CALL TO ORDER Vice Mayor McGovern called the meeting to order at 4:03 p.m. Council Members in Attendance: Vice Mayor John T. McGovern, Councilwoman Tanya Siskind, Councilwoman Maria Antuña, and Councilwoman Amanda Silvestri. Council Members Absent: Mayor Michael J. Napoleone. 2. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the December 10, 2024 Regular Council Meeting for review. A. 24-6894 RECOGNITION OF WELLINGTON’S YOUTH COUNCIL Mr. Barnes introduced the item. He stated that this was the Recognition of Wellington's Youth Council. He said that Ian Williams, Community Service Team, along with the Youth Council, would speak and provide an update. B. 24-6893 PRESENTATION BY WELLINGTON ROTARY CLUB OF THE RUCK MARCH AND HOLIDAY FOOD DRIVE RESULTS Mr. Barnes introduced the item. He stated that this was the Presentation By Wellington Rotary Club Of The Ruck March and Holiday Food Drive Results. He said that this item would be removed from the Agenda as George Kinoshita, Wellington Rotary Club, would not be present tomorrow. He said that the item would be moved to a January meeting. He noted that there would be a second presentation in its place by Coker and Watson to speak about the upcoming Legislative Session. Vice Mayor McGovern asked if Mr. Coker and Mr. Waston will appear in person or via Zoom. Mr. Barnes answered a question from Vice Mayor McGovern. C. 24-6848 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF OCTOBER 22, 2024 AND NOVEMBER 12, 2024 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meeting of October 22, 2024 and November 12, 2024. He asked Council to provide comments, if any, to the Clerk's Office. D. 24-6776 AUTHORIZATION TO RENEW AN EXISTING CONTRACT FOR ENTERPRISE RESOURCE PLANNING (ERP) SYSTEM Village of Wellington Page 1 Village Council Workshop Action Summary - Final December 9, 2024 MAINTENANCE AND SUPPORT SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization To Renew An Existing Contract For Enterprise Resource Planning (ERP) System Maintenance and Support Services. Mr. Silliman explained the item. He noted that this is an amendment to the contract, it is adjusting the prices to meet the new pricing. Vice Mayor McGovern asked whether this was a 3-year or 1-year renewal. Mr. Silliman answered a question from Vice Mayor McGovern. Vice Mayor McGovern asked how much it is per year. He asked if $566,577.00 was the combined price. Mr. Silliman answered a question from Vice Mayor McGovern. Vice Mayor McGovern commented that he wants to be clear that this is a 3-year renewal at one price. Mr. Silliman responded to Vice Mayor McGovern's comment. Mr. Barnes spoke about the previous ERP item. He said this is a 1-year renewal not a 3-year renewal for $566,557.00 until December 2025. Vice Mayor McGovern asked if the amount is $55,000 a month. Mr. De La Vega and Mr. Barnes answered a question from Vice Mayor McGovern. There were comments and discussion regarding the yearly cost. E. 24-6895 AUTHORIZATION TO UTILIZE A SOURCEWELL CONTRACT, AS A BASIS FOR PRICING, FOR THE SUPPLY AND DELIVERY OF TABLETS, ACCESSORIES, AND SUPPORT SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization To Utilize A Sourcewell Contract, As A Basis For Pricing, For The Supply And Delivery Of Tablets, Accessories, And Support Services. Mr. Silliman explained the item. Vice Mayor McGovern asked if the Village is spending $78,710.00 on forty (40) iPads. Mr. Silliman responded to Vice Mayor McGovern's comment. F. 24-6860 AUTHORIZATION TO CONTINUE UTILIZING AN EXISTING AGREEMENT WITH KRONOS SAASHR, INC. FOR SUPPORT, MAINTENANCE, LICENSES AND RENTAL OF THE VILLAGE’S TIMEKEEPING AND PERFORMANCE REVIEW SYSTEM Mr. Barnes introduced the item. He stated that this was the Authorization To Continue Utilizing An Existing Agreement With Kronos SAASHR, Inc. For Support, Maintenance, Licenses and Rental Of The Village's Timekeeping And Performance Review System. Mr. Silliman explained the item. Mr. Barnes further explained the item. Councilwoman Antuña asked about the month-to-month renewal language. Mr. Barnes answered a question from Councilwoman Antuña. G. 24-6874 AUTHORIZATION TO RENEW EXISTING CONTRACTS FOR PLANNING, ZONING AND BUILDING INSPECTION SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization To Renew Existing Contracts For Planning, Zoning and Building Inspection Services. Mr. Stillings explained the item. Mr. Barnes noted that the Council approved the budget for these items in a prior meeting; this is the actual contract portion because the contract is coming up for renewal. Vice Mayor McGovern asked if these are the outside building inspectors that are in specialized technical areas. Mr. Mills and Mr. Sitllings answered a question from Vice Mayor McGovern. Mr. Barnes answered a question from Vice Mayor McGovern. Mr. De La Vega noted that this is an hourly rate contract. He said that the rates are listed on page 76. Mr. Stillings said that there are were no increases for the renewal. Councilwoman Antuña asked if the $344,000 is the cap. Mr. De La Vega and Vice Mayor McGovern answered a question from Councilwoman Antuña. H. 24-6896 AUTHORIZATION TO AWARD A TASK ORDER TO THE UNIVERSITY OF SOUTH FLORIDA, FLORIDA INSTITUTE OF GOVERNMENT FOR A STRATEGIC PLANNING PROCESS Mr. Barnes introduced