Communication from the Environmental Officer regarding an application submitted on behalf of Galleria City Holding Company LLC for an amendment to the zoning ordinance to establish a new Transit Development-2 District, which recommends that the Common Council find that, in accordance with the New York State Environmental Quality Review Act regulations, the proposed action may have a significant adverse impact on the environment; determine and direct that a draft environmental impact statement be prepared by the applicant; direct that the applicant's proposed draf t scoping document be circulated to involved agencies and the public; schedule a public scoping session for the Common Council meeting of April 1, 2024; and establish a public comment period on the proposed scoping outline authorizing the acceptance of written comments until April 12, 2024. Mrs.Puja moved adoption of the following Ordinance.  AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS APPROVING AND RATIFYING THE FEBRUARY 23, 2024 STIPULATION OF AGREEMENT BETWEEN THE NEGOTIATING REPRESENTATIVES OF THE CITY OF WHITE PLAINS AND THE POLICE BENEVOLENT ASSOCIATION OF THE CITY OF WHITE PLAINS, INC., AUTHORIZING THE MAYOR TO DIRECT THE BUDGET DIRECTOR TO FUND THE INCREASED PAYMENTS UNDER THE AGREEMENT, AND AUTHORIZING THE MAYOR TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT CONTAINING THE TERMS OF THE AGREEMENT. WHEREAS, representatives of the City of White Plains (the “City”) and the Police Benevolent Association of the City of White Plains, Inc., (the “PBA”), have reached a tentative agreement to extend the prior collective bargaining agreement between the City and the PBA, which covers the period July 1, 2021 through June 30, 2024, upon the same terms and conditions except as specifically modified in the February 23, 2024 Stipulation of Agreement entered into between the negotiating representatives of the City and PBA, for two years from July 1, 2024 up to and including June 30, 2026; and WHEREAS, the PBA, by a majority vote of the membership, ratified the tentative Agreement; and WHEREAS, the spirit of the Agreement calls for the City to implement the terms of the Agreement as soon as possible; and NOW, THEREFORE, the Common Council of the City of White Plains hereby ordains and enacts as follows: Section 1. The Stipulation of Agreement entered into February 23, 2024, by and between the representatives of the City and the PBA, and set forth below, is hereby ratified and approved by the Common Council:  Section 2. The Mayor is hereby authorized to direct the Commissioner of Finance to begin making payments under the February 23, 2024 Stipulation of Agreement between the representatives of the City and the PBA set forth above. ROACH t: 914.422.1411 MAYOR f: 914.422.1395 TO: THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL SUBJECT: ENGAGING VHB TO PREPARE WHITE PLAINS VISION ZERO ACTION PLAN Submitted herewith for your review and appropriate action is a proposed ordinance authorizing the Mayor to execute a contract with VHB for professional services related to the preparation of the White Plains Vision Zero Action Plan (Action Plan). The City of White Plains has been awarded a United States Department of Transportation - Safe Streets for All (SS4A) grant to prepare an Action Plan. The grant award is $500,000: $400,000 in federal funding and a match of $100,000 (in kind services) from the City. The Action Plan will envision an integrated mobility system that includes motorists, cyclists and pedestrians. It will also endeavor to enhance the safety of the City’s roadways regardless of mode of transportation and will prioritize climate resilience, sustainability and economic viability. Once the Action Plan has been completed and approved, the City will be eligible to access additional federal funds through SS4A federal program for sustainable, clean mobility projects. A task force was created to develop the Request for Proposal (RFP) and manage the selection process for engaging a suitable planning, design and engineering firm to work with city staff to prepare the Action Plan. The members of the task force are Thomas Soyk, Deputy Commissioner of Traffic; Judy Mezey, Deputy Commissioner of Planning; Anthony Marena, Transportation Engineer; Justin Holman, Planner and me. The City received three response to the RFP. At the conclusion of the selection process, it was determined that VHB is the best firm to assist the City with the preparation of the White Plains Vision Zero Action Plan. VHB has successfully demonstrated that it possesses sufficient professional skills and experience to complete this task in a timely and professional manner. Respectfully submitted, Ingrid M. The ROSEbuds Advocacy program aims to identify key strategies to reduce crime among girls between the ages of 12 and 18. The program matches mentors (ROSES) who previously navigated the justice system with our youth (ROSEbuds). The contract period will be January 01, 2024 to December 31, 2024 and the total compensation for the performance of all such services shall not exceed Ten Thousand dollars ($10,000) paid at $50 (Fifty dollars) per hour of service for a maximum of 200 hours. Such