Guild said we have residents that would like to opt-out of using village contracted services for their refuse and recycling. Village Attorney Yde has advised that there could potentially be some legal issues by requiring residents to use village services. Village staff has concerns with having an opt- out ordinance in place. Guild feels the League of Municipalities would step in to help with any legal issues if the village does not create an opt-out ordinance, because there are many other communities handling their refuse pick up process the same as the Village is currently operating. If the village were to move to the opt out ordinance, there is also a concern relating to incorrect recycling tonnages being reported by haulers. Guild stated this could affect the Village’s recycling revenue (annual recycling grant). Attorney Yde’s option is to avoid litigation and create an opt-out ordinance. Staff feels the village should require residents to use the service and risk the litigation. White said having a refuse/recycling collection is necessary for the health, safety, welfare, and convenience of the public. Berger feels it would be a mistake to have an opt out ordinance. Motion by Schuster, second by Ostrowski to approve option 1, which is to remain the same and have mandatory refuse/recycling collection by a contracted carrier for all single-family up to four- unit residences.
