1 June 17, 2024 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, June 17, 2024 and was called to order at 7:00pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Robert A. Look, City Attorney; Jesus Plasencia, City Engineer; Rob McMahon, City Administrator PRESENTATIONS PRESENTATION OF PETITIONS PUBLIC HEARING UNFINISHED BUSINESS 2024-182 OLD CITY HALL UPDATE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that City Council has received the communication from the City Engineer, regarding Rise Above Ventures' update for the rehabilitation of the old City Hall located at 3131 Biddle Avenue, and hereby places it on file. Motion unanimously carried. CALL TO THE PUBLIC CONSENT AGENDA 2024-183 MINUTES By Councilperson Calvin supported by Councilperson Crayne RESOLVED that the minutes of the meeting held under the date of June 3, 2024, be approved as recorded without objection. Motion unanimously carried. 2024-184 640 PLUM – PLANNED DEVELOPMENT APPLICATION By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that City Council receives the communication from the Planning Commission regarding the proposed development at 640 Plum Street and places it on file; AND BE IT FURTHER RESOLVED that City Council concurs with the recommendation of the Planning Commission and hereby APPROVES the Stage 1 Preliminary Site Plan for the proposed project at 640 Plum, Wyandotte, as submitted by the property owner, 640 Plum LLC. Motion unanimously carried. 2024-185 SPECIAL EVENT APPLICATION: SEAWAY BOAT CLUB By Councilperson Calvin supported by Councilperson Crayne WHEREAS the Special Events Coordinator has received an application from the Seaway Boat Club to hold their annual Dock Party event on August 16th & 17th, 2024, from 8:00AM - 1:30PM each day. BE IT RESOLVED that Council approves the requests and use of city property as listed below for said event: a. Permission to utilize city property b. Request for DPS to provide fencing around the approved area 2 June 17, 2024 c. Permission to set up on August 15th and tear down on August 18th BE IT FURTHER RESOLVED that Seaway Boat Club will comply with the following: • If there are any costs for any city staff/material/property for said event, Seaway Boat Club will be responsible for those fees. • Any tents on the street or sidewalk must be weighted (no stakes are allowed to be used to anchor tents) to prevent collapse. • Seaway Boat Club will be responsible for clean up (glass, spills, broken items, etc.) before, during, and after the event. • Any requests made after this event is reviewed and approved by Council will be evaluated by the Special Events Coordinator and necessary Department Heads for consideration of approval. BE IT FURTHER RESOLVED that Seaway Boat Club must add the City of Wyandotte as additional insured to their insurance policy and sign a hold harmless agreement as prepared by the Department of Legal Affairs. Motion unanimously carried. 2024-186 SPECIAL EVENT APPLICATION: THE PEACH TRUCK By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that Council Concurs with the recommendation of the Special Events Coordinator, Fire Chief, Police Chief and Recreation Superintendent to approve the use of city property, specifically a small portion of the City Hall parking lot - either 3rd and Eureka or 3rd and Sycamore Street for Conz Productions, LLC and The Peach Truck to host the sale of peaches on July 3rd, July 24th, and August 14th, 2024. The groups have added the City of Wyandotte as additional insured to their insurance policy and will sign a hold harmless agreement, as prepared by the Department of Legal Affairs, for the use of city property. Motion unanimously carried. 2024-187 SPECIAL EVENT APPLICATION: SWEET ARRANGEMENTS By Councilperson Calvin supported by Councilperson Crayne WHEREAS the Special Events Coordinator has received an application from Sweet Arrangements to hold a DJ event on June 20th, 2024, from 6: 30 - 10pm at the grassy area at Sycamore and Biddle Avenue (Arrowhead Pavilion). BE IT RESOLVED that Council approves the requests and use of city property as listed below for said event: a. Permission to utilize city sidewalks and property b. Motion unanimously carried. 