ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday November 05, 2018 at 7:00 PM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: November 8, 2018 Members Present: Bryan Traylor, Vice-President; Jason Plunkett, Kevin Spees, Susana Suarez, Elizabeth Hopper and Tom Schuler Members Absent: Josh Garrett Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Amy Lacy, Director of Finance & Records, and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE OCTOBER 22, 2018 REGULAR MEETING (copy posted). COUNCIL ACTION: Councilor Spees moved to approve the Memoranda of the October 22, 2018 Town Council Meeting. Councilor Plunkett seconded the motion. The Memoranda of the October 22, 2018 meeting was approved by a vote of four in favor, zero opposed. Councilor Suarez joined the meeting at this time. 3. DEPARTMENTAL OCTOBER MONTHLY REPORTS – Reports are submitted by the Town Management staff for Council review and posted on the Town website (www.zionsville-in.gov). Councilor Schuler joined the meeting at this time. 4. REQUEST TO SPEAK Zionsville resident Dawn Spivey spoke in opposition to item #6A. Zionsville resident Brian Heidelmeier spoke in opposition to item #6A. Zionsville resident Craig Triscari spoke in opposition to item #6A. Zionsville resident Neal Roahrig spoke in opposition to item #6A. Zionsville resident David Brattain spoke in opposition to item #6A. Zionsville resident Jill Brattain spoke in opposition to item #6A. Zionsville resident Heather Cleveland spoke in opposition to item #6A. Zionsville resident Darin Cleveland spoke in opposition to item #6A. Zionsville resident Tony Theofanis spoke in opposition to item #6A. Zionsville resident Steve Christian spoke in opposition to item #6A. Zionsville resident Ryan Bell spoke in opposition to item #6A. Those who spoke in opposition to item #6A expressed concerns regarding property values, safety, noise, traffic, aesthetics, water quality and well issues. 5. OLD BUSINESS A. Consideration of the 2019 Salary Ordinance for the Town of Zionsville (SECOND READING). ORDINANCE #2018-22 Deputy Mayor Mitro reviewed the 2019 Salary Ordinance stating that there were no significant changes to the 2019 Ordinance as compared to the 2018 Salary Ordinance. COUNCIL ACTION: Councilor Suarez moved to adopt Ordinance #2018-22. Councilor Spees seconded the motion. Ordinance #2018-22 was adopted on final reading by a vote of six in favor, zero opposed. 6. NEW BUSINESS A. Consideration of an Ordinance to rezone approximately 73.30 acres from the (AG) Agricultural Zoning District to the Rural (I-1) Light Industrial Zoning District ORDINANCE #2018-23 Director of Planning and Economic Development Wayne DeLong reviewed Ordinance #2018-23, stating that it came to the Council with a four to two favorable recommendation. He answered questions from the Council. At the request of Vice-President Traylor, Attorney Matt Price, representing the petitioner VanTrust Real Estate, LLC, gave an overview of the proposed project and answered questions from the Council. Mr. Price also introduced Structurepoint Civil Engineer Ross Nixon and Rafe Webster of VanTrust Real Estate, LLC who answered additional questions from the Council. Discussion followed. COUNCIL ACTION: Councilor Suarez moved to continue item #6A concerning Ordinance #2018-23. Councilor Schuler seconded the motion. Item #6A, Ordinance #2018-23 was continued to the November 19, 2018 Town Council meeting by a vote of six in favor, zero opposed. B. Consideration of a Resolution to Proceed with Land Acquisition (North-South Connector Project). RESOLUTION #2018-17 Street and Stormwater Superintendent Lance Lantz reviewed Resolution #2018-17 and answered questions from the council. COUNCIL ACTION: Councilor Spees moved to approve Resolution #2018-17. Councilor Hopper seconded the motion. Resolution #2018-17 was approved by a vote of four in favor, two opposed, with Councilor Suarez and Councilor Schuler opposing. 7. OTHER MATTERS APPROVAL OF CLAIMS COUNCIL ACTION: Councilor Suarez moved to approve claims as presented. Councilor Spees seconded the motion. Claims were approved by a vote of six in favor, zero opposed. 8. ADJOURN COUNCIL ACTION: Councilor Hopper moved to adjourn the meeting. Councilor Suarez seconded the motion. The motion was approved by a vote of six in favor, zero opposed. The next regular Town Council meeting is scheduled for Monday November 19, 2018 at 7:30 AM in the Zionsville Town Hall Council Chambers. Respectfully Submitted, Amelia A.
