Commission Meeting

June 19, 2024 A regular meeting of the Board of City Commissioners was held on June 19, 2024, at 7:00 p.m. at the City Meeting Room. Present Commissioners John Clausen, Bill Kary, Lisa Hedstrom and Jim Schacher and President LeeAnn Domonoske-Kellar. Motion made by Kary and seconded by Clausen to approve the minutes from the June 5, 2024 meeting as presented. All present voted aye, motion carried. Motion made by Hedstrom and seconded by Kary to approve the minutes from the special hearing held on May 30, 2024. All present voted aye, motion carried. Motion made by Schacher and seconded by Kary to approve the agenda as presented. All present voted aye, motion carried. General discussion was held about 2025 budget. Motion made by Clausen and seconded by Hedstrom to approve Tand Construction pay application 12 for the 2022 improvement project for $391,788.45. All present voted aye, motion carried. Motion made by Clausen and seconded by Hedstrom to approve Tand Construction pay application 4 for the 2023 improvement project for $262,685.10. All present voted aye, motion carried. With the passing of the City attorney, Pres. Domonoske-Kellar contacted Nyhus Law Firm about becoming the City Attorney. Motion made by Schacher and seconded by Hedstrom to table the matter until more law firms can be contacted. All present voted aye, motion carried. Motion made by Schacher and seconded by Clausen to approve following variances and street closures for the 125th Celebration: July 11, 2024 • Noise Variance- 724 High Park Drive 4:00 pm to 1:00 am (July 12, 2024) for the Alumni Open House July 12, 2024 • Noise Variance- Street Dance 9:00 pm to 1:00am (July 13, 2024) • Street Closures- 1. 3:15 pm to 4:00 pm- Intersection of Burleigh Road and 3rd Street and Minnie Avenue between 4th Street and 5th Street. 2. 4:00 pm to 1:00 am- Dakota Avenue from 2nd Street to Railway Street July 13, 2024 • Noise Variance- Street Dance 9:00 pm to 1:00 am (July 14, 2024)  • Street Closure for parade route- All of Dakota Avenue and Burleigh Road between 7th Street and Railway Street • No street parking on Dakota between Railway and 2st (Car show) following parade • Street Closure 1. 7:00 pm to 1:00 am Dakota Avenue from 2nd to Railway 2. 10:00 am to 1:00 am on July 14, 2024, Minnie Avenue 2nd to 4th • Fireworks Variance – Applies only to the 125th Celebration Committee, no personal fireworks are allowed Parking lot closure • Parking lot at the pond – 8:00 am to 7:00pm • South Park closed from 6:00pm to 1:00 am- approved by Wilton Park Board All present voted aye, motion carried. Comm. Schacher stated McLean County Sheriff Department presented him with paperwork that said the City could not require a security deposit for a tenant to switch the City water bill into their name. The paperwork Comm. Schacher was referring to was Wilton City ordinance 7.0223 Rates and Charges – Liability for. In 2017 per property owners request, the city changed the policy allowing renters to switch the water bill into their name with a $200.00 security deposit. North Dakota Century Code allows municipalities to require a security deposit. Pres. Domonoske-Kellar informed the board there has been one instance since 2017 where a renter has left an amount due and is currently making payment on the outstanding balance. Comm. Hedstrom questioned why this was suddenly an issue and who is the person complaining about the deposit policy. Comm. Schacher again informed the board it was brought to him by the McLean County Sheriff Department. Auditor Solberg informed Comm. Hedstrom that the person who complained was not a deputy but did work for the McLean County Sheriff Office and rents a house in Wilton. Motion made by Schacher and seconded by Clausen to require all water bills to be in the property owners name starting September 1, 2024. Roll call vote. Aye: Comm. Clausen, Kary and Schacher. Nay: Comm. Hedstrom and Pres. Domonoske-Kellar. Motion carried. General discussion on was held about changing the fee charged by the City to mow private property. The current rate is $0.02 per square foot. It was decided not to change the rate at this time. Comm. Schacher questioned why compliance letters are being sent out for grass clippings being blown into the street. Pres. Domonoske-Kellar explained it was against City ordinances and a safety issue for motorcycles and bicycles. Pictures of the violations were shown to the board that had clippings blown several feet into the road the entire length of the property. Motion made by Schacher and seconded by Hedstrom to approve the County Lines Café’s liquor license transfer to the Memorial Hall for the Alumni on July 13, 2024. All present voted aye, motion carried. Pres. Domonoske-Kellar thanked Comm. Kary for his years of service on the Commission. Comm. Kary did not run for re-election, and this was his last meeting. Motion made by Clausen and seconded by Kary to pay bills as presented. Roll call vote. Aye: Comm. Clausen, Kary, Hedstrom, Schacher and Pres. Domonoske-Kellar. Motion carried. With no other items for discussion Pres.