Facilities Use Agreement shall allow for the use of designated areas of the Law School from 3 PM to 6 PM on April 12, 2024 and from 9 AM to 4 PM on April 13, 2024 for a fee of $600.00 payable by the City. As a result of this change to the Traffic Ordinance, a project will be undertaken to upgrade the speed limit signs citywide to the new 25 miles per hour speed limit. This work was originally expected to be completed as part of the Capital Improvement Program at an estimated cost of $200,000. It is now suggested that this work should instead be performed by Department of Parking personnel working on an overtime basis at a significant savings to the city. As this expense was not originally anticipated in the 2023-2024 Adopted Budget, a transfer from the Reserve for Financing will be necessary to complete this work. In addition to the overtime expense the department will also need to purchase a significant number of signs to replace signs at sixty (60) entry points into the City as well as on numerous major roadways. The total revised estimate to complete this work is $70,000, which will save the city an estimated $130,000. The approximately 11-acre project site, known as 100 Main Street, encompassing two city blocks, is located in the City of White Plains downtown Core Area and is designated as Section 125.75, Block 4, Lots 1, 2, 3, 4, and 5 on the Official Map of the City of White Plains (“Premises,” or “Project Site,”). The boundaries of the two-block Project Site are: Main Street to the north, South Lexington Avenue to the west, Martine Avenue to the south, and Court Street to the east. Included within these boundaries is the portion of Dr. Martin Luther King Jr. Boulevard ("MLK Blvd") that runs north­ south between the two blocks. The Project Site is currently improved with the four-story Galleria Mall, Lexington-Grove Municipal Parking East and West parking garages (the "City Garages"). An enclosed portion of the Mall extends over MLK Blvd connecting the eastern and western portions of the Project Site. The Galleria Mall contains approximately 870,000 square feet and is now vacant. The Petitioner has presented a Conceptual Development Plan that would include demolition of the existing Mall and the City Garages and the construction of a new, approximately 3.7 million square foot mixed use development including approximately 3,200 units of multifamily housing. In addition, the Proposed Project would include approximately 229,000 square feet of retail/commercial space, approximately 46% open space, and on-site parking facilities with 3,400 parking spaces. At its February 5, 2024 meeting, the Common Council adopted a resolution (a) designating itself as the Lead Agency for the environmental review of the Proposed Action; and (b) determined that the Proposed Action is a Type I Action under SEQR regulations. The Environmental Officer recommends that the Common Council find that the Proposed Action, when compared against the Criteria for Determining Significance listed in Section 617.7 (c) (1) of SEQR 1 regulations, may have the following significant adverse impacts on the environment: • Potential substantial change in existing air quality, traffic or noise levels. • Potential creation of a material conflict with a community’s current plans or goals as officially approved or adopted. • Potential substantial changes to the character or quality of important aesthetic resources or of existing community or neighborhood character. • Potential substantial changes in the use, or intensity of use, of land including open space, recreational resources, or other natural resources or the area’s capacity to support existing uses. • Potential substantial changes encouraging or attracting of a large number of people to a place or places for more than a few days, compared to the number of people who would come to such place absent the action. Based on the above, the Environmental Officer recommends that the Common Council require the Applicant to prepare a Draft Environmental Impact Statement (DEIS) providing additional information to systematically assess potential impacts, explore project alternatives and measures to mitigate potential impacts. A draft DEIS Scoping Outline dated October 26, 2023, which contains an outline of issues to be addressed in the DEIS, has been prepared by the Applicant and offered for consideration and approval by the Common Council. The Environmental Officer recommends that the Common Council, as approving agency of the Proposed Action: (a) determine that the Proposed Action, when compared against the Criteria for Determining Significance listed in Section 617.7 (c) (1) of SEQR regulations, may have a significant effect on the environment. (b) determine and require the Applicant to prepare a Draft Environmental Impact Statement (DEIS) providing additional information to systematically assess potential impacts, explore project alternatives and measures to mitigate potential impacts. (c) determine the Draft Scoping Outline dated October 26, 2023, including issues to be addressed in a DEIS is adequate for the purpose of commencing public review and comment regarding issues to be addressed in the DEIS. (d) authorize the circulation