ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Tuesday September 3, 2019 at 7:00 PM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: September 4, 2019 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Jason Plunkett, Tom Schuler, Kevin Spees, Elizabeth Hopper, and Susana Suarez Also Present: Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Amy Lacy, Director of Finance & Records and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE AUGUST 19, 2019 REGULAR MEETING (copy posted). COUNCIL ACTION: President Garrett moved to approve the Memoranda of the August 19, 2019 Town Council Meeting. Councilor Hopper seconded the motion. The Memoranda of the August 19, 2019 meeting was approved by a vote of seven in favor, zero opposed. 3. DEPARTMENTAL MONTHLY REPORTS – Reports are submitted by the Town Management staff for Council review and posted on the Town website (www.zionsville-in.gov). 4. REQUEST TO SPEAK There were no requests to speak. 5. OLD BUSINESS - None 6. NEW BUSINESS A. Consideration of a Resolution Making a Preliminary Determination for the Town Council to enter into a proposed lease between the Zionsville Municipal Building Corporation and the Town of Zionsville, Indiana (PUBLIC HEARING only – no vote to be taken at this meeting). RESOLUTION #2019-13 Deputy Mayor Mitro introduced and reviewed items A, B, C, D and E explaining their relation to one another and the purpose for each. Bond Counsel Bruce Donaldson of Barnes and Thornburg explained the statutes and procedures involved in the bonding process. Superintendent of Streets and Stormwater Lance Lantz explained the Street and Stormwater portion of the municipal complex project and the proposed lease with the Zionsville Municipal Building Corporation. Parks and Recreation Superintendent Matt Dickey explained the Parks portion of the municipal complex project, as well as the prospective bonds for the Overly-Worman Park and Big-4 Rail Trail improvements. Lengthy discussion followed. Deputy Mayor Mitro, Attorney Donaldson, Superintendent Lantz, Superintendent Dickey, and Mark Adam and Rebecca Zakowski of Crowe LLC answered questions from the Council. Further discussion ensued. Councilors expressed interest in postponing consideration of items A, B, C, D and E, citing the need for more information on the projects and the associated financials. With Proof of Publication for a Public Hearing noted, President Garrett opened the Public Hearing for comment on Item A. With no public comment, President Garrett closed the Public Hearing. No further action taken at the meeting.  B. Consideration of a Resolution approving form of Lease for Street/storm water building and calling for public hearing on the lease. RESOLUTION #2019-14 COUNCIL ACTION: Councilor Suarez moved to continue Resolution #2019-14. Councilor Schuler seconded the motion. Resolution #2019-14 was continued to the next regular Town Council meeting by a vote of six in favor, one opposed, with Councilor Spees opposing. C. Consideration of an Ordinance approving Series 2019A Park District Bonds (park complex at former Rail Trail Gardens Property) (FIRST READING). ORDINANCE #2019-16 COUNCIL ACTION: Councilor Suarez moved to continue Ordinance #2019-16. Councilor Schuler seconded the motion. Ordinance #2019-16 was continued to the next regular Town Council meeting by a vote of six in favor, one opposed, with Councilor Spees opposing. D. Consideration of an Ordinance approving Series 2019B Park District Bonds (improvements at Overley-Worman Park) (FIRST READING). ORDINANCE #2019-17 COUNCIL ACTION: Councilor Suarez moved to continue Ordinance #2019-17. Councilor Schuler seconded the motion. Ordinance #2019-17 was continued to the next regular Town Council meeting by a vote of six in favor, one opposed, with Councilor Spees opposing. E. Consideration of an Ordinance approving Series 2019C Park District Bonds (trail way improvements including Big-4 Rail Trail) (FIRST READING). ORDINANCE #2019-18 COUNCIL ACTION: Councilor Suarez moved to continue Ordinance #2019-18. Councilor Schuler seconded the motion. Ordinance #2019-18 was continued to the next regular Town Council meeting by a vote of six in favor, one opposed, with Councilor Spees opposing. F. Consideration of an Ordinance regulating Golf Carts (FIRST READING). ORDINANCE #2019-19 Councilor Plunkett introduced Ordinance #2019-19, explaining the benefits of the ordinance and emphasizing the engagement and input from multiple sources in creating the ordinance. Discussion followed. Councilor Plunkett, Chief Knox, Attorney Heather Willey, Deputy Mayor Mitro and Superintendent Lantz answered questions from the Council. Responding to concerns from the Council, Deputy Mayor Mitro explained that language could be added to insure that the Ordinance would be reviewed on a yearly basis for any needed amendments. When asked by Council if they could adopt on final reading at the next meeting with amendments, after introducing it as presented on first reading, Attorney Willey confirmed they could. COUNCIL ACTION: Councilor Spees moved to introduce Ordinance #2019-19 on first reading with possible amendments before final reading. Councilor Plunkett seconded the motion. The motion passed with a vote of seven in favor, zero opposed. Ordinance #2019-19 was introduced on first reading with possibility of amendments on final reading. No further action taken. 7. OTHER MATTERS Attorney Willey advised Councilors and Town staff that she had been responding on behalf of the Town to letters they had received regarding opposition to the implementation of 5G technology in the Town of Zionsville. She requested that they share any further correspondence on this matter with her so that she could respond. Attorney Willey also encouraged Council members to speak with their State Senators and legislators regarding the importance of ongoing road funding. 8. APPROVAL OF CLAIMS COUNCIL ACTION: President Garrett moved to approve claims as presented. Councilor Spees seconded the motion. Claims were approved by a vote of seven in favor, zero opposed. 9. ADJOURN COUNCIL ACTION: President Garrett moved to adjourn the meeting. Councilor Spees seconded the motion. The motion was approved by a vote of seven in favor, zero opposed.
