCOVER THE PALM BEACHES TOURISM UPDATE Mr. Barnes stated that the Workshop Item 4A will be heard prior to the review of the Regular Agenda. He said that Sergio Piedra, Director of Community Engagement & Advocacy and Milton Segarra, President & CEO of Discover The Palm Beaches along with their team were present to provide an update. Mr. Piedra provided a brief overview of Discover The Palm Beaches. He presented a PowerPoint Presentation titled "What's Happening In Tourism The Village of Wellington". Gustav Weibull, Vice President of Research/Discover The Palm Beaches, discussed the Visitation and Performance Data. Mr. Segarra stated that it is a priority for him to connect with the Council and Village residents. He discussed Building on Success, Strategic Approach. He said that they need to hear from the Village and stakeholders to charter what is going to be the future of this destination. He thanked the Council for allowing the team to present and said that they look forward to coming here frequently to share the updates. ATTORNEY'S COMMENTS Ms. Bausch reminded the Council about the Shade Session scheduled for tomorrow at 6:30 p.m. regarding the PFAS matter. 6. MANAGER COMMENTS Mr. Barnes said that there will be a presentation tomorrow for the Citizens on Patrol (COP) beginning at 5:30 pm. He said that representatives will be coming for Deputy Taschners's presentation as Vision Zero Hero. He noted that the Village has an active and involved COP group. Mr. Barnes noted that Major Eric Coleman would attend the presentation. COUNCIL COMMENTS Vice Mayor McGovern asked for an update on the Village Walk meeting held last Thursday regarding the sound wall issue. Mr. Barnes provided a brief update of the meeting. He noted that he and Representative Katherine Waldron attended the meeting where the folks discussed their issues and concerns. He said the meeting that occurred last Thursday was another Homeowners Association (HOA) sponsored meeting with the residents and representatives of the Florida Turnpike Enterprise, their Director of Transportation and Development, Manager and Community Outreach Staff, Mr. Reinsvold, Representative Waldron, Senator Lori Berman, and Palm Beach County Commissioner Gregg Weiss. He said that the noise study was presented by The Turnpike Enterprise. He noted the request put forward by Representative Waldron and Senator Berman and the letter transmitted on behalf of the Village requesting a re-study of the area. He discussed the basis for the re-study. Vice Mayor McGovern inquired about the argument that decreases the sound. Mr. Barnes responded to Vice Mayor McGovern's inquiry. Mayor Napoleone asked if any of the representatives were in favor of this or opposed to this idea. Mr. Barnes answered a question from Mayor Napoleone. 8.