of the Draft Scoping Outline, dated October 26, 2023, with the Application Package to involved agencies and the public. (e) schedule a public scoping meeting for the Common Council meeting on April 1, 2024, for the purpose of receiving comments regarding the Scoping Outline. (White Plains Common Council). • Approval of disposition of City property now occupied by the Lexington-Grove Municipal Parking East and West parking garages to the Petitioner (White Plains Common Council). • Approval of Special Permits applicable to any Special Permit uses listed for the proposed TD-2 District (White Plains Common Council). • Approval of a Stormwater Pollution Prevention Plan (SWPPP) (White Plains Department of Public Works). • Approval of connections to municipal sanitary sewer and water service lines (White Plains Department of Public Works and Westchester County Department of Health). • Approval of roadway modifications, if any, to Main Street, NYS Route 119 and County Road 52 (Westchester County Department of Transportation). • Other necessary approvals related to the Conceptual Development Plan, including but not limited to, amendments to the Traffic Ordinance, capital projects, building permits and related permits such as water and sewer connections, signage approvals, etc.: and WHEREAS, the Environmental Officer has recommended that the Common Council find that the Proposed Action, when compared against the Criteria for Determining Significance listed in Section 617.7 (c) (1) of SEQR regulations, may have the following significant adverse impacts on the environment: • Potential substantial change in existing air quality, traffic or noise levels. • Potential creation of a material conflict with a community’s current plans or goals as officially approved or adopted. • Potential substantial changes to the character or quality of important aesthetic resources or of existing community or neighborhood character. • Potential substantial changes in the use, or intensity of use, of land including open space, recreational resources, or other natural resources or the area’s capacity to support existing uses. • Potential substantial changes encouraging or attracting of a large number of people to a place or places for more than a few days, compared to the number of people who would come to such place absent the action; and WHEREAS, based on the above, the Environmental Officer recommends that the Common Council require the Applicant to prepare a Draft Environmental Impact Statement (DEIS) providing additional information to systematically assess potential impacts, explore project alternatives and measures to mitigate potential impacts; and 2  WHEREAS, a draft DEIS Scoping Outline dated October 26, 2023, which contains an outline of issues to be addressed in the DEIS, has been prepared by the Applicant and offered for consideration and approval by the Common Council; and WHEREAS, the Environmental Officer has recommended that the Common Council, as approving agency of the Proposed Action: (a) determine that the Proposed Action, when compared against the Criteria for Determining Significance listed in Section 617.7 (c) (1) of SEQR regulations, may have a significant effect on the environment: (b) determine and require the Applicant to prepare a Draft Environmental Impact Statement (DEIS) providing additional information to systematically assess potential impacts, explore project alternatives and measures to mitigate potential impacts; (c) determine the Draft Scoping Outline dated October 26, 2023, including issues to be addressed in a DEIS is adequate for the purpose of commencing public review and comment regarding issues to be addressed in the DEIS; (d) authorize the circulation of the Draft Scoping Outline, dated October 26, 2023, with the Application Package to involved agencies and the public; (e) schedule a public scoping meeting for the Common Council meeting on April 1, 2024, for the purpose of receiving comments regarding the Scoping Outline; (f) schedule a comment period for the purpose of receiving written comments regarding the Scoping Outline and determine that written comments regarding the Scoping Outline will be accepted by the Common Council until the close of business on April 12, 2024; (g) determine that written comments should be addressed to the White Plains City Clerk, Municipal Building, 255 Main Street, White Plains, New York 10601 (Email: cityclerk@whiteplainsny.gov); and (h) authorize the Environmental Officer to distribute appropriate notices as required by SEQR; and WHEREAS, the Common Council has considered the Proposed Action, Application Materials and correspondence from the Environmental Officer which constitutes the Environmental Review Record and serves as a basis for the SEQR determination; now, therefore, be it RESOLVED, that the Common Council hereby: (a) determines that the Proposed Action, when compared against the Criteria for Determining Significance listed in Section 617.7 (c) (1) of SEQR regulations, may have a significant effect on the environment. Zion Church, for an extension of the Site Plan Approval for their proposed multi-family residential project located 63 Lake Street, formally known as 65 Lake Street.