3 June 17, 2024 NEW BUSINESS 2024-188 SEWAGE RATE – EFFECTIVE 7/1/2024 By Councilperson Calvin supported by Councilperson Crayne RESOLVED that the Council concurs in the recommendation of the Deputy Treasurer/Assistant Finance Director that a sewage rate increase be implemented for July 1, 2024, and that the Department of Municipal Service is directed to increase the billing for sewage disposal charges to $5,053.00 per million gallons of water consumed. This will provide the City with the necessary funds for the following purposes: • To pay the City of Wyandotte’s share of operation and maintenance of the sewage disposal system • To pay the Downriver Utility Wastewater Authority (DUWA) sewage charges on a monthly basis • To pay for the replacement of equipment of the sewage disposal system • To cover the loss of revenue due to the difference between the City’s master meter and customer’s meters • To pay for debt service The moneys collected, except for the collection costs of $50.50 per million gallons of water consumed which will be retained by the Municipal Service Commission, shall be placed in the appropriate fund to be used for the above stated purposes and any balance that may accrue shall be retained therein to provide for emergencies, contingencies, and extraordinary events. IT IS FURTHER RESOLVED that in accordance with Ordinance 802 Article III, Section Five, all customers of the City of Wyandotte’s Wastewater System shall receive annual notification and breakdown of the new sewage rate and the Municipal Service Department is hereby directed to print said sewage rate breakdown on all water bills on an annual basis. IT IS FURTHER RESOLVED that the Department of Legal Affairs be directed to prepare the necessary Ordinance Amendment. Motion unanimously carried. 2024-189 FIRST & FINAL READING #1543 – SEWAGE DISPOSAL CHARGES By Councilperson Calvin supported by Councilperson Crayne First & Final #1543 AN ORDINANCE ENTITLED AN ORDINANCE TO AMEND SUBPARAGRAPH (A) OF §52.017 ENTITLED “SEWAGE DISPOSAL CHARGES” OF THE CODE OF ORDINANCES OF THE CITY OF WYANDOTTE THE CITY OF WYANDOTTE ORDAINS: Section 1. Subparagraph (A) of §52.017 entitled “Sewage Disposal Charges” is hereby amended as follows: (A) Generally. Effective as of July 1, 2024 the department of municipal service of the city is directed to increase the billing for sewage disposal charges to Five Thousand Fifty-Three + 00/100 ($5,053.00) dollars per one million (1,000,000) gallons of water consumed. This will provide the city with funds for the following purposes: To pay charges for the city’s share of the operation and maintenance of the sewage disposal system (including debt service and replacement); to pay for meter loss; to pay for maintaining and operating the city sewers, which are a part of the sewage disposal system; to pay for collection costs. The monies collected, except for collection costs of fifty dollars and fifty cents ($50.50) per million gallons of water consumed, which shall be retained by the municipal service commission, shall be placed in an appropriate fund to be used for the above-stated purposes and any balance that may accrue shall be retained therein to provide for emergencies and contingencies. Section 2. Severability. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section 3. Effective Date. This ordinance shall take effect July 1, 2024. This ordinance is deemed necessary for the immediate preservation of the public peace, property, health, safety and for providing for the usual daily operation of the City Engineers Office and Department of Municipal Services. This Ordinance or a 4 June 17, 2024 summary shall be published in a newspaper generally circulated in the City of Wyandotte within ten (10) days after adoption. Any summary shall designate the location in the City where a true copy of the ordinance can be inspected or obtained. Motion unanimously carried. 2024-190 COMPETITIVE BID #4857 AWARD – WYANDOTTE CONNEX FIBER DROP By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that City Council concurs with the Municipal Services Commission approving the General Manager to award and execute a contract agreement with Henkels and McCoy, Inc, the lowest qualified bidder for the Wyandotte ConneX Part A - Fiber Drop Installation Labor (between OTE (pole) and OWB (house) for FTTH Project Bid #4867 and in an amount not to exceed $1,861,706, as recommended by WMS Management. Motion unanimously carried. 