the item. He stated that this was the Authorization To Award A Task Order To The University of South Florida, Florida Institute of Government For A Strategic Planning Process. Mr. Stillings explained the item. He said that the Council would be receiving a final report of the employee survey and focus groups in the coming days. He discussed the next steps. He said that the Village of Wellington 30th Anniversary is coming up and this would be a good way to not only celebrate the 30 years but look ahead to the next 30. Mr. Barnes spoke about the Strategic Planning efforts done in 2005. Councilwoman Silvestri asked how this translates from people that the Village does not normally hear from. Mr. Barnes answered a question from Councilwoman Silvestri. Councilwoman Silvestri commented on the cost and asked how it was calculated. Mr. Barnes answered a question from Councilwoman Silvestri. Councilwoman Silvestri asked how the Village uses the information received. She asked what the Village is getting out of this and what was the total spent on this in the past. Mr. Stillings said just under $50,000 in the past. There were comments and discussion about the process and the plan. Councilwoman Silvestri asked what other municipalities had used the University of South Florida, Florida Institute of Government. Mr. Barnes answered a question from Councilwoman Silvestri. Vice Mayor McGovern asked did the first report received cost $50,000. Mr. Stillings answered a question from Vice Mayor McGovern. Vice Mayor McGovern asked Mr. Barnes why does the Village need this. He asked how is this different from the Comprehensive Plan. Mr. Barnes answered questions from Vice Mayor McGovern. Councilwoman Silvestri asked how is this worth it if half of the community wants one thing and the other half wants something different. Mr. Barnes and Mr. Stillings answered a question from Councilwoman Silvestri. Councilwoman Antuña asked how is the Village going to look at the next 10 years if this is not reviewed now. Mr. Barnes answered a question from Councilwoman Antuña. Vice Mayor McGovern stated if this is something that the Village needs to do, then it should be done. He said that seemingly, the Village has not needed it for 20 years. Mr. Barnes responded to Vice Mayor McGovern's comment. I. 24-6884 RESOLUTION NO. R2024-65 (PROGRAM FOR PUBLIC INFORMATION (PPI) UPDATE) Village of Wellington Page 5 Village Council Workshop Action Summary - Final December 9, 2024 A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL ADOPTING FORMAL PROGRAM FOR PUBLIC INFORMATION UPDATE, INCLUDING FLOOD INSURANCE PROMOTION UPDATE, FOR INTEGRATION INTO WELLINGTON'S COMMUNITY RATING SYSTEM, TO MEET THE REQUIREMENTS OF FEMA'S COMMUNITY RATING SYSTEM; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution No. 2024-65 (Program For Public Information (PPI) Update). Mr. Mills explained the item. He discussed the update process. Vice Mayor McGovern asked about the plan. Mr. Mills answered a question from Vice Mayor McGovern. Vice Mayor McGovern commented on the update. Mr. Barnes asked Mr. Mills how much the residents usually save based on participation in the community rating system and the flood insurance program. Mr. Mills said that there is a 25% reduction available per policy. He said that the average as of May last year was about $55 per policy. He said that this program brought about a total of $141,000 in savings and flood insurance policy for the Village. Vice Mayor McGovern commented good work. He thanked the team that made this happen. J. 24-6898 RESOLUTION NO. R2024-66 (2024 ANNUAL HOUSING INCENTIVES REPORT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING THE 2024 AFFORDABLE HOUSING ADVISORY COMMITTEE (AHAC) HOUSING INCENTIVES REPORT AS REQUIRED BY THE STATE HOUSING INITIATIVES PARTNERSHIP ACT, SUBSECTION 420.9076, OF THE FLORIDA STATUTES; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution No. R2024-66 (Annual Housing Incentives Report). Mr. Stillings explained the item. K. 24-6788 AUTHORIZATION TO RENEW EXISTING CONTRACTS FOR ANNUAL LAB ANALYSES SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization To Renew Existing Contracts For Annual Lab Analyses Services. Ms. Quickel explained the item. She said that these are required lab services for both the Utilities Department and Surface Water Management that are budgeted annually. She noted that this is required as part of the Village compliance with the Florida Department of Health and South Florida Water Management. Vice Mayor McGovern asked if Pace is the contractor now. Ms. Quickel answered a question from Vice Mayor McGovern. L. 24-6789 AUTHORIZATION TO RENEW EXISTING ANNUAL PUBLIC WORKS CONTRACTS TO MULTIPLE VENDORS Mr. Barnes introduced the item. He stated that this was the Authorization To Renew Existing Annual Public Works Contracts To Multiple Vendors. Mr. Wagner said that they had worked with the vendors before and had no problems. Mr. De La Vega explained the item. He said that six of the seven vendors had agreed to renew; Mancon had not agreed because the Village had not used them throughout the contract. Vice Mayor McGovern asked if the Village was going to use the six vendors. Mr. De La Vega answered a question from Vice Mayor McGovern. He noted that the