Page 1 of 3 The regular meeting of the Mayor and Council was held in the Council room of West Point City Hall October 8, 2018 at 5:30 P.M. with Mayor Steven M. Tramell presiding. Members Present: Members Absent: Councilmember Joseph R. Downs III Councilmember Henry Hutchinson Mayor Pro-Tem Sandra Thornton Councilmember Gerald W. Ledbetter Councilmember Gloria R. Marshall Councilmember Benjamin F. Wilcox Mayor Tramell called Minister Deborah Patrick Brooks, Pilgrim Baptist Church Lanett, Alabama for opening prayer. Mayor Tramell led the Pledge of allegiance. Mayor Steven Tramell thanked Commissioner Lewis Davis and Jim Wood for attending the council meetings. The following public hearing was held prior to opening the Council meeting for business: Public Hearing to receive comments concerning the proposed Avenue F road closing. The portion between East 10th and East 9th Street. There were no public comments. Mayor Tramell closed the public hearing. Mayor Tramell called the meeting of the Council to order and welcomed everyone. MINUTES Mayor Tramell asked for a motion to approve the minutes from the September 10, 2018 regular meeting. Councilmember Joseph R. Downs III made said motion and was seconded by Councilmember Gerald W. Ledbetter; the minutes were approved unanimously without change. 1 Page 2 of 3 FINANCIAL REPORT Councilmember Gerald W. Ledbetter presented the September financial report with the October cash position and forecast and made a motion to accept the report; motion seconded by Councilmember Sandra Thornton and passed unanimously. AGENDA Mayor Tramell asked for a motion to approve the agenda. Councilmember Gloria R. Marshall made said motion and seconded by Councilmember Benjamin F. Wilcox and passed unanimously. PROCLAMATION TROUP COUNTY PREVENTION COALITION RED RIBBON CAMPAIGN Mayor Tramell read a proclamation to the Troup County Prevention Coalition proclaiming October 22-26 as Red Ribbon Week and encourage the citizens to participate in drug prevention education activities, not only during Red Ribbon week, but all year long. Mayor Tramell presented the proclamation to Shannon Lawson, Sydney Lester, and Kyla Bedingfield. MOBILE FOOD VENDORS ORDINANCE Councilmember Benjamin F. Wilcox made a motion to adopt an ordinance to amend the code of the City so as to define and regulate mobile food vendors and mobile food vendor vehicles; to establish definitions such as; Mobile food vendor is defined as any person selling food from a mobile vehicle. Mobile food vendor vehicle is defined as a self- contained motorized vehicle mounted food service unit that returns daily to its base of operations and is used for either the preparation or the sale of food products, or for both. Mobile market food truck is defined as an enclosed motor vehicle equipped with facilities for the sale of locally grown fresh produce. The produce sold is in its original form and has not been altered or cooked in any other way inconsistent with it coming fresh from the fields and/or gardens in which it was grown. to impose permitting requirements; to provide for operational requirements and provisions; such as no mobile food vendor shall operate within 350 feet from the door of a lawfully established eating establishment that is actively open for business serving customers, unless the food truck vendor provides documentation, which is signed by the restaurant owner that the restaurant owner interposes no objection to a closer proximity. No mobile food vendor shall operate outside the hours of 8:00am to 10:00 pm; to define and establish regulations; to provide for penalties; to establish zoning classifications in which Mobile Food Vendors may operate to repeal conflicting ordinances. The motion was seconded by Councilmember Joseph R. Downs III; passed unanimously. 2 Page 3 of 3 CLOSE SOUTH PORTION OF AVENUE F Councilmember Joseph R. Downs III made a motion to pass a resolution to close the south portion of Avenue F between East 10th and East 9th Street. This portion no longer serves a public purpose and is not needed for private property access. The road is in poor condition and no longer considered safe for public use. Closing this portion of Avenue F will allow the development of the adjacent property and the City will be able to make storm water improvements that will impact the adjacent properties. The property has met the required advertisement for closure. The motion was seconded by Councilmember Gloria Ramsey Marshall; passed unanimously. OTHER Councilmember Sandra Thornton stated the Smooth Sounds in the Park was a huge success. The concert was held at the Downtown River Park on Saturday October 6, 2018. Councilmember Sandra Thornton stated that October is Breast Cancer Awareness Month and Sunday October 28th at 2:00 W.H.I.P. will hold its annual walk and health fair at John Hoggs Field. Mayor Tramell asked everyone to participate in this event. Fire Chief Milton Smith stated on Saturday October 6, 2018, the Fireman raised around $900.00 in two hours to support Breast Cancer Awareness. Mayor Tramell also stated Councilmember Sandra Thornton was a Breast Cancer Survivor and the Pink colors worn at tonight’s meeting are in her honor and all Breast Cancer Survivors. Councilmember Sandra asked everyone to purchase an Angel to provide Christmas toys and other presents for children at Christmas. The event is hosted by the Salvation Army. There are 74 West Point children that are needing assistance. ADJOURN Mayor Tramell asked for a motion to adjourn. Councilmember Gerald W. Ledbetter made said motion and seconded by Councilmember Joseph R. Downs III; passed unanimously.
