Ermeling called the meeting to order at 6:00 p.m.

CONSENT
29. Approve Ordinance #16-048 an ordinance relating to Disposition of public and personal
property.
30. Approve November 9, 2016 Board of Trustees Minutes.
31. Acknowledge 2016 street maintenance activities.
Motion by White, second by Ostrowski to approve Consent items 29 to 31. Q/Schuster asked about
the Joint Employee Management Committee (JEMC). Guild stated the committee is made up of
employees. The committee makes recommendations on personnel related items to both Village
standing committees and/or Board of Trustees. There was a short discussion on sending items out for
bid. Donner said only items with a value exceeding $100 would be sent out for bid if approved by
the Property & Infrastructure Committee. Ermeling asked if all village employees were notified
when there is an employee name drawing for an item valued under $100. Weinkauf said yes.

NEW BUSINESS.
32. Discussion and possible action on an Opt-Out Ordinance, within Chapter 66, Solid Waste.
Guild said we have residents that would like to opt-out of using village contracted services for their
refuse and recycling. Village Attorney Yde has advised that there could potentially be some legal
issues by requiring residents to use village services. Village staff has concerns with having an opt-
out ordinance in place. Guild feels the League of Municipalities would step in to help with any legal
issues if the village does not create an opt-out ordinance, because there are many other communities
handling their refuse pick up process the same as the Village is currently operating. If the village
were to move to the opt out ordinance, there is also a concern relating to incorrect recycling tonnages
being reported by haulers. Guild stated this could affect the Village’s recycling revenue (annual
recycling grant). Attorney Yde’s option is to avoid litigation and create an opt-out ordinance. Staff
feels the village should require residents to use the service and risk the litigation. White said having
a refuse/recycling collection is necessary for the health, safety, welfare, and convenience of the
public. Berger feels it would be a mistake to have an opt out ordinance.
Motion by Schuster, second by Ostrowski to approve option 1, which is to remain the same and
have mandatory refuse/recycling collection by a contracted carrier for all single-family up to four-
unit residences.

Q/Schuster wanted the Board to know the Community Life and Public Safety Committee made a
recommendation to go with option 3, which is to revise the solid waste ordinance and create an opt-
out procedure, but they did not have the same information as the Board of Trustees.

33. Discussion on 2017 Utility Fund Budgets.
Guild reviewed the water and sewer utilities budget. Donner reviewed the administrative/general,
source of supply, pumping and water treatment expenses. He pointed out the proposed increases
within each line item. There was a short discussion on the addition of a new employee and
manganese removal at the Bloedel Well as a future CIP project. Guild reviewed the water utility
fund debt schedule. He also reviewed the sewer utility fund. Donner reviewed some of the major
expenses to include Rib Mountain Metropolitan Sewer District treatment costs. Guild reviewed the
sewer utility fund debt schedule. He also reviewed the storm water utility budget and debt schedule.
34. Discussion on 2017 TIF1/2 Budgets.
Guild reviewed the budget for TIF #1. He explained all the funds included in the budget. Jacobs
reviewed the special revenue fund, and fund 21. He also reviewed the calculations of the TIF district
2013-2017 taxes and debt schedule. Guild reviewed the budget for TIF #2. It was indicated TIF #2
can be closed out in 2021.
35. Approve schedule of fees for 2017, including special charges for refuse & recycling,
stormwater, vehicle registration fees, amongst others.
Guild stated the only fee increase in the 2017 budget is the refuse and recycling fee.
Motion by White, second by Porlier to approve the refuse and recycling fee increase of $165.
Schuster said the budget process seemed to be piecemealed this year as compared to other years.

Senator Petrowski joined the meeting at 7:30 p.m. He talked about state aids, fuel tax, sales tax, the
refuse/recycling fund and shared revenue.
36. 2017 Meeting Calendar.
There was a lengthy discussion on the proposed meeting calendar. An ordinance revision for the
meeting time will come before the Board at the next meeting.
CONVENE INTO CLOSED SESSION UNDER WISCONSIN STATE STATUTES 19.85 (1)(c) for
considering performance of any public employee over which the governmental body has jurisdiction or
exercises responsibility.
Motion by Schuster, second by Ziegler to convene to closed session at 8:16 p.m.

Trustee Ziegler stated he may not be able to make the next meeting.
REPORT FROM PRESIDENT.
Ermeling reported she received a letter from the Village of Rothschild Board President concerning a proposed
Intergovernmental Agreement which stated the Village felt it wasn’t needed.
