The Village of Withee Board met on August 14, 2023, in the Municipal Building Conference Room at 6:30
p.m. for the regular board meeting.
ROLL CALL
President Lindgren called the meeting to order. Roll call was answered by Trustees Lindgren, Shelton, Gehrke,
Frankewicz, and Kalepp. Clerk Niemi recorded the minutes. Also present were DPW Derek Schad, Police
Chief Patrick Fehlman, Attorney Wachsmuth (telephone), and Cindy Cardinal.
MINUTES
A Frankewicz/Kalepp motion to approve the minutes of the July 10, 2023, regular meeting minutes carried with
all ayes.
FINANCIAL STATEMENTS
A Shelton/Frankewicz motion to approve the monthly financial statements for the General, Water, and Sewer
Accounts carried with all ayes.
PAYMENT OF BILLS
A Frankewicz/Gehrke motion to approve paying the General Account checks 36296 thru 36348, Water Account
checks 7258 thru 7270, and Sewer Account checks 2558 thru 2560 carried with all ayes.
PAYROLL REPORT
The board reviewed the employee time cards and payroll report.
COMMUNITY INPUT
There was no community input.
COMMITTEE REPORT
Trustee Kalepp reported that the library received their AED and had a successful booth at Withee Days. Clerk
Niemi reported that she, library staff, and two library board members received a two-hour training from Noel
Barteck on the AED and briefly covered CPR.
DEPARTMENT OF PUBLIC WORKS
DPW Derek Schad reported on removal of a downed tree on School Street and plant filters were regenerated.
The John Deere representative is going to see if brackets can be put in front for the endloader wing, ditches will
be mowed, lead/copper water bottles will be distributed to specific residents for testing, and the Village will be
enrolled with Diamond Maps to map using the GPS machine from Rural Water Association. He is getting
quotes from B&M for upgrading SCADA and from Crane Engineering for a new or refurbished high service
pump for the plant. Schad presented information on leveling a section of sidewalk. A Gehrke/Frankewicz
motion to approve the sidewalk lifting and leveling quote of $4,152.28 from Concrete Lifting Technologies, Inc
for the sidewalk on the east side of Division Street from Spaulding Street to the railroad tracks carried with all
ayes. No action was taken for the purchase of a four-wheeler as the quote wasn’t received from Power Pac.
Trustee Frankewicz requested the solar speed sign be moved to the north end of town on Division Street.
CLOSED SESSION
A Frankewicz/Kalepp motion at 6:51 pm to enter Closed Session pursuant to §Ch. 19.85 (l)(c), “considering
employment, promotion, compensation or performance evaluation data of any public employee (part-time
employee call-in wage)” carried with all ayes. A Kalepp/Frankewicz motion to invite Derek Schad and Ellen
Niemi into closed session at 6:52 p.m. carried with all ayes.
A Kalepp/Shelton motion to reconvene into open session at 6:58 p.m. carried with all ayes. A Gehrke/Shelton
motion to approve a minimum call-in of two hours at overtime wage effective 08/08/2023 for part-time public
works employee David Laabs carried with all ayes.
POLICE REPORT
A Shelton/Gehrke motion to approve accounts payable 8/02/2023 carried with all ayes. Chief Fehlman said the
radar trailer isn’t located in the old depot, so he will call Thorp police to see if they have it. The department
participated in a traffic detail with the state patrol, and they stopped 37 vehicles in one shift. He and Officer
Haugstad made 12 traffic stops during the Owen Jr. Fair with two of the stops involving drugs.
DISCUSSION AND ACTION TO FILE ACTION TO ABATE NUISANCE PURSUANT TO §11-6-6(b)
VILLAGE ORDINANCE AT 805 DANIA STREET
Attorney Wachsmuth joined the meeting at 7 pm by telephone to answer questions regarding the abatement.
Discussion was held between the board, attorney, and police chief regarding the abatement and recouping the
attorney and cleanup fees from the property owner. Pictures of 805 Dania Street were viewed and items to be
disposed were discussed. The neighbors’ complaints about the health hazards and possible lower values for
their properties were mentioned. A Gehrke/Frankewicz motion to file action to abate nuisance pursuant to §11-
6-6(b) Village Ordinances at 805 Dania Street carried with all ayes. No action was taken on the quote for
abating the nuisances on the property as the cleaning company needs clarification on some of the items to scrap.
GENERAL DEPARTMENT
The board reviewed the year-to-date budget which had some slight increases that can be adjusted with monies
not spent in other areas.
A Kalepp/Shelton motion to adjourn at 7:39 p.m. carried with all ayes.
