Yukon City Council Minutes February 16, 2021 The Yukon City Council met in regular session on February 16, 2021 at 7: 00 p. m. in the Council Chambers of the Centennial Building, 12 South Fifth Street, Yukon, Oklahoma. The invocation was given by Pastor Kirt Moelling, First United Methodist Church appeared via videoconference) The flag salute was given in unison. ROLL CALL: ( Present) Shelli Selby, Mayor ( appeared via videoconference) Jeff Wootton, Vice Mayor Donna Yanda, Council Member ( appeared via videoconference) Rick Cacini, Council Member Aric Gilliland, Council Member OTHERS PRESENT: Tammy Kretchmar, City Manager Mitch Hort, Assistant City Manager Gary, Cooper, IT Director Officer Zach Roberson OTHERS PRESENT VIA VIDEOCONFERENCE: Doug Shivers, City Clerk Roger Rinehart, City Attorney Philip Merry, City Treasurer Shawn Vogt, Fire Chief Robbie Williams, City Engineer John Corn, Police Chief Jason Beal, Deputy City Clerk Presentations and Proclamations Mayor Selby stated she signed an Emergency Proclamation on February 14th for the current winter storm. Visitors None Recess as Yukon City Council and Reconvene as Yukon Municipal Authority) 1A. YMA Consent Docket This item is placed on the agenda so the Yukon Municipal Authority, by unanimous consent, can designate those routine items they wish to be approved by one motion. If an item does not meet with the approval of all Authority Members, that item will be heard in regular order. The City Manager recommends a motion to approve: A) The minutes of the regular meeting of February 2, 2021 B) Payment of material claims in the amount of $ 25, 747. 06 The motion to approve the YMA Consent Docket, consisting of the approval of the minutes of the regular meeting of February 2, 2021 ; payment of material claims in the amount of $ 25, 747. 06, was made by Trustee Wootton and seconded by Trustee Gilliland. The vote: AYES: Cacini, Gilliland, Selby, Wootton, Yanda NAYS: None VOTE: 5- 0 MOTION CARRIED City Council Minutes - February 16, 2021 Page 2 2A. Consider awarding the bid for the Sports Park Land Lease to Williams Family Investments, LLC and entering into a Lease Agreement, in amount of $ 11, 752. 50 per year, for the term March 1, 2021 thru March 1, 2024 with the option to renew for an additional 3 year period, as recommended by the Assistant City Manager The motion to award the bid for the Sports Park Land Lease to Williams Family Investments, LLC and entering into a Lease Agreement, in amount of $ 1 1 , 752. 50 per year, for the term March 1 , 2021 thru March 1 , 2024 with the option to renew for an additional 3 year period, as recommended by the Assistant City Manager, was made by Trustee Gilliland and seconded by Trustee Yanda. Detailed discussion was held on this item including citizen concerns, lease terms, sports park and future development. Council Member Gilliland asked about the lease term and termination. Mr. Hort stated it is a 3 year term and either party can terminate the lease with 190 day notice. Mr. Rinehart stated the lease term clause binds all parties. Council Member Gilliland expressed his concern with it being pasture land and affecting future development. Ms. Kretchmar stated the City will withhold 600 frontage feet on Frisco Road for future development. The vote: AYES: Cacini, Selby, Yanda NAYS: Gilliland, Wootton VOTE: 3- 2 MOTION CARRIED Adjourn as YMA and Reconvene as Yukon City Council) 1. Consent Docket This item is placed on the agenda so the City Council, by unanimous consent, can designate those routine items they wish to be approved by one motion. The City Manager recommends a motion that will approve: A) The minutes of the regular meeting of February 2, 2021 B) Payment of material claims in the amount of $817, 915. 