ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday October 07, 2019 at 7:00 PM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: October 12, 2019 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Elizabeth Hopper, Jason Plunkett, Tom Schuler, Kevin Spees, Susanna Suarez Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Jake Bonifield and Adam Steuerwald, Town Attorneys; Mark Adam and Tim Berry, Crowe LLC; Amy Lacy, Director of Finance & Records, and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE SEPTEMBER 16, 2019 REGULAR MEETING (copy posted). COUNCIL ACTION: President Garrett moved to approve the Memoranda of the September 16, 2019 Town Council Meeting. Councilor Spees seconded the motion. The Memoranda of the September 16, 2019 meeting was approved by a vote of seven in favor, zero opposed. 3. DEPARTMENTAL MONTHLY REPORTS – Reports are submitted by the Town Management staff for Council review and posted on the Town website (www.zionsvillle-in.gov). 4. SWEARING IN OF NEW FIREFIGHTERS Before swearing in the new firefighters, Chief VanGorder first introduced Jeanette and Tim White and their sons Nolan and Alex. Jeanette White gave a brief presentation in memory of her brother, volunteer firefighter Kevin Sanders who was killed in in 2013 in the line of duty in West Texas. She presented the Zionsville Fire Department with a donation of $1,000.00 for safety equipment enhancements. . Chief VanGorder introduced Christopher Kelly, Benjamin Shircliff, Alexander White and Jarrett Vardaman. At the request of Chief VanGorder, Mayor Haak administered the Oath of Officer to the new firefighters. Chief VanGorder announced the merit promotions of Casey Curtis and Aaron Gibbon to the rank of Lieutenant. At the request of Chief VanGorder, Mayor Haak administered the Oath of Office to the new Lieutenants. Chief VanGorder announced the appointment of Scott Mamaril to Battalion Chief. At the request of Chief VanGorder, Mayor Haak administered the Oath of Office to the new Battalion Chief. President Garrett congratulated Chief VanGorder for receiving the Fire Chief of the Year Career Award and Abdulakh Abamislimov for receiving the Paramedic of the Year Award at the Indiana Emergency Response Conference. 5. REQUEST TO SPEAK Executive Airport Attorney Michael Howard elected to delay his opportunity to speak until the matter he intended to address, item #7A, was introduced. 6. OLD BUSINESS Mayor Haak briefly explained the need for the proposed new municipal complex on the site of the former Rail Trail Gardens for the Street and Stormwater and Parks and Recreation departments. Street and Stormwater Superintendent Lance Lantz and Parks and Recreation Director Matt Dickey gave a presentation explaining the municipal complex and the need for the proposed bonds in order to fund the construction, infrastructure and related costs associated with building the complex. Citing limitations in the current locations as well as future growth, they stressed the necessity of the project. Chief Knox also contributed to the presentation, explaining that with the proposed Street and Parks municipal complex, the police department would take over the current municipal building now housing all three departments. He stressed the necessity for the additional space because the police department is at and over capacity on office and storage space and cannot address current and future needs. Tim Barry of Crowe LLC gave a presentation addressing questions and concerns regarding the funding of the proposed project and why, from a funding standpoint, it should be done now. He gave an overview of debt and property tax rates, Park and Town debt and Zionsville property tax impact. He answered questions from the Council. Discussion followed. Mr. Berry, Superintendent Lantz, Superintendent Dickey, Attorney Adam Steuerwald and Mayor Haak answered questions from the Council. A. Consideration of a Resolution Making a Preliminary Determination for the Town Council to enter into a proposed lease between the Zionsville Municipal Building Corporation and the Town of Zionsville, Indiana (Continued from the September 16, 2019 meeting). RESOLUTION #2019-13 COUNCIL ACTION: Councilor Spees moved to approve Resolution #2019-13. President Garrett seconded the motion. President Garrett requested a roll call vote: President Garrett: Yea Vice-President Traylor: Yea Councilor Spees: Yea Councilor Schuler: Nay Councilor Plunkett: Nay Councilor Hopper: Nay Councilor Suarez: Nay Resolution #2019-13 failed to pass by a vote of three in favor, four opposed. B. Consideration of a Resolution approving form of Lease for Street/storm water building and calling for public hearing on the lease (Continued from the September 16, 2019 meeting). RESOLUTION #2019-14 COUNCIL ACTION: Vice-President Traylor moved to deny Resolution #2019-14. Councilor Suarez seconded the motion. Resolution #2019-14 failed to pass by a vote of two in favor of the resolution and five opposed to the resolution. C. Consideration of an Ordinance approving Series 2019A Park District Bonds (park complex at former Rail Trail Gardens Property) (Continued from the September 16, 2019 meeting). ORDINANCE #2019-16 COUNCIL ACTION: Councilor Suarez moved to deny Ordinance #2019-16. Councilor Hopper seconded the motion. Ordinance #2019-16 failed to pass by a vote of two in favor of the