ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday September 16, 2019 at 7:30 AM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: September 17, 2019 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Jason Plunkett, Tom Schuler, and Elizabeth Hopper Members Absent: Kevin Spees and Susana Suarez Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Jake Bonifield, Town Attorney; Mark Adam and Rebecca Zakowski, Crowe LLC; Amy Lacy, Director of Finance & Records, and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE SEPTEMBER 03, 2019 REGULAR MEETING (copy posted). COUNCIL ACTION: President Garrett moved to approve the Memoranda of the September 3, 2019 Town Council Meeting. Councilor Hopper seconded the motion. The Memoranda of the September 3, 2019 meeting was approved by a vote of five in favor, zero opposed. 3. REQUEST TO SPEAK Zionsville resident Ralph Stacy spoke regarding Item #4, asking Councilors to reconsider reinstating growth controls for the Town. Zionsville resident Mark Walters spoke in opposition of item # 4, specifically items C, D, and E, urging Council to delay any decisions until after the November 2019 election. Zionsville resident Paul Dreier spoke regarding Item #4, asking Council to defer making a decision until there had been sufficient opportunity to look at alternatives and to pay down existing debt. 4. OLD BUSINESS Prior to presenting the Old Business items, Crowe representatives Rebecca Zakowski and Mark Adam gave a presentation outlining the Town’s debt structure and obligations. Discussion followed. Ms. Zakowski and Mr. Adam answered questions from the Council. Further discussion followed. Bond Counsel Bruce Donaldson, Deputy Mayor Mitro, Mayor Haak, Street and Stormwater Superintendent Lance Lantz, Parks and Recreation Superintendent Matt Dickey and Police Chief Knox also answered questions from the Council. A. Consideration of a Resolution Making a Preliminary Determination for the Town Council to enter into a proposed lease between the Zionsville Municipal Building Corporation and the Town of Zionsville, Indiana (PUBLIC HEARING/VOTE). RESOLUTION #2019-13 With Proof of Publication for a Public Hearing noted, President Garrett opened the Public Hearing for comment. With no public comment, President Garrett closed the Public Hearing and called for discussion or a motion. COUNCIL ACTION: Vice-President Traylor moved to continue Resolution #2019-13. Councilor Schuler seconded the motion. Resolution #2019-13 was continued to the next regular Town Council meeting by a vote of five in favor, zero opposed. No further action taken at this meeting. B. Consideration of a Resolution approving form of Lease for Street/storm water building and calling for public hearing on the lease (Continued from the September 03 meeting). RESOLUTION #2019-14 COUNCIL ACTION: Councilor Schuler moved to continue Resolution #2019-14. Councilor Hopper seconded the motion. Resolution #2019-14 was continued to the next regular Town Council meeting by a vote of five in favor, zero opposed. No further action taken at this meeting. C. Consideration of an Ordinance approving Series 2019A Park District Bonds (park complex at former Rail Trail Gardens Property) (Continued from the September 03 meeting). ORDINANCE #2019-16 COUNCIL ACTION: Councilor Schuler moved to continue Ordinance #2019-16. Councilor Hopper seconded the motion. Ordinance #2019-16 was continued to the next regular Town Council meeting by a vote of five in favor, zero opposed. No further action taken at this meeting. D. Consideration of an Ordinance approving Series 2019B Park District Bonds (improvements at Overley-Worman Park) (Continued from the September 03, 2019 meeting). ORDINANCE #2019-17 COUNCIL ACTION: Councilor Schuler moved to continue Ordinance #2019-17. Councilor Hopper seconded the motion. Ordinance #2019-17 was continued to the next regular Town Council meeting by a vote of five in favor, zero opposed. No further action taken at this meeting. E. Consideration of an Ordinance approving Series 2019C Park District Bonds (trail way improvements including Big-4 Rail Trail) (Continued from the September 03, 2019 meeting). ORDINANCE #2019-18 COUNCIL ACTION: Councilor Schuler moved to continue Ordinance #2019-18. Councilor Hopper seconded the motion. Ordinance #2019-18 was continued to the next regular Town Council meeting by a vote of five in favor, zero opposed. No further action taken at this meeting. F. Consideration of an Ordinance regulating Golf Carts (SECOND READING). ORDINANCE #2019-19 President Garrett called for discussion or a motion. COUNCIL ACTION: Councilor Plunkett moved to adopt Ordinance #2019-19. President Garrett seconded the motion. Ordinance #2019-19 was adopted on final reading by a vote of five in favor, zero opposed. 5. NEW BUSINESS A. Appointment of two Appraisers to complete an Appraisal of a portion of the former Rail Trail Gardens property (planned Street and Stormwater Department facility). COUNCIL ACTION: Vice-President Traylor moved to continue the vote on the appointment of appraisers. Councilor Plunkett seconded the motion. The appointment of appraisers was continued to the next regular Town Council meeting by a vote of five in favor, zero opposed. No further action taken at this meeting. B. Consideration of an Ordinance vacating a platted and recorded utility easement (Stonegate Subdivision) (PUBLIC HEARING). ORDINANCE #2019-20 Deputy Mayor Mitro briefly outlined the request and noted a letter from the Stonegate HOA supporting the request. With Proof of Publication for a Public Hearing noted, President Garrett opened the Public Hearing for comment. With no public comment, President Garrett closed the Public Hearing and called for discussion or a motion. COUNCIL ACTION: President Garrett moved to introduce Ordinance # 2019-20 on first reading. Councilor Schuler seconded the motion. The motion passed with a vote of five in favor, zero opposed. Ordinance 2019-20 was introduced on first reading. No further action taken at this meeting. 6. OTHER MATTERS President Garrett asked Councilors to send him any questions regarding the bonds outlined in Item #4 or any other questions related to Item #4. 7. ADJOURN COUNCIL ACTION: President Garrett moved to adjourn the meeting. Councilor Hopper seconded the motion. The motion was approved by a vote of five in favor, zero opposed.