47 C) Designating the items on the attached list from the Technology Department as surplus and authorizing their sale, donation or trade D) Setting the date for the next regular Council meeting for March 2, 2021, 7: 00 p. m., in the Council Chambers of the Centennial Building, 12 S. Fifth St. The motion to approve the Consent Docket consisting of the minutes of the regular meeting of February 2, 2021 ; payment of material claims in the amount of 817, 915.47; designating the items on the attached list from the Technology Department as surplus and authorizing their sale, donation or trade; setting the date for the next regular Council meeting for March 2, 2021 , 7: 00 p. m., in the Council Chambers of the Centennial 12 S. Fifth St., was made by Council Member Building, Wootton and seconded by Council Member Yanda. The vote: AYES: Selby, Gilliland, Yanda, Cacini, Wootton NAYS: None VOTE: 5- 0 MOTION CARRIED 2. Reports of Boards, Commissions and City Officials - Ms. Kretchmar commended the Street Department for all the winter road work. City Council Minutes - February 16, 2021 Page 3 3. Consider approving a Budget Amendment for Fiscal Year 2021 The motion to approve a Budget Amendment for Fiscal Year 2021, was made by Council Member Yanda and seconded by Councli Member Cacini. The vote: AYES: Yanda, Selby, Gilliland, Cacini, Wootton NAYS: None VOTE: 5- 0 MOTION CARRIED 4. Consider approving Ordinance 1419, an Ordinance amending the employee retirement system, defined benefit plan for City of Yukon, Oklahoma; providing retirement benefits for eligible employees of City of Yukon, Oklahoma; pertaining to definition of employee; providing for repealer and severability; and declaring an emergency. The vote: AYES: Wootton, Cacini, Yanda, Gilliland, Selby NAYS: None VOTE: 5- 0 MOTION CARRIED 4a. Consider approving the Emergency Clause of Ordinance No. 1419 The motion to approve the Emergency Clause of Ordinance No. 1419, was made by Council Member Yanda and seconded by Council Member Cacini. The vote: AYES: Selby, Wootton, Yanda, Cacini, Gilliland NAYS: None VOTE: 5- 0 MOTION CARRIED 5. Consider approving the Emergency Clause of Ordinance No. 1420 The motion to approve the Emergency Clause of Ordinance No. 1420, was made by Council Member Yanda and seconded by Council Member Wootton. The vote: AYES: Cacini, Selby, Gilliland, Yanda, Wootton NAYS: None VOTE: 5- 0 MOTION CARRIED 6. Consider authorizing the City Engineer to advertise bids for the Waterline Relocations along State Highway 4 The motion to authorize the City Engineer to advertise bids for the Waterline Relocations along State Highway 4, was made by Council Member Wootton and seconded by Council Member Gilliland. Council Member Gilliland asked why the Engineer solicits bids. Mr. Kretchmar stated they draw up the specifications and act as an agent of the City. The vote: AYES: Yanda, Cacini, Gilliland, Wootton, Selby NAYS: None VOTE: 5- 0 MOTION CARRIED 7. Consider authorizing the City Engineer to advertise bids for the Sanitary Sewer Relocations along State Highway 4 The motion to authorize the City Engineer to advertise bids for the Sanitary Sewer Relocations along State Highway 4, was made by Council Member Yanda and seconded by Council Member Cacini. The vote: AYES: Wootton, Yanda, Selby, Gilliland, Cacini NAYS: None VOTE: 5- 0 MOTION CARRIED 8. Consider approving the expenditure of funds in an amount not to exceed 92, 640. 00, to TEIM Design, for Engineering Services and Construction Observation for 11th Street road improvements The motion to approve the expenditure of funds in an amount not to exceed 92, 640. 00, to TEIM Design, for Engineering Services and Construction Observation for 1 1 th Street road improvements, was made by Council Member Wootton and seconded by Council Member Gilliland. Council Member Wootton asked about the process. Ms. Kretchmar stated that TEIM will draw up the specifications, plans and bid the project. The vote: AYES: Cacini, Gilliland, Wootton, Yanda, Selby NAYS: None VOTE: 5- 0 MOTION CARRIED City Council Minutes - February 16, 2021 Page 5 9. New Business - no new business. 10. Council Discussion Council Member Yanda asked everyone to stay safe and warm. Council Member Wootton asked everyone to stay safe, warm and to check on your neighbors. Council Member Cacini asked citizens to help each other and to slow down on the streets during winter weather. Council Member Gilliland thanked the Streets Department as well as all City departments for all their work during the winter storm.
