City of West Point Regular Council Meeting Minutes Monday, October 12, 2020 @ 5:30 PM Via teleconference The regular meeting of the Mayor and Council was held by Teleconference October 12, 2020 at 5:30 P.M. with Mayor Steven M. Tramell presiding. Members Participated: Members Non-Participate: Mayor Pro-Tempore Henry Hutchinson Councilmember Deedee Williams Councilmember Joseph R. Downs III Councilmember Gloria R. Marshall Councilmember Gerald W. Ledbetter Councilmember Sandra Thornton Councilmember Gerald W. Ledbetter gave the opening prayer. Mayor Tramell called the meeting of the Council to order and welcomed everyone. Mayor Tramell stated it has been brought to his attention that there is no in person early voting in the City of West Point. This election is not a municipal election. The City contracts with one of the Counties for municipal elections and pays the County for the cost of early and election day voting. Early voting and election day voting in a general election, which this election is, is the responsibility of the County governments not the City of West Point. He stated he has discussed this issue with City Staff and have instructed staff to contact Harris and Troup County to request early voting in person at the City of West Point polling places in both counties as soon as possible. He reminded everyone that the Troup County absentee ballots can be dropped off in the drop box at City Hall in the lower parking lot. MINUTES Mayor Tramell asked for a motion to approve the minutes from the September 14, 2020 Regular Business Meeting. Councilmember Joseph R. Downs III made said motion; seconded by Councilmember Gerald W. Ledbetter. The minutes were approved unanimously. FINANCIAL REPORT Mayor Tramell stated the financial report for approval is in the Council packet. Mayor Tramell asked for a motion to approve the September Financial report. Councilmember Sandra Thornton made said motion; seconded by Councilmember Gerald W. Ledbetter; passed unanimously. Page 2 of 3 AGENDA Mayor Tramell asked for a motion to approve the agenda. Councilmember Gloria R. Marshall made said motion and seconded by Joseph R. Downs III and passed unanimously. NEW BUSINESS • PERSONAL CARE CENTER AT 1009 3RD AVENUE Mayor Tramell asked for a motion to approve a Personal Care Center at 1009 3rd Avenue. The Center will be operated by Ms. Tameka Atkinson and Ms. Chrystal York, D&M LLC. The units are single occupancy except for married couples. The home will be limited to six occupants and the units are for people 65 and older. Councilmember Gloria R. Marshall made said motion; seconded by Councilmember Joseph R. Downs III; The motion passed unanimously. Councilmember Henry Hutchinson recused from voting citing personal relationship with the applicant. • HISTORIC PRESERVATION COMMISSION APPOINTMENT Mayor Tramell asked for a motion to appoint Ms. Debra Robertson to the West Point Historic Preservation Commission. Councilmember Joseph R. Downs III made said motion; seconded by Councilmember Sandra Thornton; passed unanimously. • DISORDERLY HOUSE ORDINANCE AMENDMENT Mayor Tramell asked for a motion to approve amending the Disorderly House Ordinance City Code Sec.17 Maintaining a disorderly house states A person who keeps and maintains, either by himself or others, a common, ill-governed, and disorderly house, to the encouragement of gaming, drinking, or other misbehavior, or to the common disturbance of the neighborhood or orderly citizens, is guilty of a misdemeanor. The amendment would hold the property owners accountable as well as the tenants for a violation of disorderly house. Councilmember Joseph R. Downs III made said motion; seconded by Councilmember Gerald W. Ledbetter. During the discussion Councilmember Sandra Thornton stated the ordinance is not much difference from the current ordinance except holding the property owners as well as the tenants for a disorderly house. Councilmember Joseph R. Downs III stated Police Chief Donald Britt outlined the procedure for notifications to tenants and owners and that seem to please most members.