ordinance and five opposed to the ordinance. D. Consideration of an Ordinance approving Series 2019B Park District Bonds (improvements at Overley-Worman Park) (Continued from the September 16, 2019 meeting). ORDINANCE #2019-17 Superintendent Dickey presented Ordinance #2019-17 and explained the project. Parks Board President Jeff Edmondson gave an overview of the Master Plan process. Boone County Convention and Visitors’ Bureau Board President Steve Jacob spoke in favor of the trail improvements at this time and offered a letter of support from the Boone County Convention and Visitors’ Bureau and a contribution of $2,500.00 from the Boone County Convention and Visitors’ Bureau. Superintendent Dickey and Tim Berry answered questions from the Council. COUNCIL ACTION: Councilor Suarez made a motion to introduce Ordinance #2019-17 on first reading. Council Hopper seconded the motion. The motion passed with a vote of seven in favor, zero opposed. Ordinance #2019-17 was introduced on first reading. No further action taken. E. Consideration of an Ordinance approving Series 2019C Park District Bonds (trail way improvements including Big-4 Rail Trail) (Continued from the September 16, 2019 meeting). ORDINANCE #2019-18 The Boone County Council and Boone County Board of Commissioners submitted a letter of support for the Town of Zionsville’s proposal to the DNR for a Next Level Trails Grant along with a contribution of $3,000.00. Superintendent Dickey answered questions from the Council. COUNCIL ACTION: President Garrett moved to introduce Ordinance #2019-18 on first reading. Councilor Suarez seconded the motion. The motion passed with a vote of seven in favor, zero opposed. Ordinance #2019-18 was introduced on first reading. No further action taken. F. Consideration of an Ordinance vacating a platted and recorded utility easement (Stonegate Subdivision) (SECOND READING/VOTE). ORDINANCE #2019-20 Deputy Mayor Mitro answered questions from the Council.  COUNCIL ACTION: President Garrett moved to adopt Ordinance #2019-20. Vice-President Traylor seconded the motion. Ordinance #2019-20 was adopted on final reading by a vote of seven in favor, zero opposed. G. Appointment of two Appraisers to complete an Appraisal of a portion of the former Rail Trail Gardens property (planned Street and Stormwater Department facility). COUNCIL ACTION: President Garrett made a motion to deny appointment of appraisers. Councilor Spees seconded the motion. The appointments were denied by a vote of zero in favor, seven opposed. 7. NEW BUSINESS A. Consideration of an Ordinance to rezone approximately 5.22 acres from the Rural (AZ) Airport District to the Rural (AG Agricultural Zoning Classification (Van Sickle Petition) (FINAL READING/VOTE). ORDINANCE #2019-21 Director of Planning and Economic Development Wayne DeLong introduced Ordinance #2019-21, noting that it came to the Council with a favorable recommendation from the Planning Commission. Representing the petitioner, Attorney Melissa Gerrard spoke regarding the proposed rezoning. Michael Howard, as attorney for the Airport, spoke in opposition to the rezoning. Ms. Gerrard answered questions from the Council. COUNCIL ACTION: Vice-President Traylor moved to adopt Ordinance #2019-21. Councilor Suarez seconded the motion. Ordinance #2019-21 was adopted by a vote of seven in favor, zero opposed. B. Consideration of an Ordinance to Adopt the 2020 Budget for the Town of Zionsville (PUBLIC HEARING AND FIRST READING). ORDINANCE #2019-22 Mayor Haak presented Ordinance #2019-22 and gave a brief overview and highlights of the budget, explaining it was a balanced budget which met the Town’s Reserve and Liquidity Policy. He explained that it included one-time expenses that would be funded with savings from several prior years. With Proof of Publication for a Public Hearing noted, President Garrett opened the Public Hearing for comment. With no public comment, President Garrett closed the Public Hearing. Mayor Haak answered questions from the Council. COUNCIL ACTION: President Garrett called for a motion to introduce Ordinance #2019-22 on first reading. Councilor Spees moved to introduce Ordinance # 2019-22 on first reading. Councilor Plunkett seconded the motion. The motion passed with a vote of six in favor, one opposed, with Councilor Schuler opposing. Ordinance 2019-22 was introduced on first reading. No further action taken. C. Consideration of a Proclamation of the Zionsville Town Council in support of the Zionsville Community Schools two referenda on the upcoming November ballot. President Garrett introduced the Proclamation, stressing the importance of the operating Referendum and the facilities Referendum in order to maintain the quality of Zionsville’s schools. COUNCIL ACTION: President Garrett moved to approve the Proclamation and Vice-President Traylor seconded the motion. The Proclamation was approved by a vote of seven in favor, zero opposed. 8. OTHER MATTERS There were no other matters to discuss. 9. APPROVAL OF CLAIMS. COUNCIL ACTION: Councilor Suarez moved to approve claims as presented. Councilor Spees seconded the motion. Claims were approved by a vote of seven in favor, zero opposed. 10. ADJOURN COUNCIL ACTION: President Garrett moved to adjourn the meeting and Councilor Hopper seconded the motion. The motion was approved by a vote of seven in favor, zero opposed.