Council approved a list of Public Works projects at the October 8, 2024 meeting. He said that these are the vendors that are going to do the work. He mentioned that there was no change in pricing. Vice Mayor McGovern thanked Mr. Wagner and his team for everything that they do on a daily basis to make the community better. He stated that this was the Authorization to Purchase An Irrigation Pump Station Replacement From Hoover Pumping Systems. Mr. De La Vega explained the item. He said that the location map is located on page 161 of the Agenda. He discussed the resolutions and the request. Vice Mayor McGovern asked which land piece was being conveyed to the Acme Improvement District. Mr. Reinsvold answered a question from Vice Mayor McGovern. Vice Mayor McGovern asked why does the Village want the piece of land being conveyed. Mr. Barnes said that there is an existing canal that the Village does not have access to. He said that it is a critical component of the surface water management system that, to date, we have had limited or no access to be able to maintain. Ms. Cohen said that there is no cost to the Village. Vice Mayor McGovern asked if there were any costs to the Village after conveyance. AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that was Resolution No. R2024-62 (Agreement For Decorative Clock At Wellington Town Center). There were comments and discussion regarding the clock's location. Mr. Reinsvold said that the clock is on Exhibit B. Councilwoman Siskind asked if the Village would be building the pavers and seating area. Mr. Reinsvold answered a question from Councilwoman Siskind. Ms. Cohen said that it is Rotary's responsibility to provide maintenance on the clock. R2024-63 (APPROVAL OF A QUIT CLAIM DEED FOR TRACT C OF OAKMONT ESTATES PUD (THE CIVIC SITE ADJACENT TO K-PARK) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING THE QUIT CLAIM DEED FROM THE VILLAGE OF WELLINGTON TO ACME IMPROVEMENT DISTRICT FOR TRACT C OF OAKMONT ESTATES PUD (THE CIVIC SITE ADJACENT TO K-PARK); AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2024--63 (Approval Of Quit Claim Deed For Tract C Of Oakmont Estates PUD (The Civic Site Adjacent To K-Park). Ms. Cohen explained the item. She said that the property is referred to as the right-of-way, it is owned by the Village, as the rest of K-Park is owned by Acme Improvement District. She discussed the replat process. Vice Mayor McGovern inquired if the Village is making it one owner instead of two. Ms. Cohen answered a question from Vice Mayor McGovern. Mr. Barnes said that regardless of what is developed at K-Park, it would need to be plated as one parcel. He said that putting it under one ownership makes it facilitate the next step, which is a replat. Councilwoman Silvestri asked why is this being done now. V. 24-6853 ORDINANCE NO. 2024-24 (GRANTING AN ELECTRIC FRANCHISE TO FLORIDA POWER & LIGHT COMPANY) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL GRANTING TO FLORIDA POWER & LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC FRANCHISE, IMPOSING PROVISIONS AND CONDITIONS RELATING THERETO, PROVIDING FOR MONTHLY PAYMENTS TO THE VILLAGE OF WELLINGTON, PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Ordinance No. 2024-24 (Granting An Electric Franchise To Florida Power & Light Company). Ms. Cohen explained the item. She said that the Village entered into an agreement in 1996, and then in 1997 that agreement was amended to increase the franchise fee to five percent. She said that the new agreement will increase the franchise fee to six percent and is going to translate into a positive additional revenue for the Village of $900,000 per year. Vice Mayor McGovern asked how was the percentage determined. Monica Barnes, Senior Attorney/Florida Power & Light Company, said that the figure is not determined by the Public Service Commission (PSC). She spoke about franchise fees. Vice Mayor McGovern asked if six percent was the maximum that any community charges. Ms. Barnes answered a question from Vice Mayor McGovern. Ms. Cohen said that the Village is at five percent and has been for many years. He said that they are glad that the Village was able to come to an agreement with them. W. 24-6864 ORDINANCE NO. 2024-25 (ANIMALS IN PARKS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 14, ARTICLE III, DIVISION 1, SECTION 14-18 (WILDLIFE) OF THE CODE OF ORDINANCES TO CLARIFY THAT LEASHED DOGS ARE ALLOWED IN CERTAIN WELLINGTON PARKS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this was Ordinance No. 2024-25 (Animals in Parks). Ms. Cohen explained the item. She discussed the amendments and the Village practice. She said that counsel would be pursuing the release of the funds held in escrow in the amount of $9,130,842.12. Vice Mayor McGovern asked about the release of the funds. Ms. Cohen answered a question from Vice Mayor McGovern. There were comments and discussion regarding the funds in escrow. Ms. Cohen said that the attorney fees in the Dog Park case had been received today in the amount of $52,276.80. She provided an update on the 130 Violations case. Vice Mayor McGovern asked if there were attorney fees in the 130 Violations case. Ms. Cohen answered a question from Vice Mayor McGovern. Vice Mayor McGovern commented on the cases.