2024-191 POLICE DEPARTMENT – PROMOTION TO DEPUTY CHIEF – K. GROAT By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that the City Council concurs with the recommendation of the current Deputy Police Chief and the Police and Fire Commission to approve the promotion of Detective Sergeant Kenneth Groat to the rank of Deputy Police Chief effective June 17, 2024; and FURTHER authorizes the Mayor and City Clerk to execute an Employment Agreement with Kenneth Groat after approval by the City's Labor Attorney which includes a starting annual salary of $99,507.20 and the preservation of the current fringe benefit provisions currently entitled to Kenneth Groat. Motion unanimously carried. 2024-192 HIRING: DPS LABORER/EQUIPMENT OPERATOR – G. POUPARD By Councilperson Calvin supported by Councilperson Crayne RESOLVED that Council acknowledges receipt of the communication from the Human Resource Specialist regarding the Laborer/Equipment Operator position at the Department of Public Service; AND CONCURS with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy; AND FURTHER, RESOLVED that the Council approves the hiring of Gary Poupard as a Full-Time Laborer/Equipment Operator in the Department of Public Services contingent on successful completion of physical, drug screen, and background check. Motion unanimously carried. 2024-193 DOWNRIVER COUNCIL FOR THE ARTS: BUILDING FUNDING REQUEST By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED, that the City Council hereby approves the funding request of the DCA in the amount of $5,938.95 for elevator service, maintenance, and repair at 81 Chestnut Street, and BE IT FURTHER RESOLVED, that the quotes of service and invoices shall be referred to the DDA Director and City Engineer For technical support. Motion unanimously carried. 2024-194 EMERGENCY REPLACEMENT FOR AC UNIT AT FIRE STATION #2 By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that Council concurs with the recommendation of the City Engineer and APPROVES the replacement of the rooftop air conditioning unit at Fire Station #2, located at 1093 Ford Avenue, by Expert Mechanical Service of Wyandotte, Michigan, in the amount of $19,500, in accordance with the Emergency Procurement section of the Procurement Rules and Policy adopted by the City Council on January 9, 2017. The purchase and installation of the unit will be funded from account #101-448-750-270. Motion unanimously carried. 5 June 17, 2024 2024-195 SALE OF 1850 21ST STREET – RISE ABOVE VENTURES By Councilperson Calvin supported by Councilperson Crayne RESOLVED BY THE MAYOR and CITY COUNCIL that the communication from the City Engineer regarding the sale of the property at 1850 21st Street, Wyandotte is hereby received and placed on file; AND BE IT FURTHER RESOLVED that Council concurs with the recommendation to sell said property to Rise Above Ventures, LLC in the amount of $34,839.75; AND BE IT FURTHER RESOLVED, the Council authorizes the Mayor and City Clerk to execute the Assignment with Rise Above Ventures, LLC as presented to Council on June 3, 2024, and approved by the Legal Department. RESOLVED FURTHER, that a public hearing upon such plans, district, and estimate of costs will be held in the Council Chambers of Wyandotte City Hall at 3200 Biddle Avenue, Wyandotte, Michigan, within the City Council meeting commencing at 7:00PM on Monday, July 22, 2024, where Council will meet to consider the proposed district and to hear the objections of any owner of, or party in interest of, the property to be assessed, whose name appears upon the last local tax assessment records, and that a notice shall be sent by the City Clerk by first class mail addressed to such owner(s) or party(ies) at the address shown on the tax records, at least ten (10) days before the date of such hearing. Motion unanimously carried. 2024-197 2024 COMPOSTING AGREEMENT By Councilperson Calvin supported by Councilperson Crayne RESOLVED that Council approves the Composting Agreement with Regulated Resource Recovery, Inc. to provide processing of compost materials for the City at the unit rate of $8.75 per cubic yard, and FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute said Composting Agreement and the Department of Public Services is authorized to deliver compost materials to Regulated Resource Recovery as necessary.
