Increase: 001-0001-0599 (Appropriated Surplus) $23,723.00 Increase: 001-1010-4040 (Trustees/Education Exp/Travel) $ 2,177.00 001-1410-4040 (Village Clerk/Education Exp/Travel) $ 851.00 001-1410-4450 (Village Clerk/Miscellaneouse) $ 412.00 001-7520-4520 (Historical Properties/Plaques) $ 3,108.00 001-8163-4450 (Trash Pickup/Miscellaneous) $17,175.00 ROGERS #2 RESOLVED, that payroll and vouchers in the amount of $150,847.67 covering the period from 8/30/2021 – 9/21/2021 are hereby approved as follows: PAYROLL COVERING - 8/30/2021-9/12/2021 $ 41,958.32 VOUCHERS COVERING- 9/8/2021-9/21/2021 GENERAL FUND- $ 38,301.72 WATER FUND- $ 57.20 SEWER FUND- $ 3,343.31 GLEN PARK FUND- $ 798.21 TRUST & AGENCY FUND- $ 10,708.41 DEBT SERVICE- $ 53,400.00 COMMUNITY DEVELOPMENT- $ 0.00 CAPITAL FUND- $ 2,280.50 $ 108,889.35 GRAND TOTAL: $ 150,847.67 ETU #1 WHEREAS, The Village owns the right-of-way (“ROW”) along East Spring Street, a village street; and WHEREAS, a portion of the ROW has extended, and currently extends, beyond the traditional roadway to abut the building facades of two structures located on 5590 Main Street (S.B.L. #69.17-2-32) (commonly known as 5590 Main Street and 78 E. Spring Street) (“5590 Main Street”); and WHEREAS, pursuant to a license agreement dated May 2, 2016, the owner of 5590 Main Street, or its tenants, have occupied an approximately 90’ x 10’ strip of the ROW as shown on the sketch attached and incorporated by reference herein (“ROW Strip”) for use as patios,; and WHEREAS, the use of the ROW Strip has not interfered with the East Spring Street roadway or the remaining sidewalk on the east side of East Spring Street; and WHEREAS, the Village wishes to discontinue the ROW Strip as a Village right-of-way and transfer ownership of the ROW Strip to 5590 Main Street LLC, the owner of 5590 Main Street; and WHEREAS, at the request of the Village, the Town of Amherst Assessor has calculated that the value of the ROW Strip is $12,000 (based on a per acre value for vacant land and comparable sales data); and WHEREAS, 5590 Main Street LLC has agreed to pay the price of $12,000 for the ROW Strip, which the Village has determined represents the fair market value of the property; and WHEREAS, the Village completed a Short Environmental Assessment Form (“EAF”) in connection with the proposed discontinuance and sale of the ROW Strip and has determined that such discontinuance and sale will not result in any significant adverse environmental impacts, for the reasons set forth in Parts 2 and 3 of the EAF, which is incorporated be reference herein; and WHEREAS, a duly noticed public hearing on the proposed discontinuance and sale of the ROW Strip was held on September 13, 2021; NOW, THEREFORE, BE IT RESOLVED, that the Village Board of Trustees hereby determines that it is no longer necessary to maintain the ROW Strip as Village right-of-way and is therefore hereby discontinued; and BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to execute, on behalf of the Village, a contract of sale of the ROW Strip to 5590 Main Street LLC, for a price of $12,000.00, along with any and all other necessary forms and documents to consummate such sale. ETU #2 WHEREAS, the Village Board desires to pursue funds opportunities to complete the Main Street Sidewalk Gap Project. WHEREAS, the Village Board desires to provide this type of facility to residents at the lowest possible cost to the Village and Village taxpayers, and WHEREAS, the Village Board desires to apply for financial assistance from the NYSDOT Transportation Alternative Program (TAP), and WHEREAS, the Village Board commits to providing the required local matching funds to insure the timely implementation of the proposed project. THEREFORE BE IT RESOLVED, that the Village Board authorizes and submits an application for the New York State Department of Transportation: 2021 Transportation Alternative Program funds for the Main Street Sidewalk Gap Project in an amount not to exceed $802,707 (80% of the total project cost of $1,003,384.00), and BE IT FURTHER RESOLVED, that upon approval of the application for financial assistance that the Village make available $200,677.00 (20%) in matching funds to satisfy the requirements of the funding program, and BE IT FURTHER RESOLVED, that the Village Board authorizes the Mayor to sign all documents and agreements related to the Transportation Alternative Program (TAP) application RESOLVED, that Deborah L. Rogers, as Mayor of the Village of Williamsville, is hereby authorized and directed to file an application for funds from the New York State Department of Transportation, Transportation Alternatives Program, in an amount no less than 20% of the approved funding and upon approval of said request to enter into and execute a project agreement with the State of New York for such financial assistance to the Village of Williamsville for the proposed Main Street Sidewalk Gap Project. TORRE #1 RESOLVED, that the Administrator is hereby authorized to advertise for a public hearing on Tuesday October 13, 2021 at 7:30pm to hear all those interested in discussing the reduction of the speed limit on Garrison Road in the Village of Williamsville.
